@bakcagain: OK then, I can agree with that. I failed to take his drunken state into account when I "surmised" he as looking at the dark horse. His reactions would be slowed enough that he could very well have been "surprised" by it.

It's "just an excuse" though, and the cops were right in arresting and charging him. Either way the Judge decides is valid, unless there's more evidence one way or the other (of course! That's always the case, eh?).

@5cat's I agree and have agreed with everything else you have said. I don't think he is a nice guy(I think he's a benefit scrounger), I don't think the cops were wrong in tackling him and arresting him(said thankfully he was tackled).

The only thing I'm saying is I believe him when he says "WTF a horse is infront of me" and panics like a little child. But as we all know, it's not a subjective test for self defence it's objective. Upto society to decide if the fear was reasonable which I don't really think it is. But I believe him when he says he was watching it go down and got scared.

So @Bakcagain: We're looking at the video, frame by frame, and we cannot decide if he did it "on purpose" or not?
HOW are the police at the scene supposed to know any different? It LOOKS like he did, so ARREST him for it!

To me, he's looking at the white horse 'straight ahead' at 34, then turns to his right at 35, and rather than get out of the way? raises his arms (fists) and steps TOWARDS the charging horse!
Also: The horse is practically stopped when it reaches him.
Plus he's probably drunk...
No matter how "nice a guy" he is while sober? In this video he's just another drunk in the MIDDLE of a riot, causing trouble.

He is a complete idiot. Yes he is in the middle of a public disturbance. Yes he is wearing a scarve across his face. And yes the police were right in their actions. But from watching that clip, he looks like he was oblivious to the horses coming directly at him and thinking they were going past him. He was standing on the side of the main road next to a photographer. He's an idiot who didn't see the obvious coming. But the way he prances round trying to lash out and then push away at the horse with his hand until he is tackled makes me believe him when he says he was shocked. It doesn't look like he had an intent or strategy, just "poo something in front go away" I don't think there is intent, but whether it is self defence will be for a judge to decide on him being that stupid, to put himself in that situation.

20-28 you see the police charging down to the junction. You also see several people on the large pavement area
28-32 you see the police tactically head back from the progressing hooligans
33 you see counter charge and mr punch standing on the side of the main road
34 You seem him watching the charge, already 2 policeman have gone past him down the main road
35 charge is gathering pace at least 4 coppers have past him into the group. one of the horse heads a an different angle towards him. From frame at 34 you can see he is looking at the white horse heading straight not the blakc horse heading towards him
35 he's off screen but you see the horse slow down and we know he punches it. He takes a stance
36-39 he keeps his left arm pushing against the horse as he prances round like a complete twat going around the horse
39 thankfully tackled by a cop and taken into custody

You don't want a police dog or horse to get punched? then how about you don't use them as a weapon?

I mean, apart from the obvious (to me anyway) issue of animal rights. WTF do you expect? and don't give me any crocodile tears either. We're talking hooligans, the most friendly sociable lawabidding citizens, enjoying a nice friendly game of soccer which as we all know calms the nerves and brings people together it makes for such a nice family friendly afternoon...

Your video: 0:20 the police charge. It's CLEARLY the middle of a riot. The parts showing bad crowd behavior seconds before are edited OUT.
20 > 28 you can SEE Mr.Punch standing there LOOKING at the police! Why does he have a MASK on his face?

Look at this video it's clearer

The guy appears to be a welfare cheat. The guy is a complete idiot waiting there during the chaos. But look at it he's standing to the side next to a photographer and a horse comes upto him and it looks like he's panicking. He's an idiot for standing there, he's more likely then not despicable welfare cheat. But it doesn't appear he is lieing about being shocked at a horse running into him and he swinging out. The guy is swinging all over the place until he is tackled.

I have family who are Newcastle cops. You might just get away with taking a swing at a cop, but if you go for a police horse or dog you will go down hard.

Question on his benefits unable to walk up the stairs without trouble but able to attend a football match.... However the video does look like someone who was spooked at a horse charging towards him and lashed out.
