Friday, June 05, 2009 1:24:57 PM The concept is a principle of the constitution. The legal effect is the interpretation of that principle. In the same was as a contract exist as an abstract 'meeting of minds' (the document itself is merely a record of some of that agreement) this principle includes a 'natural right' not to (for the sake of argument) be sat on or electrocuted. How each country chooses to enact this will vary but the underlying principle is considered enshrined in the constitution. Perhaps a more accurate term would be calling it a 'Hobbsian' natural right, but I thought that Habeas Corpus would be more readily understood. My point is that you shouldn't sit on people and electrocute them because even if the law at first sight seems to condone it the constitution doesn't. I don't think that the law enforcement chap commenting below realises that. |

"It protects the individual from harming him or herself, or from being harmed by the judicial system." The key part of the quote is... "the judicial system", meaning the court. Your take on the definition does not apply because Habeas Corpus is for prisoners who feel that are being incarcerated unlawfully. |

The cops should have, after the use of force, made some attempt to catch him. Lazy, I guess. c. The force was justified. He was not complying. d. They told him why they were arresting him. He had a warrant. The officers don't have to tell him what the warrant is for, because there are times when the officers don't even know. Folks, that's just the way it is. I spent several years in law enforcement. I'm not going by what someone told me, I'm going by what the law says. |

Thursday, June 04, 2009 7:17:24 PM He is Jewish (Yahwah) and extremely contradictory. His wife should get him help. He's not a hero. Yes, they DO have to state the arrest charge, however, they CAN hold him because of his erratic behavior, without a charge. They CAN claim they were taking him into custody for safety reasons. Cops seemed overwhelmed to state charge, so it's their mistake. Technically, it's not arrest, but for protection. Secondly, he is a complete moron for not cooperating. And life sucks. I was taken in for something I didn't do, but something someone claimed I did to "get even with me" at my college. Let's put it like this: This was a unit where they put suspected criminals who are a danger (whether claim was founded or not) with no separation from people under "observation". dog kennel cleaner. Denied meds. Sad thing is, they deny you rights, telling you you have none, even if you are completely calm and willing. He had the camera- if he were calm on tape, that would be one |
