SOME cops will. There are good cops who are actually trying to keep people safe. If someone's walking home and not causing trouble, great.

On the other hand, some police and even police departments make it more about meeting ticket quotas and charging fines. Auburnjunky, this might be of interest to you:


An Auburn, Alabama, cop was fired because he tried to speak out against crap like that. He was silly enough to think his job was to keep people safe and keep the peace. Turns out not so much.

You're absolutely right some cops do escalate the situation...as do some a@@clowns that feel a need to be a tough guy/gal. It goes both ways.

Lying down and sleeping it off will get you busted, too. I know a guy who spent a weekend in jail for that.

I'm with piratefish on this one. How pissed do you have to be to get the attention of officers? This isn't an issue except for a very special few, I'd guess.

Kcorb, too often the police choose which laws to enforce and which not to. Or when to escalate it and charge a higher crime...your word against theirs. Guess who the Judge believes.

Maybe this isn't obvious, but the Police do not make the laws, they just enforce. Our elected officials make the laws.

Or, you know, you could just not drink so much that you can't stand.

If you're so intoxicated that someone can look over and say 'that guy is drunk,'
-you went too far
-you need a cab

Usually, to get a PI in most cities (except possibly in some of small towns) you have to be pretty drunk, or creating a problem. I never arrested anyone for simply walking home drunk, nor do I know of any other officers who did. Not saying it never happens, I'm just saying it's pretty uncommon, and your chances of being okay walking home are far better than if you get behind the wheel.

They do it all the time. But only if you have the resources to pay the fines & court fees. If you are a staggering drunk homeless guy they don't arrest you and give you a warm place to sleep and a meal.

Freakonomics showed that drunk walking is every bit as dangerous as drunk driving. The only difference being, someone else is likely to do if you're driving. YOU are likely to die if drunk walking.

They'll only arrest you for public intoxication if you're making a scene and acting like an a$$hole. If you get picked up for that chances are you deserved it.

In PA, public intoxication is considered a crime if the drunken individual poses a danger to him/herself, property, or another person.

So, I could amble drunkenly down the sidewalk, so long as I stay on the sidewalk, without the cops picking me up.

Here in CA, public intoxication is only a crime if you also attack people physically or verbally. But they'll sometimes put you in the drunk tank if you pass out on the sidewalk.

They won't public intox you unless you are acting like an idiot, and public intox is a class 3 misdemeanor. the penalty is no fine and time served, which is usually 8 hours.
