I would go so far as to say that it is the civic duty of the public to videotape all police interactions and to make the video available to the police force, all effected parties (victim and alleged suspect, etc.) and the concerned public. This helps to ensure the integrity and good conduct of law enforcement and may be used by all parties to verify their truthful statements in court.

With the exception of weapons, the police fear video the most. Misconduct and deliberate misinterpretation/ recollection of a suspect's statement or actions is the basic mechanism by which they carry out their jobs. If they conducted themselves properly, their jobs would be much harder, and in some cases, impossible. Therefore, recording by the suspect or even passers-by constitutes a direct threat to their conviction rate, their job security and even their liberty. This is what they really mean by interfering with police duties.

You may consider the above observation cynical, but it is the truth.

hes probably got so many devices because his rights have been trampled on before?

He wasnt interfering he was observing and moved when asked the cops didnt like his attitude and that he was observing one of their colleagues and were pricks about it.

More specifically, you have to reveal your identity upon request or you can be detained:

Even in stop and identify states, police may only ask for ID if they are detaining you.

Note that the first thing the man asks is "am I being detained?" to which the cop replies "no"

Even if he is being detained, he does not have to provide an ID, he can simply state his name and address.

@Runeman - "When a cop asks for your ID, yes, you ARE required to fork it over"

says who? not where I live. Some states are stop and ID some are not.

An officer doing a traffic stop sees a guy hanging out behind him. He calls for backup for his own safety - he has no idea what the guy's intentions truly are. The (backup) officers simply asked him who he was (routine question), what he was doing there(routine question), then simply asked him to step back and away (routine procedure)... to which he argued and bitched and whined the whole time.

You don't play the "But I'm not TOUCHING you! ... I'm not TOUCHING you! ..." game with cops ordering you to do something.

The guy had two cameras and an audio recorder at a traffic stop of someone he presumably didn't even drating KNOW - he was there JUST to start poo and you know it. I've seen a lot of clips where cops abused their authority kicking away people filming ... this was not it. They were infinitely patient until the 50th "but I'm not TOUCHING you!" before removing him from the situation via squad car.

Citizens executing their rights shouldn't be taken as an attack on Police. Situations like this make people think cops have something to hide. In the end this only justifies people doing this to police.

I don't get it, he was asked to leave the property...He complied and they accuse and arrest him for tresspassing. I'm not quite sure how that works but ok.

@Denogginizer are you serious? He didn't do a single drating thing to provoke anyone. How is filming a traffic stop considered provoking? The officers were extremely hostile and deceptive. They wanted to arrest him right away for whatever they could. This is not how a law enforcement is supposed to behave.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Exactly what reason did this guy give them to ignore this amendment?

what petulant petty little men these cops are, they are the sort that give the decent ones a bad rep, hope he wins a large settlement against them and their jobs are taken away.

The ONLY thing I see that ANY of the officers did even REMOTELY wrong ... is not telling the wife where he's being taken (though I thought "jail" was pretty well implied). Beyond that, this guy was completely to blame, did it intentionally, and deserves 48hrs in the tank. This is not police abuse by any stretch of the imagination. This is one cop doing a routine stop, getting nervous about a werido behind him, calling for backup, and backup trying just to get this guy to back the drat away ... but no, keep poking the bears with a stick cuz that's all you're there for

"Resistance will be futile." ... LOL.

When a cop asks for your ID, yes, you ARE required to fork it over. Period. "I'm a journalist" and yet acting secretive, not wanting to say for who ... yeah, that's not suspicious at all. Officer says "stand over there in the shade" and you circle right back behind the deputy ... Are you a drating idiot? You are seriously conducting yourself as a possible threat. "You guys not used to citizens recording ...." ... these cops have been NOTHING but polite up to this point. ... and he keeps creeping closer to the deputy, then like a smartass steps an inch off the property and thinks that's okay. And then the wife FOLLOWS THE POLICE CARS ... wow, dumbdrat marries dumbdratette.

He needs to be beaten with a hose. The cop is just trying to do his job and this terdburgler is trying to provoke the cops into something that he can use to get noticed. He needs to get a life.

He is doing a real bad job at documenting this stop. I can't tell whats going on at all. 90% of the time the camera isn't even facing the stopped vehicle.

I love how they say they don't have to tell her where they're taking him. Does anyone else see a problem with that? This country is so far beyond messed up it's not even funny.

Sure, the guy was looking for an incident, but I think cops have to get used to the idea that people with cameras are everywhere, and their actions are going to be documented, whether intentionally or while the person is recording another event. They should be aware that they must follow procedures in the same way they expect the people they apprehend to. Learn to live with it; if they guys out looking for trouble find themselves ignored and with nothing to record, they'll go away.

I hope he sues, wins a big settlement so he can keep doing this. I thank him for upholding our (apparently bull$h1t) rights.

I'm sorry, but the amount of recording devices on this guy he knew exactly what he was doing. He was looking for a situation and he got one.
