@Gerry1of1: Spice is a substance that makes people appear drunk but with no test results for weed or alcohol. But the other officer say he would not have arrested him, yet it is still a possibility, true.

Gerry, I took another look at the clip and could clearly see they did test for cannabinoids... the list was long of what they tested him for, if he was stoned on something it would have to be a pretty rare drug.
This is sad to see, but NOT SURPRISING AT ALL. I hope he wins, and maybe, just maybe, it will happen less and less.

skypirate makes a good point. He could have just been stoned "under the influence" can be a range of drugs.

Should'a charged him with reckless driving, then there's no test, just the cops word. Of course, that's not as lucrative for the state as a DUI.

[Based on the video...] He should win a settlement (no idea if $500k is the right amount). And the officer should be terminated.

The system is based on generating government revenue. The only remedy for this is monetary, but Gerry's right -- a monetary loss will be compensated by an increased propensity to catch people. Fine with me: Send more police officers out to catch speedsters and reckless drivers and drunk drivers out on Saturday nights. But don't arrest anyone for DUI with a 0.000 BAC.

It's possible that him being black had nothing to do with it. But c'mon - there is quite obviously racial bias when it comes to police arrests. Let's not be naive.

not saying this isnt BS. But my mom (therapist) sees court ordered people for DUIs not related to alcohol all the time. all .000 dui in AZ isnt a new thing.

Dumb arrest and he should win the lawsuit. But where did his race come into this? Did the cops use racial slurs? I doubt it. I'm not sure if being black had anything to do with it.

MrOrange - logically a large settlement should discourage this behavior. But then they'd need to raise funds to make up for the loss, so...

Think of it like this, have large settlements stopped police beatings?

There are moronic imbeciles in every profession. I am married to a deputy, but prior to our relationship, I was constantly stopped and harasses by police officers because "I looked like I was up to no good" even though I've never been arrested, obtained a speeding ticket nor broken any laws, ever.

Is that's the case and i can certianly see it as an option it happens over here too. wouldn't a massive settlement to this guy be a "good thing"?

Not "reality" drunk, just legally.
When the law does not reflect reality it should be trashed. But it will increase the convictions and this fills the coffers, and that is after all what the police and courts are for.... fund raising.

I'm with Gerry on this. It's more quota BS. If the officers don't make enough arrests, it's automatically assumed they aren't doing their jobs. Not that their enforcement is actually working and lowering that particular crime rate.

Once again success is seen as failure by faceless bureaucrats.

Many cities do resort to pressuring for more and more arrests when their coffers are running dry, which is why it's my belief that tickets and arrests like these, as well as stoplight cameras, are more about taxation than enforcement.

I agree with broizfam. It seems like he's had this problem SEVERAL times and has filed multiple complaints to no avail. I don't like the idea of him getting money, but some PDs won't do anything about complaints unless they're financially threatened. Some PDs still won't do anything even after they've been financially threatened.

On one hand I agree with you, he was angered, not harmed, at least not physically. But he's apparently had this problem several times. He was held for no good reason, against his will. Personally, I feel he deserves compensation and the town needs not only to fire the offending officers but, also, to have a compelling (that is, financial) reason to make sure that ALL of their officers are clear on what constitutes appropriate reason for detainment and arrest. This kind of behavior is, was, and will always be inexcusable. (By the way, I've read your posts and I know you agree with that last part. It just needed to be said!)

Officers are under a lot of pressure to make DUI arrests. Not because it makes the streets safer, because the states/counties/cities make a lot of money. Fines, court costs, court-ordered rehabs you have to pay them for, impounding your car/storage fees, court ordered safe-driving courses they get a cut of.... Same thing with pot, they'll never legalize it. Too lucrative.

I was charged with a DUI while walking on the sidewalk. The charges were later dropped (after much fighting). Unfortunately, in my state, just for being arrested and charged with DUI your license is automatically suspended for 6 months... That was another fight in itself.

I like the idiotic assumption of racism here, even without knowing the details. For all Naitsirhc88 knows, the arresting officer was black.
