I agree that the huge claims are a problem.
But the best way (in my opinion) to halt frivolous litigation is simple: 'Loser Pays'.
As it is now, anyone can sue any person/business for the price of filing the initial lawsuit, which is less than $100 in most places.
So technically, I could sue GE for $16million because they sold be a defective can opener that cut my finger. GE would have to have defend itself with lawyers and time while I represented myself.
More than likely, I'd lose, and I'm out the $75 filing fee, but GE would be out hundreds of thousands.
NOW, if I were to know that if I lost I'd have to pay court costs, GE's costs, etc, I'd be less likely to file frivolously. |

This is called 'gallon-smashing' apparently it's the new 'planking'. It's wasn't funny the first time, or 10,000 videos later. I believe I have a great sense of humour, but this just pisses me off. It might be a bit presumptive of me to assume so, but the majority of these little c.ocksnaps are probably from families that are well-off and will probably head straight to college after high school and never have to work a job where they might be responsible for cleaning up the mess the next generation of Fu-ktards will leave behind. |

the sad thing is that might actually work. I remember one case where a girl broke up with her boyfriend, threw her drink at his face (while spilling some on the floor) and then proceeds to get up and slip on her drink. She successfully sued the bar for not having a "wet floor" sign. |
