Unfortunately for the waitress, it's well documented that she received the money, so Uncle Sam will be sure to audit her if he doesn't get his cut.
She's only required to claim up to minimum wage. Say she makes $2.13/hr. She's only required to claim $5.12/hr, technically.
When I delivered pizza, I never claimed poo because I made above minimum wage. IRS never said a thing. |

She could always just say she passed it around to everyone who works there. It would be hard to prove who got what. I doubt the IRS will worry about $500 anyway. If you earn less than $600 from one source you don't even have to claim it. |
