Ok, Crakr, I'm better now. To anyone interested, here's a good blog from a lawyer who explains how funnyjunk really has no case, and is trying to bully Oatmeal into paying $20K. |

The lawyer was questioned and says he's going to try to stop the donations because the website hosting is'nt for uses such as these or something |

Gerry: I have to agree with patchgrabber on the 'extortion'. Funnyjunk isn't presenting a 'bill' for lost income they are threatening to inform to cause federal legal action. Funnyjunk can't prove actual damages, whereas The Oatmeal CAN prove copyright infringement.
The Oatmeal has nothing to fear here, they haven't libeled, been the cause of harm to reputation or income to FJ or violated any federal law. FJ has damaged itself by being a dick and sending this latest letter just proves that fact. |

This IS an extortion attempt. Basically the site in question is claiming to sue for libel. They say they are being libeled on another website, TheOatmeal,resulting in a loss of income. However if it's true, it isn't libel. And it can be proven that Matt's claims about their infringements are true. |

Apart from being stupid and ignorant (e.g. the ludicrous claim about how to manipulate Google search results), the case would be thrown out because of the clearest and best defence against an accusation of defamation - the statements made are provably true. Funnyjunk was making money from selling advertising on a large number of unauthorised, uncredited copies of The Oatmeal's work with the credits edited out of the comics. They can argue that they're allowed to do so, and maybe they are, but they can't argue that they weren't doing it.
yup...i like the fact that they are trying to claim that old blogs that pointed out what FJ were doing are slander when they deleted the content after their creation
it's like swiping something from a shop, being caught red handed, then simply putting it back and being outraged about the accusation (especially when the shop owner was ready to let it go after it was put back) |

I really hate those kind of people...
A woman in my building keep having lawsuits for random crap... last time she sued the condominium for something that had nothing to do with us, she lost, then we sued her to make her pay the lawyer fees that we had to pay to defend ourselves, she was pissed ^^ |

My guess is that Funnyjunk is going out of business and is flailing around trying to grub up some money from somewhere. Why else would they try this ridiculous scheme to coerce money from the Oatmeal on the basis of a post made a year ago, which they replied to a year ago? |

I'm pretty sure this would get thrown out of court for being so stupid anyway.
It's almost certainly just an attempt to silence the target by using an expensive lawsuit as a weapon to threaten them with. In which case the lawyer is still either incompetent or following orders from someone who's incompetent, as shown by demanding $20K. That's too much to be written off.
