It's fair! This idiot doctor will now have to pay higher insurance premiums, just as the "mother" will have increased financial responsibilities too. A lump-sum isn't as good as payments over time. Both combined are the best! |

An similar case hit the courts here in Norway in the 90's. It was a man that had been sterilized in 1986, but he knocked up some woman later and he sued the hospital, claiming they should pay for the child's upbringing. It went all the way to Supreme Court, where he lost, on grounds of that having a child is a unconditioned gift, and regular fairness. He wanted to keep the child though and said that he would be responsible for it's upbringing. Just not the financial part.
It raises interesting damages- law questions, both US and European courts have similar damages- rules but some courts, like the Norwegian court opens up for other considerations than financial loss and culpability etc.. |

This makes no sense...how do you fail? Its not like cancer or something(where operations can remove some tumors and the cancer still spreads), it happens or it does not..how did they not know the abortion was a success? And oldollie, your a idiot..I disagree with late term abortion unless a safety risk to the mother, but early term??? If the fetus can not survive outside the body of the mother then its not murder. 7 billion of us and counting, mistakes happen..get off your high horse. |

It sounds odd because it's a monthly payment. Judge could have slapped a lump sum malpractice fine. Same thing.
It's easier for the doc financially to spread it out. |

I feel like if you kill someone out of pure negligence, criminal charges should be filed and you should lose your license to practice. Just my opinion. |

Honestly, not enough doctors answer for their mishandlings in hospitals. Kaiser injected the wrong medicine into my friend and they gave him 100x the amount you're actually supposed to give of this wrong medicine. He died in 4 data because it deteriorated his brain. Not one doctor faced criminal charges. The family win a civil suit though. Chris Wibeto. You can look his story up. |
