Thursday, May 31, 2012 8:06:58 AM "By that logic, if my mechanic doesn't fix my car then he has to make the payments for me." Yeah, i was kind of wondering if they let this happen, doesn't it sort of set a kind of precedent? |

Wednesday, May 30, 2012 12:02:17 PM Stop performing abortions Doc. You obviously suck at it. @aj: BAD PUN! BAD! (lolz, it's subtle though!!) It's fair! This idiot doctor will now have to pay higher insurance premiums, just as the "mother" will have increased financial responsibilities too. A lump-sum isn't as good as payments over time. Both combined are the best! |

Wednesday, May 30, 2012 5:00:55 AM I wonder what the doctor would have to pay for this mishap? The 22-year-old mother, who has three other children, told her family she knew something was wrong when she heard something 'crack'. Baby decapitated |

Wednesday, May 30, 2012 2:30:57 AM An similar case hit the courts here in Norway in the 90's. It was a man that had been sterilized in 1986, but he knocked up some woman later and he sued the hospital, claiming they should pay for the child's upbringing. It went all the way to Supreme Court, where he lost, on grounds of that having a child is a unconditioned gift, and regular fairness. He wanted to keep the child though and said that he would be responsible for it's upbringing. Just not the financial part. It raises interesting damages- law questions, both US and European courts have similar damages- rules but some courts, like the Norwegian court opens up for other considerations than financial loss and culpability etc.. |

Tuesday, May 29, 2012 11:27:43 PM This makes no sense...how do you fail? Its not like cancer or something(where operations can remove some tumors and the cancer still spreads), it happens or it does not..how did they not know the abortion was a success? And oldollie, your a idiot..I disagree with late term abortion unless a safety risk to the mother, but early term??? If the fetus can not survive outside the body of the mother then its not murder. 7 billion of us and counting, mistakes happen..get off your high horse. |

Tuesday, May 29, 2012 10:41:21 PM 16 year old kid: Mom, why do we get these checks every month? Mom: Oh, you see, when you were still inside me i tried to abort you, but it didn't work. So I sued the doctor to make him pay for you. 16 year old kid: Holy fu*k that's worse than being adopted! |

Tuesday, May 29, 2012 10:00:43 PM Why call it child support, just call it malpractice suit and the docs insurance pays the total? |

Tuesday, May 29, 2012 9:35:11 PM It sounds odd because it's a monthly payment. Judge could have slapped a lump sum malpractice fine. Same thing. It's easier for the doc financially to spread it out. |

Tuesday, May 29, 2012 5:12:32 PM "That's because medical malpractice is a civil matter, not a criminal matter." Tell that to Conrad Murray - Michael Jackson's doctor - who was found guilty of involuntary manslaughter in connection with MJ's death. |

Tuesday, May 29, 2012 5:04:22 PM I feel like if you kill someone out of pure negligence, criminal charges should be filed and you should lose your license to practice. Just my opinion. |

Tuesday, May 29, 2012 4:15:46 PM LOLOLOLOLOL!!!!! THAT DOCTOR GOT OWNED!!! Honestly, not enough doctors answer for their mishandlings in hospitals. Kaiser injected the wrong medicine into my friend and they gave him 100x the amount you're actually supposed to give of this wrong medicine. He died in 4 data because it deteriorated his brain. Not one doctor faced criminal charges. The family win a civil suit though. Chris Wibeto. You can look his story up. |

Tuesday, May 29, 2012 3:47:20 PM What a great thing to tell the kid when he gets a little older.. "I wanted to abort you, but the doctor botched it. So to alleviate the pain and suffering of having you, i sued him".. That'll probably not leave emotional scars, right ?.. |
