well originlemming, what i find funny is that in your frenzy to bash all things American, you use examples of dbaggery that happened before America existed, by your logic you surely have relatives that fought for the US in vietnam and therefore it was a european act. Also you might take notice of the little"where from" areas next to the avi's, they dont say germany or sweden or france, they say EUROPEAN you drating self righteous douchebag. so we are FORCED to lump you all together on this site so if you want to be recognized by a more detailed geography you should post it on your bio. all drating lemmings can suck big fat American balls. and drat you and whatever country you are from specifically. |

For those who keep "missing it" the main reasons the SYG Law didn't apply were:
#1 She returned to the house, pistol in hand. The man did not stop her from leaving.
#2 She DID get bail! And promptly violated it to assault & batter the man she 'was terrified of'.
#3 There were 3 charges, she cannot claim the children were also attacking her (depending on their ages).

So why isn't he being charged with 3 counts of aggravated assault? If all it took was the "fear of death or dying" then how the hell would a haunted house ever be able to operate?
Since only one shot was fired, there should only be one charge, by my reckoning.
Otherwise by your reckoning if she had fired 3 shots she'd be facing 9 counts. |

It's real easy to play Armchair Quarterback when you only have information on one side of the story. Of course the media knows the prosecutor cannot comment on the case so they know it's going to be a one sided report. |

CrakrJak, she caused three people to fear death or significant harm. Thus the three-times charge of assault. No physical harm required. I wasn't speaking to this case, only to the specificity and difference between "assault" and "battery" and why should be charged with assault without physically hurting anyone.  No argument from me, just talking about legal definitions. |

SmagBoy: I noticed that in the court report, that was linked to below, that there was no mention of the 'victim' strangling her. There was also information that she could've exited the house in other ways and that the 'garage door didn't work' excuse was false.
Later she violated a court order of protection by going to the victims house.
So her explanation, saying she was afraid for her life because of her husband, didn't hold water with the judge.
Thing is though, she shouldn't be charged with 3 counts of aggravated assault, she only shot the gun once and even then she shot it into the ceiling, even though the victim claimed it was aimed at him. |

Her "the garage door didn't open" has not been duplicated, it worked before she ran there AND afterwards too.
Yes it's tragic that victems of spousal beatings (married or dating, male OR female) have such trouble leaving their abuser. However, shooting at him is one thing, his kids in the room is another, and violating your probation on DAY ONE to beat him up?
