Wednesday, January 18, 2012 4:58:01 PM Who seriously sleeps through getting raped? Having thought about it, I'd say it was possible. If it was done without force, the sleeping person's unconscious mind might not perceive it as an attack and they might remain asleep. Maybe. But add drugs and it's definitely possible. I've "slept" so deeply with drugs that people have cut me open, looked around inside me, moved some of my innards around for a better look and done some cutting inside me, all without waking me up. |

Wednesday, January 18, 2012 4:47:08 PM I don't fancy watching the video, but the wildly different and conflicting statements about it from people who have watched it interest me. On the one hand, there are people saying that it's such low quality video and so heavily obscured that you can't see anything at all, e.g. "You can't even tell there is a woman in the video." On the other hand, there are other people saying you can see everything clearly. Can't both be true. If they were both drunk and consented to whatever actually happened (which is apparently impossible to tell), then it's not assault of any kind. If she was unconscious and he wasn't, then it's assault of some kind. |

Wednesday, January 18, 2012 4:33:03 PM Consider one simple fact. The woman never once moves, except when he moves her. It seems fairly apparent she was unconscious. That's Rape, plain and simple. I tend to agree that if someone consents to sex while drunk, it's not rape, no matter how much they regret it in the morning. But that doesn't seem to be what's happening here. She's literally not moving. The only time her body moves is when he moves her. That's Rape. |

Wednesday, January 18, 2012 4:30:40 PM Who seriously sleeps through getting raped? Nobody, obviously. But if "sleep" is being used as a euphemism for "took enough of a drug to make myself deeply unconscious", then it's a possibility. Are we sure this isn't some bs? No, we're not. But it won't matter - a conviction in a rape trial doesn't depend on what really happened. That's true of all trials to an extent, but especially so in rape. The guilty go free and the innocent are convicted and nobody really has much idea how often either of those things happens. |

Wednesday, January 18, 2012 4:23:43 PM That's not really a possibility. Substance abuse is no excuse for breaking the law, which is why we don't have people being able to say Accused-"Sorry, judge, but when I robbed that 7-11 I was drunk" judge-"Well, boys will be boys." That counters the argument used, but the scenario you're replying to was about two adults having consensual sex while drunk. You have three choices: 1) Charge them with raping each other. 2) Charge neither of them with rape. 3) Decide who's a rapist and who's a victim based solely on whatever irrational prejudices you favour. Sexism is by far the most popular, but any would do. Say, for example, one is Canadian and one isn't - the Canadian is the victim and the dirty foreigner is the rapist! One's a Christian and one's an atheist? Everyone knows atheists are hellspawn, so they must be the rapist! Or use racism, or whatever other bigotry you like. But it is bigotry, foul |

Wednesday, January 18, 2012 3:36:29 PM I've never understood the discrepancy between driving under the influence and consenting to sex under the influence. People make bad decisions either way, but they're still responsible for those decisions and the consequences of them. |

Wednesday, January 18, 2012 6:35:39 AM zombunny-"Having sex with someone without their consent = rape." Agreed. But there are some times when a women, who is drunk and not rational, will say 'Yeah Baby!' and when sober will regret it and decide it is 'rape'. (rescinding the consent AFTER the fact) By the same token the man, who is drunk and not rational, will believe the 'Yeah Baby!' is consent, and when sober is facing a rape charge. ('but she said "yes".' Well she changed her mind. "When?" A week later.) The difference? One is held accountable while under the influence, the other is not. (I'm not saying neither should be held accountable, I'm saying BOTH should.) Reality is: Some men are animals, and are capable of raping women. Also, some women are animals and will lie that it was rape. The best bet is: -stay sober enough to keep your wits about you -hang out with those you trust -when in doubt, keep your wick dry. |

Wednesday, January 18, 2012 5:49:40 AM "i guess you could say don't get drunk to the point you are passing out with people you don't know or trust as well" Uh yeah, except most rapes are committed by someone the victim knows and trusts. |

Wednesday, January 18, 2012 5:29:40 AM If a man's drunk and has sex with a drunk woman, neither should be charged with statutory rape. As her higher faculties were impaired she could not have consented, but likewise, he could not consider the full legal implications of his actions. That's not really a possibility. Substance abuse is no excuse for breaking the law, which is why we don't have people being able to say Accused-"Sorry, judge, but when I robbed that 7-11 I was drunk" judge-"Well, boys will be boys." |

Was she so drunk she's passed out or is she so drunk she's blacked out? Cause if it's a drunken black-out, she might have given consent but doesn't remember the next day. That poor, poor innocent man acused of rape! |

Tuesday, January 17, 2012 9:18:40 PM Scuzoid-"if you're over 25 and you didn't do something you somewhat regretted under the influence of alcohol, you're not normal." Nope, just intelligent. Done things I regretted, didn't require alcohol to do so. Scuzoid-"It's normal for a reason" Sorry, but nothing about getting 'blackout drunk' is 'normal'. Just stupid. Scuzoid-"Humans don't live under bridges Grendel." Now,THERE'S and inane observation (and a totally incorrect one. Seeing as 'some' humans DO live under a bridge, that is easily proven as false.) Scuzoid-"tweeny who hasn't gotten this drunk yet, you're missing out" Actually, I'm 45, and have not gotten drunk yet (which is not to say I do not drink, because I do, I'm just too responsible to drink to excess.) And no, I'm not missing out. It's entirely possible to have a great time WITHOUT getting blackout drunk (and, if THAT'S your idea of 'fun', you need to look up th |

Tuesday, January 17, 2012 8:51:29 PM "The woman is clearly unconscious" Get over yourself. You can't even tell there is a woman in the video. I suppose CNN shouldn't report the story either, considering the story has actual information. I mean really, where were you when the video of the tilted cruise ship was posted? I mean, you can't tell, but there ARE dead people inside of it. Where's the outrage over that? |

Tuesday, January 17, 2012 8:45:03 PM Grendel, I get it, you're a troll and you abhor human contact. Whatever works for you bro, but if you're over 25 and you didn't do something you somewhat regretted under the influence of alcohol, you're not normal. I know you want to think this makes you special as I'm sure you fall under this category, but it really doesn't. It's normal for a reason, even though you regret it, it's still fun at the time. Humans don't live under bridges Grendel. So yes, if you're Llamakhan or another tweeny who hasn't gotten this drunk yet, you're missing out. |

Tuesday, January 17, 2012 8:32:31 PM You can't tell anything from this video OR the story. Was she sleeping and he randomly came in and got in her bed? That's rape. Were they both drunk and in her bed and she passed out in the middle of behavior she was obviously already consenting to? That's sketchy as all hell but not really rape. This isn't just a matter of someone possibly being raped, it's also a matter of someone possibly going to jail for ten years. The footage we will never see will aid in the law deciding his sentencing (if any), all we can do is hope they're both honest about it. |

Tuesday, January 17, 2012 8:24:50 PM jadedtortois-"If this video isn't removed within the next 24 hours, I will absolutely never come back to this site." Life's tough. It's not fair and is often cruel. You have the right to be offended. So what? Good riddance. (hint: a 'threat' is supposed to involve repercussions that others would DISlike) |

Tuesday, January 17, 2012 8:19:56 PM Scuzoid-"get out more and do some serious drinking with close friends." Why would you adise us to do something inherently stupid that leaves one more susceptible to doing idiotic things? Do you also tell your kids to go play in traffic, with scissors, wearing a plastic bag over their heads? Scuzoid-"I had no problems at all sleeping through far greater physically violent activities after a blackout binge than mister four incher put this woman through. “ So, because you admit to being an idiot, you believe that others should be just a stupid? Scuzoid-"real men don't frack until she begs for it." This guy wasn't a real man. Real men also don't feel the need to partake in 'blackout binges'.

Tuesday, January 17, 2012 8:11:30 PM I am extremely offended that a VIDEO of someone being RAPED is being posted. The woman is clearly unconscious, and has no idea she is being raped. This is just vile, and disgusting. How dare you de-humanize the situation by posting it like its a LOLZ moment for a drunk girl. drat you guys. |
