Tuesday, May 10, 2011 3:59:04 PM A few things. First, his crime wasn't smoking it, it was dealing it. $1600 and 2 pounds of the stuff. Second, this wasn't his first offense, but his fourth. He got off with probation on the three prior convictions, but didn't this time. Third, he wasn't given life for dealing pot, it was given life for being a repeat offender. That's a different law. A technicality, yes, but one worth mentioning. I personally think that he should have gotten the maximum sentence allowable by law for the dealing offense, and NOT the mandatory sentence of life. That has more to do with my opinion on mandatory sentencing than on the legality debate about pot. |

Tuesday, May 10, 2011 12:38:53 PM I can't watch the video because I'm in public and without headphones, but, if this is one of those three strike deals, it's ridiculous. You should get punished appropriately for the crime you commit. Life in prison for four minor offenses is just lazy legislation and lazy judicial execution. The point of the human element of the judicial system is to appropriately judge the severity of a crime, rather than applying a blanket rule where it might not be appropriate. Whether you agree with marijuana being illegal or not, it is a minor offense in comparison with rape, murder, and most other crimes. To sentence a marijuana user with life in prison when other, worse crimes are getting off on parole, is just wrong. |
