I just remembered something, if you say they can't search they can get suspitious and call for back up or a drug sniffing dog. I don't personally know, so don't hold me on that. Some places have weird local laws that can help you too, if you know them, for instance someplace in Idaho if a police officer suspects you are having sex in your car they have to wait a few minutes to give you time to get dressed before they can come up to your car if I remember that correctly. They might not even follow those kind of laws though but its nice to know just in case XD just look on one of those dumb-laws sites.

Chrom... that has nothing to do with probable cause. If the officers have probable cause, they are not going to ask. I know an officer that will ask to search every car with 4 kids in it. If they say no, he moves on. But, on occasion, he gets a "sure", so he searches. He's found stuff on a search where he had no probable cause, but consent. Go figure...

This is complete and Utter BS as no one knows what probable cause is!!! I work at a PD and I know for a fact this is crap

5. No Searching.
Do not allow the police to search anywhere! If the police officer asks, they do not have the right to search and must have your consent. If you are asked make sure you proclaim to any witnesses that "You (the police) do not have consent to search." If they perform the search anyway, that evidence may be thrown out later. Also, if you consent to a search, the officers may find something that you had no idea you had placed somewhere, ie: marijuana left by a friend. Remember, that denying the police consent to search DOES NOT give them the probable cause they would need to conduct a search.

I say a guy who was pulled over by my house. He said NO! U may NOT search my car. He had no slur or any other signs of being drunk. They did a search anyway. He is now in jail for: Having alchol in his car. NONE missing from the case. Justice?

Indiana... that's where I'm from.

Malletman, some people (drunk, of course) in Indiana think they can request a blood test, but the law here actually reads something to the effect that a blood test can be offered. It doesn't say anything about being requested. It just gives another option for the police.

i preferred reading the '14 most evil companies' article, and the one about the us congress being essentially full of criminals. i guess they're stating the obvious but still interesting to read just how much we're getting fuc'ked every day of our lives by the people who are supposed to serve us fairly and protect us.

RE: Searches:
I know in FL at least, if you have a party in a screen-enclosed pool area, it's not considered plain sight.

Honestly, you should have stopped with "don't drink and drive" or at least given the state that the information you are offering is applicable to.

Me, I'm happy that we have stringent DUI laws in a state that I'm not going to divulge.

second, where I live, if you are offered a test and refuse, then you automatically lose you license for 1 yr. Also, when you go to jail, you MUST stay in for at least 15 hrs before you can be released. If you do take the test and fail, you usually only lose your license while the case is pending. That's if it's a first offense. When you go to jail, they release you as soon as your sober.

Wait, it said don't leave your home? I've always heard to step outside onto the doorstep and talk to them there, because if something was going on inside, the cops could see it through the door and wouldn't need a warrant.
