The cop was having a personal conversation on his phone and was upset about it. Out of control cop? Maybe he just found out his wife was cheating or that he has cancer, you don't know. With no video, it`s just this guys word that the cop was even yelling.

Not very likely. You can rescue deleted files immediately after deletion, press record again and the chances are more than likely that the data gets overwritten partially. Since it's flash memory, the overwriting process is totally random, rendering pretty much all unallocated memory useless. Any kind of use afterwards will make the chances of recovery nill.

I bet there are people around being able to find out wether there was a clip recorded, restore it and find the date and time it was erased...

If he was recording an out of control cop there must be other people around to back up his story. Not that it's not plausible, but if he can`t prove it it didn`t happen.
