This is one instance where I'd actually side with MeGrendel, Ollie, and many others I usually don`t. I suppose the legal equivalent of this would be "voluntary assumption of risk," meaning that if you break into a person`s house (in Kentucky no less), you had better assume that if the owner catches you in his house he will probably shoot you. I don`t know anything about this would-be thief, and if he`s had a hard life I empathize with that to a degree, but that does not excuse breaking into a person`s house. He rolled the dice and lost, simple as that.

I've shot a .22 rifle. It`s practically a pea-shooter. You can certainly seriously hurt some one, but to actually kill them without shooting them in the head is damn impressive.
