@Ozmose and MeGrendel
Grendel is right, (never thought I'd get a chance to say THAT) if he had gotten his information from the bottom of a bag of kittens, if the information is correct, he is still right. It may be the case that the kid should not have had his phone out in class, but he is right regardless.

Ozmose-"the fact that the argument is invalid, because the entitled little ****stain shouldn't be playing with his toys in class."
So, because YOU don`t like how the evidence was obtained, you beleive the argument is invalid? How convenient.
Cell phones are a fact of life, and as long as they are not a disruption it`s not an issue. In this case, WITHOUT the usage of the phone as a recording device, this Indoctrinator would still be in the classroom, shouting down and belittling anyone who didn`t bow to her narrow, biased view and attempting to dictate what constitutes `facts`. (of course, you`re all for that).
Any person should realize that any public forum is open to recording.
