Who seriously sleeps through getting raped?


Having thought about it, I'd say it was possible. If it was done without force, the sleeping person`s unconscious mind might not perceive it as an attack and they might remain asleep. Maybe.

But add drugs and it`s definitely possible. I`ve "slept" so deeply with drugs that people have cut me open, looked around inside me, moved some of my innards around for a better look and done some cutting inside me, all without waking me up.

I don't fancy watching the video, but the wildly different and conflicting statements about it from people who have watched it interest me.

On the one hand, there are people saying that it`s such low quality video and so heavily obscured that you can`t see anything at all, e.g. "You can`t even tell there is a woman in the video."

On the other hand, there are other people saying you can see everything clearly.

Can`t both be true.

If they were both drunk and consented to whatever actually happened (which is apparently impossible to tell), then it`s not assault of any kind.

If she was unconscious and he wasn`t, then it`s assault of some kind.

Consider one simple fact. The woman never once moves, except when he moves her.

It seems fairly apparent she was unconscious. That's Rape, plain and simple.

I tend to agree that if someone consents to sex while drunk, it`s not rape, no matter how much they regret it in the morning. But that doesn`t seem to be what`s happening here. She`s literally not moving. The only time her body moves is when he moves her. That`s Rape.

Nobody, obviously. But if "sleep" is being used as a euphemism for "took enough of a drug to make myself deeply unconscious", then it's a possibility.

No, we`re not. But it won`t matter - a conviction in a rape trial doesn`t depend on what really happened. That`s true of all trials to an extent, but especially so in rape. The guilty go free and the innocent are convicted and nobody really has much idea how often either of those things happens.

That's not really a possibility. Substance abuse is no excuse for breaking the law, which is why we don`t have people being able to say
Accused-"Sorry, judge, but when I robbed that 7-11 I was drunk"
judge-"Well, boys will be boys."



That counters the argument used, but the scenario you`re replying to was about two adults having consensual sex while drunk. You have three choices:

1) Charge them with raping each other.

2) Charge neither of them with rape.

3) Decide who`s a rapist and who`s a victim based solely on whatever irrational prejudices you favour. Sexism is by far the most popular, but any would do. Say, for example, one is Canadian and one isn`t - the Canadian is the victim and the dirty foreigner is the rapist! One`s a Christian and one`s an atheist? Everyone knows atheists are hellspawn, so they must be the rapist! Or use racism, or whatever other bigotry you like. But it is bigotry, foul
