"Gender is a social construct"
Gender defines the roles that one relates to, while sex is the physical traits.
There is a difference between biological gender and social gender. You can be one bio gender, and be the opposite social gender if you follow the mannerisms and actions of that gender.
The problems arise when you have a male who is considered to be efeminate or a woman who is butch. If one was to follow the rules of social gender, then the efeminate male would be gender female and the butch female would be gender male. They could also be considred gender ambiguous. There are many non transsexual/transgendered who would take exception to that.
