The guy got out and was told to put his hands behind his back. He was not told that he was under arrest from the onset. Next thing he know he has a taser pointing at him and thought it was a guy. Granted to say that his next move was not the brightest but I would say that in his shoes I probably would have reacted the same way. He refused to sign the ticket because it was not completely filled out. It did not list the speed on the ticket, I would have refused to sign it also until it was completely filled out. Utah law states that a traffic citation must be completely filled out so in that instance the officer violated the law. I also question your liberalism...you statement are anything but liberal. Like I said in my other post we are becoming a police state...act like good little sheep or we will tase you...think about it

Robbery525 you don't have to read Miranda rights to someone you issue a traffic citation to...it is a civil procedure not a criminal procedure. Once an arrest is made you need to read Miranda rights to someone before you question them. He was not interrogating him during the arrest and did not question him. The search was also legal, it is called a search incidental to arrest. Once he is under arrest he is taking control of the vehicle and has the right to search it. He also had the right to tow it but the wife took possession of the vehicle, that is officer discretion. The officer was cleared by the internal investigation and then their finding were sent to the prosecutor. I don`t know what the outcome of that was but I did find a story about the guy filing suit against the state and he is fighting the ticket. MatthewJohn, when the officer ordered him out of the vehicle he did not tell him the reason so the guy thought that were going to look at the sign.

I'm a liberal through and through. When I saw that kid get tazed at the Kerry convention for asking questions, I was outraged; what a drated up country we live in. But this...the kid in the vehicle was a smart ass who didn`t know his place. He could`ve signed the ticket, gone to court, and appealed the whole thing, no problems whatsoever. Instead he bitches and moans like a little kid and then gets out of the car, walks away from the cop twice and puts his hands in his pocket, and asks what the hell is the matter with him. We`ve all seen "Cops"- you know thats exactly the type of thing that goes down before the kid would make a break for it.
I think our restrictions on police brutality are utterly laughable. Oh, that cop sure hit that rapist pretty hard! We`re gonna make sure he gets fired! And then we sit and wonder why there`s such rampant drug use in the country today, why our cities are in such piss poor shape, and why it seems as though everyone is suddenly a criminal
