That only applies to countries that have in their constitution. Guantannamo Bay, acoording to the Geneva Convention, does not exist.

Oh, and the only way the writ of habeus corpus can be removed/extended is in times of war. Lucky we're in Iraq, but I don`t believe that qualifies considering they weren`t holding her for war crimes.
