Georgia couple loses custody of son after giving him marijuana to treat seizures

Excerpt from CBS article: A Georgia couple who says they gave their son marijuana to treat his seizures, is fighting to regain custody of him. The state took custody of Matthew and Suzeanna Brill's 15-year-old son, David, in April when he tested positive for marijuana. They are charged with reckless conduct and facing jail time.

The Brills say their 15-year-old son David went from having up to 10 seizures a day to being seizure free for 71 days after he began smoking marijuana, reports CBS News' Omar VIllafranca. The couple said he's never gone that long without a seizure before. 

"For our son, it was a miracle for him," Matthew said. 
  
Georgia has some of the strictest marijuana laws in the country. Physicians are not allowed to prescribe marijuana for medical use and it's illegal to sell or possess it. But the law does allow those with a state-issued medical card to possess low THC oil. 

"The only way he could get a medical card would be a six-year waiting list," Suzeanna said.

So the Brills, frustrated with traditional prescription medication, took matters into their own hands. 

The Brills were charged with reckless conduct after someone alerted the Georgia Division of Family and Children Services. The couple said they spent six days in jail. On April 20, David was removed from the Brills' custody. That day, he had a seizure and had to be rushed to a hospital.

bearbear01 That is an interesting article. I call into question the citation from the Treaty of Tripoli. I have been given to understand that the quote given is a mistranslation. I know that it doesn't appear in the English language version, but I can't read Arabic.
Note that only Thomas Paine of the five listed was an atheist.

monkwarrior I would imagine that the context matters. This could be a prologue to saying that humans have an added morality which should deter from going on a raping rampage. And this morality exists and is by no means exclusive to the religious.

Not to mention the raping pedophile priests, which you have yet to condemn. So much for their religion or god holding them moral. Or whomever's who is their apologist.

Maybe all drugs should be legalised. Ideally not all drugs. Some drugs still need to be carefully controlled. For example, someone with a satchel full of Fentanyl could poison a whole water supply. Some drugs should not be sold or possessed in distribution quantities, such as PCP and Krokadil, because that'd cause people great harm and there's no good reason to take it if clean alternates are available. We'd also need good harm reduction programmes like naloxone needles, needle collection and management or rehab systems. I accept it would result in an acceleration of the drug epidemic, but it would reduce crime, reduce the proceeds of crime and a lot less people would be in jail. Lesser evil and all that.

Ill join in on this discussion! As someone who has Fibromyalgia, my symptoms are muscle pain, joint pain, nerve pain, bone pain (seriously), stiffness, insomnia, brain fog, malaise, depression and anxiety. Currently, CBD oil is legal to sell in the state of Nebraska but our dumbass congress guy (cant remember his actual title) has NO knowledge of CBD oil whatsoever so he thinks people are buying it to get high. Sure, some CBD oil has trace amounts of THC but you would have to consume a LOT of it to get high, therefore stores around here are banned from selling it. CBD has given me a TON of relief and I continue to order it online. Now, it doesnt help for sleep however. Thats when marijuana comes into place. I have prescribed sleep medication that barley gets me to sleep at a decent time (it says to take within a half an hour of bedtime), but I still dont get to sleep until 2+ hours later. Smoking right before bed (plus my medication) gets me to sleep within at least an hour. That is an incredible improvement compared to just relying on the meds I am prescribed. It also brings relief to all of that pain I had mentioned in the beginning, especially if I am in a fibro flare (that means ALL of the pain and stiffness symptoms are present and I feel like I cant move). I use it during the day as well for a more "depressed day" or "anxiety day", along with just for fun too. I am aware of its benefits for seizure patients (especially for children), its extra heartbreaking to see one in a seizure :( Its also great for glaucoma! After working for an eye clinic for a little while, I figured out why. So, for those who like to learn a little something while they are online, heres what glaucoma is and how marijuana helps. Your eye is constantly producing fluid from the inside as your ducts are releasing it to keep the pressure inside of your eye at a level that is acceptable and non damaging. When you start to get high eye pressure, this means your ducts cannot release the proper amount of fluid to keep up with how much the eye is making. I am unsure how prescription eyedrops work for this, maybe slows down the fluid making process? Sometimes people get relief by having small tubes inserted into the ducts to keep them from collapsing and fluid can run free. Marijuana dries out your eyes, right? Well, this is the benefit! Your eye slows down the fluid making process therefore, reducing the pressure put on your eye as it tries to release fluid as well. I was pretty pumped when I put two and two together about this. Another fun thing to talk about (not marijuana related, but the eye) is SO many people HATE the poof of air that gets shot at your eye when you have an eye exam. Yes, it is startling, but that is the least invasive way to check your eye pressure. When you are in the middle of your exam with the doctor and lets say you passed on the poof of air, well, they are still going to check your eye pressure. Remember getting those eye drops put in that react with the blue light they shine in your eye? Well, the first drop is a numbing drop, the next is a UV reactive dye drop. Why do they numb your eye?! Well, the doctor drops down a little tenometer and uses the "Goldman Method". This little cone pushes directly on your eyeball. When the doctor is looking into your eye with the blue light on, they are turning a dial that moves the tenometer forward onto your eyeball. When two hair-like lines inside that piece line up, they are done checking the pressure and look at the number on the dial that moves the piece forward. Repeat with other eye. Another way they check is with a little hand held device that has that same tenometer piece only the doctor is manually putting the pressure onto your eye as they line up the hairs and check the number on the device when lined up. ANOTHER way is a little hand held device that kind of looks like a monkey wrench. Between the stationary top piece and the movable bottom piece, there is a small pin. Those top and bottom pieces touch your face, but as soon as the tech pushes the button, the small pin juts out and touches your eyeball very quickly until it gets a readable number. So, keep in mind, that puff of air may startle you, but only air is blowing into your eye, nothing is physically touching it! Your choice on which method you prefer, now :P Sorry that got a little off topic, but I like to share that with people since SO many hate that little poof of air!

Naz14 Marijuana is amazing for fibromyalgia - my mum suffers from it too. sadly its still illegal in the UK (despite the UK being the worlds biggest exporter of medical cannabis >.< ) she still takes some of the medication from the doctors aswell, but has completely cut out the tramadol and takes a lot less pregabalin and replaced it with a relatively small amount of weed. Kinda fucked up that opioids and a drug that prevents the brain from regenerating cells are considered the "safe" medication and weed is supposedly bad :/

layla_wilson if I take enough Tramadol to be effective (2 pills every 6 hours) it makes me violently throw up, Skelexon, oxiconton, and my other pain meds are ineffective, the muscle relaxers they prescribed me... Well my muscles are what allow me to stand and keep my handsome shape

layla_wilson Right? I take Cymbalta for my fibro and I am sure that has had way more negative effects on my body than smoking ever has! I have never heard of pregabalin before...oh jk, just googled, its Lyrica. None of my insurances have ever covered it so I have never had a chance to try it!

I find it a bit hilarious that they have 'medical marijuana dispensaries'.  It's like Yeah sure, you're not fooling anyone, you're a drug front trying to pretend you're all official.

You don't see any Oxycontin Dispensaries because controlled drugs are dispensed by entities such as pharmacies.

monkwarrior Mark this on your calendar: I agree with the sentiment of Layla's comment.

I spent 7 years on opiate maintenance to the point that heroin addicts couldn't keep up with the amount it took to get out of bed.  First surgery fused C5-C6 and took three months to step down and detox.

Round 2 I used medical marijuana with great results.  I ate a candy at night that helped me sleep and used cbd oil during the day to control nerve pain and inflammation without risking anyone's safety so I could still work.  I had a partial laminectomy and expansion of the foramen to relieve pressure but I also have permanent nerve damage as a result of bone spurs.  The opiates don't kill that kind of pain but medical cannabis does; the options to not be high during the day make it even more attractive.

I wish It was possible to see your face when you reach the pearly gates of heaven and get told to fuck off down to hell. semichisam01 I find it hilarious because it really exposes the deceptiveness of recreational drug users.

There are pieces of marijuana, extracts or constituents or component parts that have great promise for medicine, but smoking marijuana, which is what people are talking about when they talk about medicinal marijuana, has never been shown to be safe or effective as a medicine.  There are better options for 'pain', this is just being used to 'get high'.

monkwarrior I won a natural history award for my work isolating and testing natural ingredients of traditional herbal pharmacopoeia, then went on to study pharmacology at a top university known for that faculty.

The pharmacology and toxicology of THC is well understood. There are quite a few unfounded claims in lay culture, but there is a compelling case for medical use and doctors won't prescribe it for spurious reasons. Couple that with low harm and the fact it's enjoyable and I think it contributes positively to the world. Certainly, I think the current delegislated climate is better than a blanket ban.

Realize article isn't about adults and kids are different, but it is labeled an open forum so I'll just say my 2¢ worth. 

As an adult anyone that thinks they have a right to tell me what I can do with me (my body) can f#¢€ right off. I am a grown ass adult and I'll decide what I do and don't put in my body. Doesn't matter if you think it's dumb, stupid, bad for me, or a mortal sin.  It's my body, my choice, and if it is the wrong choice I have to live with it, not you so mind your own damn business.

bearbear01 I'm not positive I get your meaning, but I believe your implying that I didn't have a say in water purity laws and didn't care to, so somehow that means I have to accept that someone else gets to decide I'm not allowed to smoke a joint if I want to.  I'm not saying no laws are allowed to be written without my approval. My point is a law that protects me from myself is fundamentally  tyrannical. To criminalize and imprison a person for something they choose to do to themselves is unjust. a law against poop in water is just because it keeps another party from injuring me with his feces or me from injuring him with mine.  But if he wanted to find and eat poo of his own accord it isn't my place to stop him no matter how stupid or disgusting I feel it is.

And besides my approval or not of criminalizing marijuana consumption, I imagine the law is not to protect the individual but the society from the individual under influence, as it is with DUI prosecution. With the difference understood about not needing to drive, of course. 

As it relates to the poop point, arguably the act of consuming drugs is deemed dangerous beyond the individual, as it is the act of crossing tolerable levels of fecal matter in drinkable water. The other point being that your declaration of principles is interesting, but not actionable within the practical for most people.

7eggert to be clear, the argument is regarding the notion of absolute personal freedom.

In my mind, medical uses of marijuana are fine and welcomed. Recreational use of marijuana is just as problematic as alcohol and I think both should be treated equally.

Both should be regulated according to the intrinsic danger (as opposed to fear nor carelessness of people who don't know sh*t).

bearbear01 I agree you can't drive while high due to impairment, but impairment due to marijuana isn't practically worse than impairment due to distraction, inattention, lack of sleep or anything else.  Imo the erratic, impaired driving should have the consequences in and of itself. regardless of reason it'll cause a crash and or death.  My issue is with criminalizing what one does to themselves and keeps within the confines of their home.  You want to grow a plant and smoke part of it in your home you should be allowed. I don't care if it's pot or heroin its your business not the govs.  sorry  others feels don't count only causing physical harm that's just too fuzzy a line to draw as some people's feelings are hurt by all manner of mundane garbage. 


It's not a war on drugs it's a war on personal freedom. Getting you used to someone else saying what you are and are not allowed to do with you.  the funny thing is I haven't touched the stuff in over 20 years.

  In its most basic form I see it as legislated tooth brushing yeah you're a fool if you don't brush your teeth, i appreciate it when others also brush their teeth, the world would be a better place if everyone brushed, but it sure as hell isn't the govs role to enforce mandatory brushing.

geobas1 yes. But, let's take a step back. Referring to your point where one should be entitled to freely use marijuana, because it's an individual's personal freedom issue. And it seems that we agree that driving while high being a risk to others is an argument worthy of consideration. Setting aside the harm to the self, it is then justifiable to pass legislation against things that could cause damage beyond the self, wouldn't you think?
Going back to your declaration of principles, there is a conflict between what is your personal freedom and what is your communal freedom. This is the old "your freedoms end where the others' start", paraphrasing it of course. This is not an absolute truth but it is defensible.
I like your example of brushing your teeth. In that case, I feel there is negligible harm to others, so it wouldn't be comparable to drug consumption. 
Where I say that it is impractical for most... You could argue that if you grow your own plants you're not contributing to the trafficking side of the problem. If you don't drive, or have a driver, your chances of harming are gone. If you don't work, your impairments won't be risky to others. And so on. But the moment when there is a possibility of interaction, the containment argument falls apart.
I would offer car seatbelts as an alternative to tooth rushing. And also abortion rights as another case to ponder.

bearbear01 I feel it's absolutely comparable to brushing ones teeth.  I'd rather have interactions with a stoned individual than one with stinky breath.  "Trafficking" becomes trade when it's legal. Booze was trafficked during prohibition but now it's just called interstate trade/shipping.

marsii Firstly, no offense, but this isn't my first time on i am bored or dealing with a troll. Lol. I don't blame you for how you handle it, but sometimes I simply find it too tempting to fight fire with fire for the hell of it if you catch my drift. I've met a couple okay people on here. Murder rate there .93 per capita vs 5. in the USA
Rape is 9.2 per capita but in USA 27.3

3) Marijuana is terrible for your mental health:  Marijuana will stunt the developing mind of a child, but  not an adult. And no one is advocating kindergartners be issued bongs.  Yes, over do it and it makes your brain fuzzy. Over do anything and it will kill  you.  And for mental health, if anyone needed to spark up it's you, chillax!

4) Marijuana is terrible for your physical health:  No one will argue it's bad for your waste line as it makes everything taste sooooo good. But for patients with wasting syndrome it increased their health and immunity by increasing their appetite.

5) The drug decimates many people's lives:  No it doesn't. The government decimates lives with this ridiculous {and I think illegal} ban on it. Obviously we learned nothing from Prohibition. All legalization has done is create crime cartels that control supply, quality, and price and will use any violence they want to achieve their goals.

To ban alcohol took a constitutional amendment.... so why is pot banned just 'cause some guy in Washington says so?

Partisan conservatives love to bad mouth the "liberal" media but the news doesn't pull this bullshit where they are constantly pushing a blatant narrative against the other "side". It's the kind of sensational bullshit above that makes partisan conservatives think the news is biased against them. I wonder how many times a day people that watch Fox News or read their articles hear/see the term "liberal media" or "mainstream media"? I bet it's in the 30-50 range. But it's not in the same league as what Roseanne said. Roseanne is a white woman who made a racial comment against a black woman. Samantha is a woman, who attacked another woman, with a sexist comment used to attack women. I normally wouldn't say this word but Samantha was the one being a cunt.

Update: I also don't think Roseanne should have lost her job. There's better ways to make that a learning experience than these stupid knee jerk reactions like with Roseanne and Kathy Griffin.

I would like to get away from the concept of medical marijuana as justification and concentrate more on getting the government out of peoples private affairs.

If someone wants consume THC for ANY REASON under the sun, it is their business; medicinal, leisure, experimental, whatever.  It's no one else's business what people do (providing they are not endangering others of course).

You should not need justify why you want to use weed.  If kids need it medically (such as for seizures), then of course they should be able to get a prescription.

Gerry1of1 I know you said you wouldn't make anymore comments on the subject but hopefully you will answer a question.  After seeing all of Monk's comments on this open forum, are you still claiming that I'm the bully for making a comment that came true 4 hours after I made it?

"Countdown until Monk asks about IAB Code of conduct posting."

A month after the post of The IAB community standards was posted he's been asking about another monthly post.  On every open forum it's always the first post he makes.  I made my comment 4 hours later he asked the question.

I don't like bullying either but I don't understand how this was instigating anything or bullying.
