Ironically, approving same-sex marriage nationwide would fix the legal problem.

@Draculya, I don`t see how approving same sex marriage nationwide would prevent "fix" this "problem" (polygamy). If anything, it would create more opportunities to have a same sex spouse in addition to the an opposite sex spouse, meaning more opportunities to polygamy. The only legal "fix" would be to ban same sex marriage.

He might be able to marry a woman in North Dakota, but back in California he`s still married to a man and until there is a divorce he can be charged with polygamy. North Dakota only has to extradite to California and get rid of the problem.

Polygamy should be legal while Bigamy should be prosecuted.

Polygamy is about conscientious decisions made by consenting adults.
    Bigamy is about perpetrating fraud.

I fail to see what, what other people do, that has absolutely no bearing whatsoever on what you do, has to do with you?
Keep your nose out of my bedroom and you won`t be so pizzed off over finding out how badly *you`ve* been doing it all along.

@turbotong Read the article? Understand much about law? Heres why Draculya is right:

The problem is Dakota doesn`t recognise another states Gay Marriage, therefore the Bigamy law will not work as legally in Dakota same sex person is not Married. If all states had Gay Marriage, or were forced to recognise a legal status of married couple from another state. Then the Bigamy laws will apply the same way to hetero marriage. The problem is saying "you`re not married" allowing you to say "ok then I will get married to someone else as I`m not married am I"

@turbotong And one more point. If you got rid of same sex marriage all across the USA. Then people from other countries that recognise same sex marriage you`d get the same issue. Or Americans can just get married in the USA have it not recognised by the state, and then get a hetero marriage. So actually the only "fix" is to legislate to have gay marriage recognised...

Ah, so either the gay marriage was an attention seeking fad or his `gay man to marry a woman` is an attention seeking fad.
Because being born that way makes you chop and change, doesn`t it?

Similar to when I evaluated same sex marriage, I don`t see a mechanism of harm to anyone willfully entering a polygamous arrangement nor any harm to their neighbors.

On the other hand, I can see a commercial need for coders to write ordinance language...

drawman61 - perhaps you should look into the number of previously married men, even with children by that marriage, that subsequently live as a gay man. Similarly bisexual people would, by definition, chop and change.

I`d actually watch that one. His first wife is now legally a man and they both live in states that don`t recognize gay marriage so they can`t get divorced so now he has to pretend to be a woman so they can.

That`s what gets me. States will acknowledge a man who becomes a woman, accept that and be okay with HIM being a woman.... but let a man love a man and PHUCK NO! THAT`S PERVERSION!

Makes no sense at all. But then, those same states will let a 12 year old girl be sold off in marriage to a 45 year old man.

@Gerry- Can`t argue with you on that one.
The movie The Magdalene Sisters is being shown on tv tonight. It reads, four girls, two pregnant, one that`s been raped by her cousin and one thrown out of an orphanage are shamed and disgraced and set to hard labour by nuns. Nowadays they would get a tv show and a book deal.
The point being, our generation will be laughed at for homophobia, racism and especially equality for the sexes in the workplace in years to come.
