    I knew half of that. I knew the damages were based on 2 days coffee sales and the coffee did 3rd degree burns, but I had seen reports the coffee melted through the cup.

    So the media portrayed the case as a moron that bought hot coffee then spilt it on herself. Is that not what happened, the heat would not have been an issue if she hadn`t been idiotic to put it between her legs.

    That said, how hot does cofee need to be ffs!

    I knew a lot of this: But not all of it!

    I didn`t know she was that old (I thought she was in her 50`s)
    I thought the car was moving (it was parked). I did know she wasn`t driving.

    Our local, liberal, newspaper (The Free Press) regularly "buries" negative stories about huge corporations. McDonalds, specifically, many times!

    I did know that McD had many cases of burns before this, and had refused to lower the temperature.

    Usually they drag the cases out for a decade or longer: this one was really fast!

    And I knew the amount was greatly reduced.

    Don`t believe everything you read or hear! Do some research on your own, sheeple!

    Yes, I`ve heard all this before, it`s still bullpoo in my opinion.

    Firstly, people are gasping at coffee at 180-190 degrees F. Yet according to the National Coffee Association of USA, coffee should brewed at a temperature of 195-205 degrees F and served at 180-185 degrees. link Which is in a normal range, most hot foods are hundreds of degrees. Stick you face in a hot pizza and leave it there for 15 seconds like this woman did and you`ll have worse burns.

    Secondly, all this talk of third degree burns. If the third degree burns were 6% of the burns on 16% of her body it means that there weren`t even third degree burns on a full 1% of her body, and it was because the liquid was pressed against the skin for over 15 seconds.

    1 out of 24000000 people is statistically irrelevant, you have much better odds of being the powerball winner

    So if I am eating hot soup while driving and it some how falls down my t-shirt or something can I get 2.7 million?

    Maybe we should sue car companies for making cars go too fast, you odds of dying in a high speed collision is much better than burning yourself like this in a freak coffee accident because you were playing with your coffee when you should be focusing on the road.

    No, I think they were gasping at the damage coffee that hot can do in a short amount of time.

    Coffee being a liquid will transfer heat much quicker, and will do much more damage.

    Sure, so it would be fine to sue for millions if I spill chicken noodle soup on myself or hot sauce or grease drips on me? Because they would have the same effect.

    Haven`t gotten gotten coffee there in ages. Always hated how I`d have to wait like 15min before I could even take a sip without frying my mouth.

    I was on the side of McDonalds at first when this happen and at the time doing plumbing an my boss made a good point. He said as a plumber we have to set the hot water temp to a level where it can`t burn someone by code/law or be held liable. Their coffee machine have thermostats why can`t they? No one can drink something that inflicts burns like that.

    A freak accident. Because, I always hold a paper cup of hot coffee between my thighs. Doesn`t everyone? (sarcasm, kids.) My guess is that she had a bit of senile dementia.

    This is like buying an anvil and then trying to sue Acme after you drop it on your foot (which, sadly, would cost Acme millions today).

    So, if a woman spills coffee on herself and it does a little damage, it`s her fault but if it does great damage it`s McDonald`s fault? The severity of the damage does not change the fact that it was her fault.

    I can show you a pic of a guy who blew his hand off due to stupidity. According to your logic because it was so severe he should be able to sue McFireworks Seller.

    I got it, lets have all McDonald`s serve nothing hot, cold, spicy or a choking hazard (and no sharp edges on the Big Mac boxes).

    @richanddead If you had actually watched it you would know that she never asked/sued for that much money. She only wanted McD`s to cover her $10,000 medical bills. In fact, her lawyers tried to settle with McDonald`s TWICE out of court and they absolutely refused. Even the lawyer who defended McD`s was on the old lady`s side.

    @MrPeabody: I`ve seen that picture countless times. Its swollen dead tissue pushed up by fluid forming a blister. Because she spilled the whole coffee it saturated the sweat pants that acted like a sponge and pressed the heat directly to her skin for several seconds. It`s graphic yes but not unexpected or unusual. When hot grease is splashed on people it has the same effect. The areas severity is due more because she spilled the whole damn coffee on herself and held there. Do it with pizza or hot noodle it will be way worse.

    @McThstlpnts: I watched the whole thing beginning to end. Settling out of court does not mean anything other than the guilt falls with the jury too. And they didn`t "absolutely refuse" the came back with two counter offers that the woman didn`t except. I would think $10,000 would be exorbitant as well for a mistake she caused, in her car, when she was supposed to be driving. It just compared to 2.7 million its less absurd.

    The melting point of styrofoam is 464 degrees F, the coffee would be boiling over in the cup and steam would be whistling out of the top. I can`t find any credible sources that state this, only certain comments from anonymous people, sounds like gossip to me.

    Infact, you can put a styrofoam or paper cup directly into the flames of a campfire and as long as it is full of water it won`t melt or burn. I do that to boil water when I go hiking, saves on weight.

    Still we don`t need the Hot label on cups..
    I was in a hotel recently and the paper cups had "Caution Hot" written on them. They are empty cups.. and the wine we drank out of them was not hot.

    Why is it McDs fault that the old witch put the coffee between her legs? Coffee is made with hot water. They make it with lukewarm, everyone else is going to complain. Next time you buy a cup pour it straight over your head - jackpot.

    She was served hot coffee (which she ordered), and burnt herself with hot coffee. Everything that followed is a moneygrab.

    Punitive damages should go to a state fund or designated charity, less legal fees at a standard rate, leaving the plaintiff with no more than compensatory damages.

    It`s all McDonalds fault. They should have had a warning on the side of the cups saying: CAUTION: Do not place between legs whilst seated in a car. It`s a cup of freshly brewed coffee. It`s hot, you dolt. If you`re stupid enough to think that it`s not going to cause you any physical damage, if and when you spill it in your lap, then you shouldn`t be given hot drinks in the first place.

    But then, I don`t suppose that would fit on the cup.

    Sre we have coffee machines. after a few weeks of use we put them in the cupboard with the bread making machine, the ice-cream making machine, the juicer and the toastie maker. THen we go back to pouring hot water on instant coffee.

    Every couple of years we`ll remember we have them and bring them out for an airing.

    1. The issue isn`t that she spilled it. It was that coffee should not be served at a scalding temperature. You cannot honestly say something intended to go in the mouth should be served at a temp that causes those kinds of burns.
    She had the damages reduced due to contributory negligence with how she spilled it. Then there were exemplary damages because McDonalds had received a sh*tload of complaints about similar issues but refused to change it. Also, the hot contents warning on the cup wouldn`t stop this from happening again if someone else received burns.
    2. I have never seen this place be so for a large company and the media. I don`t know what US tort reform was like, but Au reform has made it hard for legit plaintiffs. This will only ever benefit bi companies. Now, a gym can have you sign stating that they cannot be sued if they provide broken equipment. No one else is allowed to contract out of a legal duty. The wet floor sign/rain ones are bs from when people have sued

    Coffee should be and is recommended to be brewed at a temperature of 195-205 degrees F and served at 180-185 degrees. link If your talking about a hot food like pizza, the serving temperature is usually 200-400 degrees.

    Your statement is based on a misconception. Temperature is a measure of the activity per molecule. So if have less of an amount, you don`t have as many molecules, there`s not much heat even if the temperature of the individual molecule is high. This is why you can be struck by a tiny ember from a fire without being burned. When you sip coffee, you sip it not chug it. When you are taking in just a little sip at a time, the molecules can spread out and is cooled quickly by the coolness of your saliva and mouth. When she spilled the coffee, all the heat from the coffee in the cup was applied to her lap all at once and then held there by the sweatpants.

    Thats why people naturally take small bites from hot food.

    There were a poo load of complaints because their were a much bigger poo load of customers. They said 700 people over 9 years complained, thats 77 people per year out of 68,000,000 they serve per day. They say at 4:12 that the statistic is a single person burns themself out of every 24000000 people. As I said before you have better odds of being hit by lightning twice (1/9000000).

    That is statistically irrelevant! Your odds for the airplane you`re on, falling out of the sky and crashing causing your DEATH, not just being injured, are 1 in 11 million! But we all consider that exceptionally safe. In fact it is the safest mode of transport. You dying in a car crash is only 1/5000.

    And the temperature the court set it too would still cause burns. Necrosis of the epidermal layer due to heat (A.K.A burning) starts when the temperature of the epidermal cells reaches 44 degrees celsius, that`s 111.4 degrees fahrenheit. It is still very possible to create the same kind of burns at 140 degrees fahrenheit, it would just require the coffee be held to the skin for a longer duration or simply a larger cup of coffee to be emptied.

    140 degree coffee can actually still cause sever burns in under only 3 seconds!

    Unless you eat only room temperature food you will always have a chance of burns, and the larger the population eating the food, then the higher the chances of a freak accident.

    I guess I`m probably gonna get trolled for this, but I watched this in the hopes they would provide additional information that would change my mind but they didn`t. So, she wasn`t driving. she. spilled. coffee. on. herself.
