    First of all, those being arrested have to be searched before going to jail, that`s fully legal, judicially tested, procedure. Should that person be hiding something and bring it into jail with them, that`s extra felony charges, when that contraband is found inside the jail.

    The difference is, if it`s found while on the side of the road it`s a possession charge. Inside jail it`s not only possession, it`s a smuggling charge and likely a charge of giving a false statement to police (because they were asked about it and lied).

    Not to mention, having a smuggling charge on one`s record is pretty much "probable cause" for the police to cavity search you at will for the rest of your life.

    Cavity searches are NOT side of the road acts for all passersby to witness. They`re done in a private room, in the police station, prior to the arrestee going to jail.

    A quick Google search led me to Ohio`s statute on body cavity searches.

    While I`m sure there are slight variations from State to State, several key points in Ohio:

    "Unless there is a legitimate medical reason or medical emergency justifying a warrantless search, a body cavity search shall be conducted only after a search warrant is issued that authorizes the search"

    "...and the search shall be conducted in a manner and in a location that permits only the person or persons who are physically conducting the search and the person who is being searched to observe the search. "

    nettech: Narcotics can be absorbed through the walls of the colon and into the bloodstream. Cops also search suspects mouths for the same reason. Depending on the substance, like crask cocaine or meth, ingestion and rectal concealment can be fatal.

    And per your own link - (2) A body cavity search or strip search may be conducted if a law enforcement officer or employee of a law enforcement agency has probable cause to believe that the person is concealing evidence of the commission of a criminal offense, including fruits or tools of a crime, contraband, or a deadly weapon..

    broizfam: I guess your expecting the cops to whip out a tent and set it up right there. These women were NOT strip searched, their clothes were left on. There was also no exposure that I seen that would even rate a PG-13 in a movie.

    crakrjak - you are way off base here. These people were pulled over for flicking a cigarette butt out the window. In no way does that call for a body cavity search. It is ridiculous to give these cops that much authority. That is why search and seizure is specifically mentioned in the bill of rights.
    If there were reason to book them into jail, the search would happen during the booking. Searching them because they flicked a cigarette out the window is not a reason to book them into jail, which is why they searched them before booking. They had no reason to book without the search...and in this case, they had no reason after the search.

    Stop making excuses for these cops who violate our rights. They are supposed to serve us. Instead, they use us. We are there to justify their existence and to generate income for the state.

    What the hell kind of questions could there be on a polygraph test that, even if shown to be answered truthfully, could possibly mitigate what was clearly shown on the video, let alone prove her innocence? ;-/

    turdburglar: Pot smokers flick their roaches out windows too, especially when they panic upon seeing a cop behind them. Also, during "Red Flag" dry conditions it`s highly illegal to discard cigarette butts out of a car window and will get you a hell of a fine.

    So please tell me how that`s such an innocent act again. Most smokers know to use an ashtray inside the car.

    crakr - It wasn`t a roach. The cop even said it was a cigarette. You are trying to change the subject. Besides, I never said it was innocent, but FAR FROM probable cause to search ones car...let alone search ones v and b holes.

    You are less likely to be violated by American police than by any other place in the world. This is by far an exception, and was completely uncalled for. This will have gone to court, and somebody will have lost their jobs.

    turdburglar: Tossing anything out the window of a moving car can be considered probable cause these days. That`s just the way it is.

    Test it out someday on the highway, in front of a cop, see what happens.

    I think the cop had a reasonable excuse to claim probable cause if the car actually smelled of weed. Doesn`t excuse doing a cavity search in public, though.
