    The "failure to secure a weapon" charge is bullsh*t. He was on his own property and wasn`t transporting the shotgun.

    @Gerry1of1 - It can be done, depends on what kind of ammo is loaded in there and the range. This was point blank range and since he took the shotgun with him because he thought he saw a bear the previous night he probably had a slug in the chamber.

    Here`s what I seeing, the cops who are probably hunters and gun owner are saying he was in the wrong.

    He lives in an area with bears, his fault. People keep encroaching into the wilderness then get freaked out when they see a bear.

    Learn to live with them peacefully or move out.

    My best guess, and it`s only that. This bear has been coming on his property recently and eating all the bird feed or just in general being a destructive jerk to his property and garbage so he got pissed and probably told his wife, "IF `ER SEE THAT DERM BEAR AGAIN I`MMA SHOOT HIS A$$."

    76 years old, carrying a gun on his own property, did not wish to be eaten by a bear. I somehow fail to see how this is a problem.

    @VikingGuy: Generally I`d agree, but there`s more to this story than just the headline or what he`s feeding us.

    Here`s what he`s charged with, all crimes he was aware of in the city:
    "Ahlstrand is now charged with illegally killing a bear, illegally baiting a bear, illegal possession of a firearm and failing to secure a weapon."

    If the bear just randomly charged him, then why the baiting charge? Why own an illegal fire arm?

    There`s more, this isn`t just a case of leftist trying to save animals and stop gun rights. It seems he not being truthful and being over dramatic for sympathy.

    It depends, however I have seen plenty of overzealous animal rights activists both here in europe and in the united states. Also police charges are sometimes excessive or overhyped. The baiting charge could be related to that the bear chased him, aka: he was bait. The firearms charges make little to no sense as you do not need a license to own a shotgun there and I somewhat doubt it was a military automatic shotgun or some sawn off gangbanger piece. Also carrying a gun on your own property is legal even here in Germany, and according to the state law where he is, the same goes there.

    As to the moving out if you don`t like it, see it this way, moving out is not appealing if done in pieces while bathing in digestive juices, and arriving is something we best not think on.

    It`s a legit fear, which is why I choose not to live by bears.

    I agree with your counter points as valid, but ulitimately as is my point there`s just to many questions which we aren`t privy to the answers.

    In this part of our country, the people don`t always live in fear from overzealous left-wingers or animal rights activists.

    As an example when the Wildlife Fisheries agent said, you should`ve called me that lead me to believe that he let it slip that the bear was seen on property before and fearful for his family decided to kill it before it killed him... which is valid and I`m not arguing that logic.

    It`s seems that everyone privy to information we aren`t given see`s this as an avoidable incident, which is why I have my theory below.

    @peakingo - The "illegal possession" charge doesn`t necessarily mean what you think. The shotgun in his home for self defense is probably 100% legal but they can slap him with illegal possession because he went out & shot the bear without a hunting license and not being up to date with the required safety courses, which goes along with the illegally killing a bear charge. As the law is now, in many places that require registration & permits, you can still keep an unregistered firearm in your home and on your property legally. The second you step foot off your property without it being registered, it`s illegal.

    The failing to secure the weapon charge is bullsh*t because that goes if the weapon`s being transported off your property. You can`t just throw it in your truck and take off, it has to be locked (secured) in a case.

    peakingo: He`s being charged with so many charges, that I`m afraid the police decided to "Throw the book at him". It`s a common tactic with some police forces. The more charges, the greater likelihood that one will stick or that a plea deal will be taken.

    I hope this guy gets a decent lawyer because it will take a good one to cut through all those BS charges and get an acquittal.

    The police report says that the man had a 50 gallon drum of bird seed in the back yard, which, to them at least, seemed excessive for feeding birds. So they believe he was using the drum of seed to bait the bear, which had been destroying his feeders for a week.

    OMG this is where I live. The Mass gestapo is in full swing. They`re charging him with baiting, an unlicensed firearm and failure to secure. Now here`s the bulls**t this town is not rural it`s where two highways intersect there`s a mall and a whole bunch of major routes going through it sure there`s woods but not much especially not much as other places. So if he were baiting why would he bait in his backyard and why would he use bird seed? If I were to bait a bear I`d use geee hmmmmm mabey meat!! Then there`s the unlawful gun well at one point there was a lifelong FID in MA but the politicians decided that was bad and got rid of it without sending a notification of said FID holders bet that`s this guy. As for the not securing well that`s a bit redundant seeing that you can`t have a gun secured if you`re going to shoot a bear.

    This is my state summed up give gangbangers in Roxbury and such EBT cards and early parol and throw the book at a 76 year old man who shot a bear he though was a threat. You know it`s not like people walk and jog around the neighborhoods and kids play there.....oh no that`s exactly what happens. The people out in Boston want this cause they think a black bear is a cute cuddle ball of love. So he should wait 20 min or till someone get mauled so the police can show up and shoot it missing about 5 or 6 times(another story). That or tranquilize it and send it off in the wood somewhere cost god knows how much so it can make its way right back to the same place because it sees the area as easy food now.

    Shows your IQ, eh? The bird seed seemed to work just fine; it`s much, much cheaper than meat; it doesn`t spoil and turn funky like meat; and meat would attract every dog, house cat, big cat and predator in the area.

    we get bears all the time at my cabin, they come down to eat fruit off the tree`s.. so you know what we do? we leave the dratin thing alone... and go about our business and just stay clear of the dratin thing.. no big deal, we have dogs to.. they know better then to drat with a bear, just like we do... this guy is lacking in the IQ department.. just listen to him.

    This isn`t cabin country it`s howdy doodyville 50`s housing projects all over and newer McMansions. Along with a good sized mall and loads of crap along the major routes going through and 2 highways not a place you look for bears. Some woods but not very rural though. People jogging everywhere and kids playing all over is a bad place to find a bear especially if it was a mother bear which they suspect.
