Kelly McGrevey just wanted to get skin cancer just like everyone else that used tanning beds. Instead, she got shamed.

Not even from a legal standpoint but from a customer service standpoint they were stupid not to reimburse her the money. The fallout isn`t worth the $70 bucks

No it doesn`t. I don`t care where you live. There`s no legal or moral defense for accepting money in exchange for a service, and then arbitrarily deciding after receiving the money to refuse to deliver the service based on some policy you made up on the spot.

She was offered the use of the Stand Up Tanning Booth but she didn`t want it. It was in use and she didn`t want to wait. But the lay down booths are off limits to the 500 plus girls.

So, as she had an option she turned down she does NOT get a refund.

I bet it`s written write on the F`ing beds, but no one asked that. Never been on one but it looks like glass in there to me, that can only handle so much weight before breaking.

I don`t know how it is where you live, but here in the UK it doesn`t matter what is in the T&C`s if they`re unlawful. There are lots of companies for instance that say in their terms that they don`t give refunds, but if the circumstances fall within what are your statutory rights here as a consumer then the law still says you get a refund and if you don`t get one then they`re breaking the law.

Companies rely on people reading their T&Cs and accepting that they must be enforceable and legal, but quite often they`re not. Also, in the UK legal system when T&C`s are challenged in court they are generally read at benefit to the consumer, so for instance if a term or condition is very vague then the court will read it in favour of the consumer rather than the company who wrote it.

only in america haha, I`m from the uk, and I swear to the flying spaghetti monster, any bit of sun is a blessing, yet we can still tan on a good day, fat bish could go swimming in your clear oceans, get a tan and lose some weight

It is unfair to not give a refund, but I would be too embarrassed to tell other people, let alone go on television and say "I`m so fat I can`t tan". Is there no shame left in `merica?

I was going to say "f uck is there not more important things to feature on american news?" but this is actually pretty pooty. Dont you guys have consummer affairs type programmes? we have those....the thought of appearing on one of those programmes here is enough to keep most people in line (note, I say most). Plus, why doesn`t the dumb s hit just go out f ucking side? thats free. then she`d have more money for snacks.

Sounds like the person at the front desk is simply not authorized to give refunds. I`m betting the manager will give her a refund. (But who knows - maybe they`re idiots and won`t.)

Point is, she has two choices: A) Demand a refund from the manager and report them to the BBB and Consumer Affairs and possibly tell the bank to get her money back if they won`t refund it.

Or B) Call the f`ing cops and the media?!?! Wow, what a waste of resources for this attention whore. I mean, I feel for her (I`m > 230 lbs. myself and this would piss me off), but you deal with it the right way, not by demanding your 15 minutes of fame and wasting police resources! I`d file charges for filing a false report if I were the sheriff in that town.

I don`t think it`s discrimination, if the lie down tanning beds can`t support their weight they should not allow their customers to use them. Hell, the business can turn away Asians or Caucasians or any other group if they wanted to - they`re a business. But to not give a refund for refusing service? That is criminal.

There are weight limits for chairs, i suppose there are weight limits for tanning beds and 120 kg limit seems fair to me.

Thanks for providing the missing information. So many times I`ve seen news reports of prejudice and commercial nastiness, only to hear the reasons and the real situation MUCH later. Reporters should be taught to investigate and not just selectively report what sounds inflammatory.

Here`s the solution.

Let her sign a waiver saying she will not sue for damages, then let her tan.

When she breaks through the glass, disfiguring herself and possibly bleeding out, sue her to fix the table, and laugh at her fat ass.

What`s hard to catch from this report is that she COULD tan at the facility in the stand-up booths, she was simply being told she couldn`t use the lay-down tanning beds because of her weight.

Once that little fact comes out, the owner`s position is a lot more reasonable--and this story is a lot less interesting. Yet another lame local news story.

(Fairly interesting post, however: no complaints there.)
