We once had a "Mr Donalds" right in downtown Vancouver. The owner put in the same waste baskets and other details as McDs had at the time, same red and yellow scheme, same lettering style. He operated for some time before the clown put him out of business.

Whether they have grounds to sue is irrelevant. McD has a right to try and sue. They also have enough money to make him go broak fighting them.

My mom is a copyright lawyer. I can tell you McDonald`s does have a case. If they hired her, they would win as my mother has never lost though they probably wouldn`t, because she was Burger King`s lawyer back when both had "Big Kids Meals". Because of her, McDonald`s had to change it to "Mighty Kids Meals". She`s been a lawyer for Donna Karan, Joan Rivers, she also helped shut down Napster.

It`s called Trade Dress. This is a clear case of trademark infringement. It`s called trade dress: if it looks like mcdonalds, feels like mcdonalds, it better be a mcdonalds. PS this protects the consumer as much as the infamous corporation.

We had a burger place here, back in the 70`s, called "Munchie Burger". The "M" was golden in colour. McDonald`s sued the crap out of them and they had to shut down.
