I like the last line in jclv`s link:
He complains that citizens monitoring police activities for wrongdoing might "affect how an officer does his job on the street."
That is the exact reason for filming police on the job - to ensure that they are doing their job properly.

This guy is going to get rich. He already got $25K from a previous incident. I think he has a good case to claim that $25K didn`t teach them anything, so this time, it ought to be $250K. Then if they do it again, make it $2.5M.

They only right the cop had to ask him for is ID is the fact that he (I assume) was in the driver seat of a vehicle, thus he needs a license. If he were standing in the street and hadn`t been driving, the cop had no right to ask for his ID.

I like that everyone thinks this is about him filming the police. The cop came over and asked for ID multiple times and the cameraman didn`t present ID so the cop had every right to arrest him.

This is exactly why people should film the "authorities". He did nothing wrong and got arrested. It`s ridiculously hard to take them seriously, when they don`t uphold the law properly. They don`t even get properly reprimanded for harassing law abiding citizens. They have far too much power and influence in our society.

@Popcap, a cop can not just randomly ask someone for ID. They have to have just cause to stop you in the first place. People have the right to tell the cop they don`t want to talk to them. You can ask the cop, "am I being detained?" and they say no then you can leave. If they say yes you can ask why. If they don`t have a reason then they can`t stop you.

@CoyoteKing: "If they do their job correctly to uphold the law and don`t in turn break the law to do so or for their own personal gain, then they have no reason to worry about being filmed."

Which is why this happened. It is likely the police were breaking the law. But, the man with the bigger gun wins.

Fortunately, this guy didn`t resist. The cop did have the right to ask for ID, and the citizen had the right to say he didn`t want to speak to the cop. But, the cop should have presented the statute and given the citizen the opportunity to comply with the law before arresting him. This is not just a worthless cop, but a worthless human being.

They can arrest you for failure to present identification but not recording them. Cop is an ass probably trying to reach quota.

On another note...why was he recording a traffic stop?

"Though there was no reason he should have been arrested, why was he filming?"

Because someone has to watch the police. If they do their job correctly to uphold the law and don`t in turn break the law to do so or for their own personal gain, then they have no reason to worry about being filmed. They are public servants doing their job in the public to protect the public. They can record you during an encounter and you should have the right to do the same in recording them in an encounter. It keeps cops honest, or shows their unjust behavior like this incident or something like Rodney King.
