As much as it is an elephant in the room, we all know he`s going to eventually kill himself so the sentencing doesn`t really matter anyways.

People may feel sorry for the kid, and I do as well, but the fact that he gets straight As in school, kills kittens, sexually assaults his younger brother and breaks his infant brother`s leg while...wrestling...and to top if off is completely emotionless when repeating the incidences to doctors etc.... That seems like hes definitely got psychopathy. Hopefully he can be rehabilitated but I doubt it. To be honest I don`t have a problem with children being tried as adults depending on the circumstance. Killing his brother wasn`t an accident, and kids at age 12 know what is right and wrong (murder obviously being wrong).

And? Theft is theft, whether it`s a 12 year old or a 20 year old, so should 12 year old thieves be charged as adults? Why have a juvenile court at all when people in that age range are charged as adults anyway? If they`re about to be an adult I can understand it, because there isn`t much of a difference between a 17 year old and an 18 year old. But a 13 year old (who was 12 at the time) is not even close to being an adult. Putting him in an adult prison doesn`t make any kind of sense.

Though, prison at all isn`t going to help the situation. If he`s in for life, you might as well kill him. If he`s let out after a couple years, his life is completely ruined and he`ll have virtually no chance of making anything of himself and he`ll end up harming people and wind up in jail again. He needs rehabilitation, not jail.

The system was aware of his situation and did nothing about it. He was abused by his nearest and betrayed by those who had a duty to protect him.

But to some here he `looks evil` and should be hanged. Nobody is talking about an `excuse` but an explanation is not hard to find.

It may be that he is so damaged he may never be safe without supervision, but to toss him aside is wrong.

How can he be tried as an adult!! He needs help and may indeed never be able to live unsupervised- but it is disgusting that a system that failed him so tragically should now just throw him away...... so sad.

It`s obvious the kid lived a pretty f*cked up life and is only 13 but I have another problem with this kid`s story.

"Fernandez was born in Miami, Florida in 1999 to Biannela Susana, who was just 12. The boy`s 25-year-old father received 10 years` probation for sexually assaulting her. Two years later, both mother and son went to foster care after authorities found the toddler filthy, naked and walking in the street at 4am near the motel where his grandmother, who was taking care of him, was found surrounded by cocaine."

Then it says in October 2010 he was back living with his mother and her new husband. Umm... why the f*ck did they allow the mother to have him back?!?!?!

Kid`s lived a hard life. Im not condoning his actions, but if you read articles about him, there`s a clear path that ends in murder and abuse.

It`s a tragedy that this child is so psychologically scarred that he will likely never be able to be a productive member of society. He will need supervised care for the rest of his life, simple as that.
