Well that`s just asenine! The rapist should have the right to rot in jail, period! He should NOT be informed of any baby that results, nor should he have one tiny "right" to anything. Except jail.

I don`t even understand why raped women would have the child. That`s the principle argument and reason for Roe v. Wade, after all.

But this begs the question, if the fathers are known, why are they not in jail? In a crueler society, perhaps, castrated?

I like to imagine that the rapist has to have rights, because if he doesn`t have rights, he can`t be forced to pay child support. I don`t know if that`s the case, but that`s the only way it makes sense to me, so I`m going with that in my little world.

seeking parental rights is an admission of guilt, rape is by definition sexual assault, and as such is a crime

I honestly can`t say which upsets me more, the poor woman`s ordeal or the horrific comments under the article about how she probably just likes rough sex/is lying about being raped.

Odd how many of you missed the point. Rape isn`t a death sentence. Good behavior in jail, speedy trial, and cooperation from the defendant can easily result in the rapist father being set free before "his" child is even five years old. Now what? Now he has all the same rights as any other father.... or he bargains those rights away to spend, say, only one year in jail. Entirely possible from what this article suggests.

Yes, the "father" goes to jail as he admits what he did, but for 1 year or ~10 with permanent visitation rights....? Frak that nonsense.

"In a rape case it is the victim, not the defendant, who is on trial."

Well you got pregnant, so it was not legitimate rape! You should be on trial for lying. We all know about the shut down switch.

To continue, Andrew, Brim, you`re aware rape can occur where there was previously loving sex in a relationship, right? Now not only does the victim have to prove her child was the product of single or continuous rapes, but even if she manages to prove that it makes no real difference in 31 states....

She quoted 17th century law. It is differant now. Yes, still very hard, very traumatic, but rape victims are much more protected now in court. You cannot attack the victims sexuallity, history, or say she deserved it for wearing short skirts.

The sentators and ass hole. We dont` need to exagerate his comments, they`re idiotic enough.

Let`s see. After a little internet detective work I find that she is full of crap. If what I`ve found is correct, she didn`t make any kind of claim that he raped her until she sued him for child support and he in turn requested visitation. The child was already a couple of years old by this point. Then she agreed to drop her accusation, and her request for child support, if he agreed to give up visitation.

She claims he raped her repeatedly over the course of many months. He claims that they had consensual sex over the course of many months while he was married to someone else, which is why they originally kept the baby on the down-low.

The solution to this is simple. When he comes over to pick up the kid, just shoot him and claim he tried to rape you again. Just make the place look like there was a struggle, tear your clothes, smack yourself in the face, and pull his pants down. I bet they wouldn`t even arrest you.

ryan, basicly you are proving the point the article started with though.. she didnt name the `aleged `rapist, yet you mention an article that blames her. Hence the victim is persecuted, not the alaged rapist.
Thing is, so many families that broke up where the fathers have less chances in the system then the rapists. Seems that crime in certain instances does pay.

if we are going to have the death penalty, and not saying I agree we should, but since many states do, it should be extended to rapist.

problem is, that 17th century judge was right, when a women reports a rape the sexiest system we live within takes her from victim to suspected liar and makes her prove she did not in some way cause the rape...

the fact is rape is not a sexual crime at all but a violent crime and there is nothing a women could ever do to make rape justifiable. if a man rapes a woman and is convicted, death penalty.

and in the mean time, MAYBE we could stop asking what a women was wearing, if she was drinking, etc. none of that matters AT ALL, not one little bit.

"if a man rapes a woman and is convicted, death penalty."

I disagree with the death penalty in general, but especially in this case. Even if he`s convicted of rape, there`s still a slight chance that the jury is wrong. So you`re willing to put someone to death for a possible wrong conviction?

holycanoli11: I`m not doing your homework for you. The information is available for the finding. The lesson is, if something someone claims on the internet sounds outrageously stupid, it just might not be true.

I didn`t find an article that blamed her. I found an newspaper article that explained the situation. I am not assigning fault at all. I am saying that just because a woman claims she was raped during a child custody dispute doesn`t actually make it so. Or do you support a system where as soon as a woman in a custody dispute says she was raped that she should automatically get ever

jamie76: "the VAST majority of women do not report it when they are raped. you should wake up and see reality."

The VAST majority of sex that creates a child is not rape. You should wake up and see reality.

Oddly, this is the only time I`ve ever seen her claim that she was the victim of a violent rape. It`s certainly not the way she claimed it happened previously. The biological father of this child, (or the alleged rapist if you will,) was a church pastor. In her court filings, she claimed the sex occurred because he convinced her that it was God`s will. She was an intern at the church that was run by the father of the man she was sleeping with. She never claimed that she was an unwilling participant in it until now.

But your statement that the vast majority of rape is unreported is loaded. That`s the same excuse Pennsylvania used to pass voter-ID. There is no way of knowing how much "unreported" rape actually occured.

    I bet that would work.

"When she`s born and I`m out of jail, your baby daughter`s coming for a sleepover with me every weekend and I`ll play her the same song that was on the radio the night she was conceived."

    That is effin` scary.

You need abortion rights and forfeiture of paternal rights.

ryanwi, I`m a pretty savvy Internet user. Granted, I don`t normally go past the first three pages of search results (primarily because I keep the parameters specific enough that the first few results usually work just fine, and, to go past that is usually digging way too deep for my needs).

Anyway, I find nothing to support what you`re saying, even after doing several searches. That said, if what you`re claiming about her story is correct, you have made several good points. And what you claim would invalidate her claims, obviously. Please share the articles you found so that we can judge them for ourselves.

Ah, you see, LillianDulci? We CAN agree on something. I too oppose the death penalty, not because there aren`t criminals who deserve it, but because I don`t believe the government is competent to be trusted with that much power over individuals.

On the other hand, if a woman kills her rapist, as I described below, I would trust that she knows exactly what she`s doing.
