@Arcval: Let me see if I`m understanding you. You believe that anyone who commits a crime while suffering from mental illness should be found not guilty by reason of insanity?

I think I can make a good argument that ANYONE who murders someone is experiencing some degree of mental illness. So by that standard, let`s just remove the crime of murder off the books, since, clearly, no one can commit it. Every murderer, apparently, is just someone who`s misunderstood, making a cry for help. ~sniffle~

Perhaps the "most christian country in the world" could forgive him for actions he took whilst severely ill?

Mental illness doesn`t mean sudden gibbering craziness. Insane people can do insane things calmly. Sometimes eerily so. This guy wasn`t a gun nut with a history of violence. He was very anti-gun with no previous history of violence. This act was extremely out of character.

Anyway, in a mental hospital he can receive the help he needs and maybe one day lead a normal(ish?) life (though probably under witness protection considering america`s barbaric bloodlust).

This is similar to the Andres Breivik Case in Norway. Except I can see Holmes going for the insanity defense rather than Breivik`s route. It`s Holmes best chance by far of not being killed.

I know what will fix that crazy brain... lots and lots of amps!

Wether he is in control of his actions or not, he has done it. Attempting to kill 70 people and achiving 17 is not something people will ever let off.

If he is locked up in the loony bin he will be hated and scorned by people, so it would make him even more a victim if that is really how you see it. Death would be a mercy in the long run.

Naked guy lying on a highway overpass chewing another guy`s face off? Sure, insanity defense works for me.

Person who orders thousands of rounds of ammunition over the internet, waits for their delivery, calls a shooting range so he can practice, booby traps his own apartment before leaving, puts on a gas mask before throwing a smoke or gas canister into the crowd, then refuses to talk to the police without an attorney present after murdering 12 people? Not so much.

Every psychiatrist gets a thousand patients a year who PLAN something like this. Extremely few ever get one who DOES something like this. Hence why they are trained to take suicidal ideation far far more seriously than thinking about harming others. In fact someone who planning to harm themselves moving onto planning to harm others instead is seen as a positive step. If that`s what happened (fairly likely) then his psyc would have had a positive view on his progress and be less concerned than previously about him. If his psyc is judged by fellow psycs then he`ll probably not lose his license. A court however...I don`t know.

@Arcval - I agree with you on that, he`s going to be locked up for sure, but it will most likely be in a mental hospital. The sh*t is going to really hit the fan when they start going after the psychiatrist he was seeing and the school for not having him admitted, against his will, for observation. They`re saying he was already on their radar as being a potential threat to others but nothing was done because he left school.

I know i`m about to get flamed for this, but you do realise that he`s insane, and most probably go to a mental hospital. He was under the care of a psychiatrist at the time of the shooting and has been assigned a lawyer who specialises in insanity defenses.

There`s only going to be a death penalty if the jury is so enraged that they go for barbaric revenge over justice.

I await the torrent of hate over his `Not guilty by reason of insanity` verdict.

Yes, but (and this is the part I really have to drive home) he was (most likley) bat sh*t f*cking insane and therefore not responsible for his actions.

The fact that he didn`t submit a plea is pretty telling about his guilt. If he was just a guy who was there, he would have immediately submitted a not guilty plea and sworn up and down that he was one of the victims. Not the shooter.

No, this guy is guilty. The only question is (depending on your point of view), was he crazy or just a guy committing mass murder.

@teggp. It`s not like they just grabbed a random person. They arrived on the scene and found a guy with body armor and ammo. Chances are that`s the suspect.

Also, read up on the eye witness reports at Columbine. Dozens reported seeing multiple shooters on multiple floors. There was a lot of investigation and speculation by media of a third shooter. In actuality, witnesses first saw two shooters with trench coats and then other saw the same two after he removed his duster. They were able to shoot on two floors because the start shooting on an outdoor stair set and one went up and one went down.

Eye witness testimony helps but is shaky at best.

tedgp, they couldn`t even see his face and he was wearing body armor and they we`re all panicing. Hardly reliable to describe what he looks like without the equipment. Also, he had his own apartment booby-trapped with explosives. An innocent guy going to a movie would totally do that right? Not to mention all those weapons, and his car... Yeah all the evidence points against it being him, right <_<

Funny how people think it was this guy that did it, yet eye witnesses that were there said he didnt and it was a completely different person of a different height and stature.

All that info that was taken by the local police, but ignored by the FBI.

Dont get me wrong, its possible he could have done it, but the evidence says otherwise.
