One consideration as the devil`s advocate: is it possible the comment was done in a condescending way? Like, "Pssh, nice car man. What kind of rims ya got, brah. LOL" Now, obviously, does that warrant the response it got? No. But it would explain better in my mind why this guy lost his temper. I just can`t even conceive of this sort of reaction unless that`s how the conversation went. Still agree that he should be penalized for the full extent of the law, and the "put people to sleep comment" plus domestic violence background make it obvious this guy is probably just a terrible human being

Also, they will have the option, depending on the laws in the state, to get him with felony murder, where any person`s death that occurs during the commission of a felony (deadly assault) constitutes what is called felony murder. Laws differ from state to state, but depending on the penalties for 2nd degree and involuntary manslaughter. It would be easier to prove felony murder because there is no requirement on the state to prove intent. All they have to do is prove the felony. The death being collateral with the felony is automatic felony murder.

I think they`ll try for 2nd degree. Myself being a prosecutor, for cases like this you try for the highest penalty possible knowing that the jury will still be able to get him for the lessor charge if it doesn`t go perfectly in trial. I`d charge him with 2nd degree, absolutely. If it doesn`t work out, they can give him the lesser charge of involuntary manslaughter.

You sir, are correct. That`s all double jeopardy is. Can`t be charged for two crimes for the same incident, can`t be re-tried after acquittal in a separate criminal trial. If multiple charges for one incident, the lesser charges are absorbed into the largest crime. Charges may be escalated where necessary.

Perhaps it`s easier to understand simply by saying, they can`t charge you for the murder AND the assault, you have to pick one, and murder is the larger crime, so the assault is absorbed into the murder. If acquitted on the murder charges in a state court, he can`t be recharged for the same crime (murder), or the lesser crime (assault).

Judging by the story it would appear that he didn`t fall down, he was knocked down. That`s a VERY big distinction. Could even have been unconscious, & possibly brain damaged, before he hit the ground. I have no doubt the charges will be elevated at least to involuntary manslaughter if the victim dies. Only the perp, his lawyer, and (maybe) the perp`s family will act surprised!

As I recall (I`m certainly not a lawyer) the Double Jeopardy rule keeps a person from being charged a 2nd time with the same crime in a different court. For example, if found "not guilty" in a state court, can`t be retried in a federal court on the same charge. Charges can be changed, I believe, when the outcome of the crime changes, as when a wounded victim then dies. Let`s hear from the lawyers on this.

The problem is proving intent. Right now, at best, they have a reckless assault with intent to commit serious bodily harm. Intent will be key if the kid dies. In order to prove a murder, you have to be able to prove that he intended the murder. Intent is easier to prove when a deadly weapon is involved, but where all he did was punch him in the face twice, its possible that the most they`ll be able to convict him on will be Involuntary Manslaughter. If the kid dies, he`ll likely be charged with 2nd degree murder, and the jury will be given instructions after the trial that if they don`t believe intent was proven, they can still find him guilty of involuntary manslaughter.

They can charge him now for assault, and if the kid dies, the charges escalate to murder II. All double jeopardy means is that you can be charged for two crimes for the same incident. The charge itself, however, can be escalated. Charging him now doesn`t lock in that charge forever.

@Glockpants @pinkrhoid: I`m pretty sure there`s a timeline they have for upping a charge, however it`s not likely this kid will die, it would be more likely he`s a vegetable. He also probably confessed then lawyered-up, at which time counsel certainly told him to plead not guilty so they can plea-deal him down.

I`m no lawyer, but what I just posted was regarding an acquittal. I`m not sure if they can be charged again if convicted. Because he is definitely guilty of assault. Eye witnesses and he even confessed (then had the nerve to plead `not guilty`).

Ya I read this yesterday. The guy has a record for domestic violence as well. In a clip where he goes in a court room he walks around like a peacock; no sign of regret or shame at all.
He looks like a class A D-bag to start with. Hair spiked, fake tan, overly muscular, treats others like poo. It`s surprising he`s in WA and not Jersey (Shore).
I hope they don`t charge him yet because it seems likely the kid he hit is going to die and if so this guy deserves the murder 2 he`s get. If they charge him now they can`t bring it up to that later if I`m not mistaken.
