Zimmerman Free - Black Woman Convicted On SYG Law?

Same law, same state, but different consequences. Did she "Stand Your Ground"? If so why was she arrested & convicted?

For those who keep "missing it" the main reasons the SYG Law didn`t apply were:
#1 She returned to the house, pistol in hand. The man did not stop her from leaving.
#2 She DID get bail! And promptly violated it to assault & batter the man she `was terrified of`.
#3 There were 3 charges, she cannot claim the children were also attacking her (depending on their ages).

So why isn`t he being charged with 3 counts of aggravated assault? If all it took was the "fear of death or dying" then how the hell would a haunted house ever be able to operate?

Since only one shot was fired, there should only be one charge, by my reckoning.

Otherwise by your reckoning if she had fired 3 shots she`d be facing 9 counts.

CrakrJak, she caused three people to fear death or significant harm. Thus the three-times charge of assault. No physical harm required. I wasn`t speaking to this case, only to the specificity and difference between "assault" and "battery" and why should be charged with assault without physically hurting anyone. :-) No argument from me, just talking about legal definitions. :-)

SmagBoy: I noticed that in the court report, that was linked to below, that there was no mention of the `victim` strangling her. There was also information that she could`ve exited the house in other ways and that the `garage door didn`t work` excuse was false.

Later she violated a court order of protection by going to the victims house.

So her explanation, saying she was afraid for her life because of her husband, didn`t hold water with the judge.

Thing is though, she shouldn`t be charged with 3 counts of aggravated assault, she only shot the gun once and even then she shot it into the ceiling, even though the victim claimed it was aimed at him.

Yes it`s tragic that victems of spousal beatings (married or dating, male OR female) have such trouble leaving their abuser. However, shooting at him is one thing, his kids in the room is another, and violating your probation on DAY ONE to beat him up?

It`s extremely easy to say this, but actually doing it is another story. Some people are naive enough to think they won`t do it again, and they become so emotionally and physically abused that they don`t feel like they actually can leave. Others don`t know what they`ll do if they leave because perhaps the abuser is the bread winner and they feel like they wont be able to support their kids. Or maybe they`re so afraid of the abuser that they`ll think it`ll get worse if they try to leave. etc

Som-Tam, right now it`s the opposite way. I agree that the cases aren`t the same, but assuming they were Zimmerman is out walking around (and wasn`t arrested until the case got national attention) and this woman is jailed so that`s equally unfair.

I really hate hearing about battered women, however in video 2 the ex said it was to prevent another beating. There is where my sympathy ran out. Any woman or man in an abusive relationship stays, he or she should get no sympathy. The 2 cases are different. she stayed in an abusive relationship and knew her husband was violent, Z didnt know who T was or what he was capable of. With that said, F off to all this poo and everyone involved to it

CrakrJak, just for the sake of discussion, "assault" in many states, is the causing of fear due to threatening actions. "Battery" is the touching and causing harm. So, you can assault someone by waving a knife at them in a threatening manner, aiming a gun at them in a threatening manner, etc., even without hurting them.

Is her husband black? How big is her husband? Is he bigger than her? Ive read about alot of cases in which a women claims not to be able to fight back against abusers, in which the women is one hella fatty that cant possibly be weaker than her husband, if she didnt fight back physically, or through the police its her own fault, and being beaten up is never an excuse to shoot someone and possibly kill them.

There are a lot of conflicting statements in her case, the husband supports her story initially then recants. She fired at him and didn`t fire at him. She remembered her gun but forgot her keys ? She`s charged with assault yet didn`t hurt him at all.

That case is so full of weirdness that I believe she does deserve another trial. I`m not even sure if an aggravated assault charge is even appropriate considering she was trying to prevent a another crime, namely further assault on her.

Story in a nutshell (mostly from her point of view):
She cheated on husband.
Husband finds out thru texts on her phone.
Husband threatens to kill her.
She goes in garage to get gun.
Comes back inside and fires a shot at husband (and kids).
Husband grabs kids and runs out.

-Not at all like Zimmerman case.
-She has already been convicted.
-I`m sure this isn`t the whole truth.
-I may have acquitted her, but I didn`t hear the whole trial.
