All that needed to be done, in the first place, is for the police to have established fair concessions to accommodate both parties until the city responded with an official statement.
I would believe the obvious safety reasons alone would be enough,
From what I saw, the main threat to their safety was the gun club members swerving to try to hit them, which could happen on any side of the road.
but the illegal harassment would be another valid reason.
Videotaping people in public is not illegal.

What does that have to do with anything? You want them to do their job properly when it matters, so you should ignore it when they do their job badly at other times? That`s utterly ridiculous.

Knowing what is and is not legal should be a basic requirement of being a cop. This guy was citing wiretapping law without knowing what it covers.

So being belligerent makes you a crusader? I don`t think so, this woman is just a twit. Quit giving the attention whore the time she`s after and she`ll go home.

I hate this bitch. The cop was called out and was trying to do his job. All she is doing is taping to show how clever she is and how much she knows. If she got robbed that night you can bet your ass she would be begging for the cops help.

He might be law enforcement but it might help if he simply I dunno knows the laws he`s enforcing? I mean that is the point, right? If ignorance of the law is no excuse for me as a civilian, it`s REALLY no excuse for law enforcement.

"do you know for a fact that you are not on private property" ---> "no" ---> "so GTFO and give me your name because you are under suspicion of trespassing. As an officer I am not to judge if you are guilty or not, I just gather information for prosecution. If it`s public, you will be fine.. if it turns out it`s private, they will charge you"

THAT is how it should have turned out.. why these protesters think that cops need to know all the laws? they are not the ones who will charge you.. the prosecutors are, they know the lawas and when the police report has been filed, they are the ones who decode based on their knowledge of laws if you are guilty or not. that is why executive and prosecution (and legislation) are separated..

"You have rights; use them or lose them."

no.. that is whats wrong with those kind of people.. it should be:

"You have rights; use them if necessary, not abuse them constantly and don`t force situations in which you have to use them only to prove that you have them."

I don`t get why people refuse to give their names. Specially when your there protesting and someone calls the cops.

He`s simply responding to the complaint about them being on private property, it`s not like he is going to stop by the court house and grab the property info to confirm. Later he does say he`s going to do that.

As for the law "Therefore, you may be able to record in-person conversations occurring in a public place without consent. However, you should always get the consent of all parties before recording any conversation that common sense tells you is private."

@CrakrJak

"These anti-pigeon hunt idiots have been told many times to stay on the other side of the street"

Why should they have to obey that?

It`s a public street, isn`t it?

Has your country REALLY lost this kind of freedom already?

I`m not too fussed about the actual issue they are protesting; I support responsible hunting for the pot or pest control but I despise canned hunts and just killing for kicks. So I don`t think I am partisan about why they are protesting.

But if you are going to protest know the law, make it clear you know the law, remain calm and polite and don`t give up any of your rights.

You have rights; use them or lose them.

Actually, jamie76, these live pigeon shoots are completely legal in the commonwealth of Pennsylvania, or at least as of Dec 14, 2011, according to the article I just read.. I`m not saying it`s right, but it is legal.

All three parties in this video are idiots.
The cops because they don`t know the law.
The gun club because they were being jerks.
And the video tapers because their protest is ineffective, and they were probably provoking the gun club to get a reaction.

I stop watching the video as soon as they described the scene. I could just feel the bias rolling off of it and knew it wouldn`t be worth the ten minute watch.

I cannot defend the gun club, not will I attempt to defend the police force, but I can say that I don`t think that particular police officer handled the situation with complete incompetence.

The video itself stated "Any competent cop would segregate the two parties". But when he attempted to segregate the two parties by asking the ladies to movie to the other side of the snow banks, they refused.

What was he to do? Ask the gun club member to move away from his own property? That would have been the only other solution to segregate them. And that`s just stupid.

The only people more crooked than cops are lawyers. This entire conversation is a matter of semantics and the lawyers know this. They are intentionally twisting the words of the officers in a shallow attempt to prove their point.

"Pennsylvania`s Wiretap Law makes it illegal to record private conversations - which can include conversations in public places - without the consent of all parties to the conversation."

this law does not and cannot apply to public officials.

all officials that are paid with tax payer dollars are subject to public record at all times they are working in their official capacity. this includes police officers.

people really, you cannot defend the idiot cops in this vid or the gun club members.

I am a hunter but conducting illegal hunts (this one in the vid is illegal) is NEVER okay. Being a hunter means respecting nature and hunting different game when it is acceptable and needed, not when you feel like shooting and killing anything that moves.

oh and a citizen ALWAYS ALWAYS ALWAYS has a right to record anything and everything an on duty officer is doing, period.

That`s the sad part right there...

That you sound like a nut for speaking what should be a plain and obvious truth to any citizen who knows their rights.

I don`t care about the protesters. If they want to get the people`s faces on camera, then get better cameras and stand across the street. As-is, they`re morons.

But the fact is, a conversation, or pretty much anything involving he police for that matter, is never, NEVER private while they are on duty, because they are acting as tax-paid PUBLIC officials, and any government support to the contrary is a violation of our rights.

The anti-hunt people like to provoke a response on camera, edit out their behavior, and make it look like they`re victims of horrible, pigeon hunting monsters!

But they do have a right to protests. Even stupid protests are protected.

A conversation with the police along the side of the road is not "private." At least, not from an objective point of view.

Just saying.

These anti-pigeon hunt idiots have been told many times to stay on the other side of the street and they keep standing in their driveway trying to get video of people entering and leaving the gun club to post their faces on their website for further harassment.

It`s legal to hunt pigeons there, although I`m personally against `canned` hunts, these protesters constant harassment is not legal

From the ACLU website, "Pennsylvania`s Wiretap Law makes it illegal to record private conversations - which can include conversations in public places - without the consent of all parties to the conversation."

This is hard for me because birds are one of my favorite creatures. I`m a huge bird fan with heated bird baths in the harsh NY winters, bird houses galore, suet cages and bird feeders all over my backyard. I can`t help but hurt for those birds :( legal or not

I would have been on the ladies side in the beginning, but the mans voice overs and the yellow fronted writing, along with her incredible annoyingness just poed me. It`s a shame, and I agree it should be stopped. But for crying out loud, don`t create more drama than is necessary. And I know, I know, no one can say how much is necessary, but this was just too much.

zombunny
"Once again Gerry artfully manages to miss the point entirely."
What point is that Zombaby? The point that the video lies in the beginnin? Live Pigeon Shoots are legal in that state. Or the point that it`s none of their business if consenting adults engage in lawful past times? I did not miss those points, I addressed them earlier.

Once again Zombunny artfully manages to miss my post entirely.

"stupid lawyer woman probably standing on private property all the time ( the driveway) .. she doesn`t know where the private property end and common sense tells us that driveways are private and not public roads.. " within like 5 yards of the road is public access so it is public property.

stupid lawyer woman probably standing on private property all the time ( the driveway) .. she doesn`t know where the private property end and common sense tells us that driveways are private and not public roads..

then she claims that before the police came they weren`t on the property? well.. "the video doesn`t lie".. in the scene where they were probably trying intentionally to get hit by the car I see them clearly being in the driveway.. if you want to make cops look bad.. take care to not make yourself look bad too.. nobody wins

Actually what they`re protesting about this live pigeon shoot, is that the pigeons are released out of a box on the ground, and immediately shot as it tries to fly away. It`s not the same as a wild duck hunt. And apparently is in violation of some laws, as claimed by this lawyer. On top of being one of the most pussy hunting styles in the world, I can think of, besides shooting fish in a barrel.

Pigeons - take `em or leave `em... as I see it these women are actually pretty courageous to call out the illegal activity. Too many people look the other way like pussies. I say drat up the old coots. Beat him with his own cane, old pigeon-shooting bastards.

The guy with the car ... "Attempted assault with a deadly weapon."
Good size lawsuit with the city for the police failing to protect people and refusing to investigate. Coupled with their lack of response to a shooting report you have a pattern that shows deliberate intent, one more incident and you have Conspiracy. $$Cha-Ching$$

Pretty obvious the mayor and city council are the ones at the pigeon shoot. That`s why they don`t respond.

How is it any business of these mamby pamby, tree huggin PeTA lovers if other people are have a Pigeon Shoot? I hate this "let me get up in their business" mentality. I bet they`d be pissed if we were protesting something they enjoyed doing.

First, the video starts off with a lie. "A cruel and illegal live pigeon shoot". Live pigeon shoots ARE legal in Pennyslvania.

Second, it`d be stupid to shoot dead pigeons so of course it`s a "live" pigeon shoot.

Third, a pigeon shoot is no differant than a turkey shoot or duck hunting or grouse, etc. And pigeon meat is delicious. A dark meat like duck but not nearly as greasy.
