This is a page from an insurance company"s case against a kid who got in a car accident. Social media"s gonna get you.

They only make sense reading them bottom up as if they were twitter posts over the course of one day leading up to the accident, which is not chronological order and it is not on the same day.

I think its funny how people complain about privacy on facebook. If you want privacy then don`t post.

And this might not be a criminal court case. It could be civil case or arbitration. If that is the case this is relevant and will be used.

I would suppose the thinking would go along be something like this.
"The site has pictures of him and his friends, multiple posts linking him to events verified by 3rd parties on said site and is password protected." They could be and even bigger dicks and pull internet records to make sure that it was you.

Look at a personal liability umbrella policy. Most are for a cool mil. I know the one I have will send a team of insurance company lawyers to fight on the suit for the next 10 years if need be. They don`t want to pay out and will do everything they can not to. (all I pay is $100)

I`ve got news for the prosecution: Unless you have the ACTUAL screen prints of the comments the kid made on Facebook, you`re not going to be able to submit it into evidence. I am going through a similar situation right now. Anything other than the ACTUAL Facebook page is hear-say.

By the way it reads it sounds like he is a drunk driver. So it proves that he was drinking 7 hours before he hit someone. I think it`s good that they use this poo as evidence.

Facebook has privacy settings that can prevent this if you aren`t a complete motard and can operate your profile settings. Also, in general, if you post it, you own it.

Sorry, thats not how the criminal injustice system works.
1) What really happened does not matter.
2) Circumstantial evidence will be used to justify your arrest.
3) Once arrested it costs (many) thousands to bail out of jail and buy a decent lawyer
4) You should take a deal if you can get it. Even if it means pleading guilty to something you are not guilty of.
5) If you go to trial it will cost MANY thousands more in lawyer fees. And, then your life is in the hands of 12 random people. If they don`t like your clothes or your haircut you are drated.

It doesn`t have to all be from the same day. It just shows what kind of activities this person participates in and what they posted 7 hours before the accident. E for effort though.

Owned. I`ve always hated when people post about how much they love alcohol/weed etc on Facebook, it`s like they only do it because they think people think they`re cool for doing it. Sadly some pedestrian had to suffer for this idiot`s choices.

It`s in the case but will likely be thrown out. Anyone can post anything they want online but that doesn`t mean it`s true. That will bring the credibility of that type of "evidence" into question.

I know in some jurisdictions facebook doesn`t count as major evidence because it`s not exactly factual and some people do bullpoo online. I know a court didn`t care someone had been bragging about a big payout online while they were still in a trial..
