A Texas man buys $300,00 house for $16, using a little known law about Adverse Possession. It"s legal but is it right?

Adverse possession is OLD law, and every single first year law student has to memorize its elements. Did the news story tell how long he`d have to be in the house to receive good title? Three years? Five? Ten? I think that`s just how long it takes before a property owner can sue, not until he` scott free.

no running water? and someone lives there? in arkansas the authorities can get on your case for that. and what about the home`s title? someone is the owner of record, and even if the mortgage holder went out of business, their assets still belong to SOMEONE.

You can buy that house for £185,000!? Holy poo... I`ve just been looking to buy a place here in the UK, and for that money I could just about get a two bedroom, one living room, one bathroom apartment. And where I live is below national average.
Sounds like a pretty stupid law though. Also surely the house`s ownership would default to one of the creditors of the mortgage company that went bankrupt?

It`s hilarious how mad his neighbors are, it`s a completely legal way to possess the house. In fact one of the main pieces to the law is: "to maintain an open and advertise his ownership" for the period of time. As well as maintain the property during his stay.


It`s legal in every state (just about) but the years needed for possession are different in each. For example some it`s 7 years and some it`s 21. He just got lucky texas only has a 3 year limit.

Smart man, and to the winner goes the spoils.

Sounds like a case of sour grapes on the neighbors behalf. They had to pay for theirs, and when this other guy waltzs into a home basically for free they go "Thats not fair waaaaah." Frankly, that guy was smart enough to take advantage of it, he`s not hurting anyone or stealing anything, so I say let him have it. Too bad for everyone else who didn`t think of it first.

The family can always buy back the house, but in reality if they went in to forclosure and walked away from it the chances of that happening are very slim.

stuck up neighbors. and also not only in texas. i remember hearing a case of a homeless man that broke into a house and lived there for a year or something and when the homeowner came back from his long trip he no longer claimed ownership of the house because after a certain period of time the house is declared abandon

The law is weird.

If, for example, someone parked a car that they owned and I stole it, I wouldn`t be able to claim that I legally owned it because I was driving it now. It`s not allowed for anything else, so why should it be allowed for a house and land?

I dont know if anybody is getting this... IF he manages to stay in the house for three years he gets the title..and is free and clear to sell it. Which he will...you say he wont be able to pay the taxes...he doesnt have to...the original owner and bank are responsible for all of it till he gets the title.

To clarify, him living there is an "open and notorious" demonstration of his ownership of the property, fulfilling the requirements of the elements of adverse possession. It`s not like he can`t go to the grocery store for fear of having someone possess the property while he`s gone. He`s using the property as a dwelling place in order to satisfy the requirements for adverse possession. He has rights as an adverse possessor, which includes the right to eliminate trespassers with the aid of law enforcement.

No, he can leave, but he has to maintain continuous possession of the property. Basically, he has to act as if he owns the property. Which is why he put up the no trespassing sign and is openly introducing himself to anyone who asks as the owner. If someone were to attempt to take the property from him who didn`t have superior title, he could legally call the cops and have them arrested, as the adverse possessor.

That`s it, time to start researching states with short adverse possession time periods. Three years is mind numbingly low. Usually the period is 20-30 years.

In order for Adverse Possession to be effective, the person claiming possession has to have open, notorious, actual possession of the home for the entire prescribed time (three years) established by state law. He has to fulfill all of these requirements, meaning if one element goes, he no longer may claim adverse possession of the home. All the homeowner would have to do (or the bank since the home is being foreclosed upon) is right him a letter granting him permission to stay on the property. That would cancel the notorious element and the adverse possession fails.

Not sure how it would work in foreclosure, but basically, the person who presently claims title needs to grant permission for this gentlemen to stay there, and adverse possession fails. I wonder why the bank hasn`t done this already, or if they`ve tried, why they can`t do this?

Ah yes, they all complain because they went into debt up to their eyeballs (it`s the American way!) to buy their own house, and he legally is working towards ownership of a house that was likely to remain abandoned for some time.

He did he research before attempting it, so he`s much smarter than his new neighbors.

I can`t say much for the living conditions... no electricity, no water, a-hole neighbors... yet it`s still worth it.

He could pay the electric company to hook him up again, same goes for plumbing, and neighbors can be told to f-off.

My parents got a divorce and the agreement that they had was my mom got the brand new truck and my dad got the house.

He has long since abandoned the property. Unfortunately in Pennsylvania it would take me 21 years to lay a claim of right to get back the property such as he has.
