    If it`s legal, that`s the end of the matter, and the neighbors should chill about having a black guy move in. He seemed perfectly reasonable to me; it`s not as if a raging crackhead was crapping on the lawn and breaking out windows.

    Hahaha!!! I love it. The only way to claim property in Norway by adverse posession, is to use it in good faith for 20 years.

    What incredibly lame neighbours! If he was my neighbour, i`d go straight over there and give him a welcoming cake!

    Besides, this is probably the loss of some stupid, irresponsible bank and they truly deserve to loose the property, just as much as this innovative young fellow deserves to own it ;-)

    This man`s a genius.

    My parents got a divorce and the agreement that they had was my mom got the brand new truck and my dad got the house.

    He has long since abandoned the property. Unfortunately in Pennsylvania it would take me 21 years to lay a claim of right to get back the property such as he has.

    U MAD LOL. seriously these people are just angry that he had more brains than they did and found a way to take over ownership of an expensive home. He does still have to live in that home for 3 YEARS with no utilities before he owns it. He still has to pay taxes on a 300k+ home not exactly cheap either.

    I can`t say much for the living conditions... no electricity, no water, a-hole neighbors... yet it`s still worth it.

    He could pay the electric company to hook him up again, same goes for plumbing, and neighbors can be told to f-off.

    He`s exploited a hole in your system. Good for him. The neighbors are just pissed cause they didn`t find it sooner.

    Well, unless the original owners are still paying the taxes on the property, he`ll have to pay all the backed taxes once he has the title. He`ll have to pay something in the end.

    Ah yes, they all complain because they went into debt up to their eyeballs (it`s the American way!) to buy their own house, and he legally is working towards ownership of a house that was likely to remain abandoned for some time.

    He did he research before attempting it, so he`s much smarter than his new neighbors.

    Basically, "he can`t do it because we didn`t think of it."

    In order for Adverse Possession to be effective, the person claiming possession has to have open, notorious, actual possession of the home for the entire prescribed time (three years) established by state law. He has to fulfill all of these requirements, meaning if one element goes, he no longer may claim adverse possession of the home. All the homeowner would have to do (or the bank since the home is being foreclosed upon) is right him a letter granting him permission to stay on the property. That would cancel the notorious element and the adverse possession fails.

    Not sure how it would work in foreclosure, but basically, the person who presently claims title needs to grant permission for this gentlemen to stay there, and adverse possession fails. I wonder why the bank hasn`t done this already, or if they`ve tried, why they can`t do this?

    That`s it, time to start researching states with short adverse possession time periods. Three years is mind numbingly low. Usually the period is 20-30 years.

    No, he can leave, but he has to maintain continuous possession of the property. Basically, he has to act as if he owns the property. Which is why he put up the no trespassing sign and is openly introducing himself to anyone who asks as the owner. If someone were to attempt to take the property from him who didn`t have superior title, he could legally call the cops and have them arrested, as the adverse possessor.

    To clarify, him living there is an "open and notorious" demonstration of his ownership of the property, fulfilling the requirements of the elements of adverse possession. It`s not like he can`t go to the grocery store for fear of having someone possess the property while he`s gone. He`s using the property as a dwelling place in order to satisfy the requirements for adverse possession. He has rights as an adverse possessor, which includes the right to eliminate trespassers with the aid of law enforcement.

    I dont know if anybody is getting this... IF he manages to stay in the house for three years he gets the title..and is free and clear to sell it. Which he will...you say he wont be able to pay the taxes...he doesnt have to...the original owner and bank are responsible for all of it till he gets the title.

    The law is weird.

    If, for example, someone parked a car that they owned and I stole it, I wouldn`t be able to claim that I legally owned it because I was driving it now. It`s not allowed for anything else, so why should it be allowed for a house and land?

    stuck up neighbors. and also not only in texas. i remember hearing a case of a homeless man that broke into a house and lived there for a year or something and when the homeowner came back from his long trip he no longer claimed ownership of the house because after a certain period of time the house is declared abandon

    @Angillion But he`s not really stealing anything, its more like a car getting repossessed then the repo company/bank or w/e going out of business and leaving the car by the side of the road with no gas but the keys in it. The family can always buy back the house, but in reality if they went in to forclosure and walked away from it the chances of that happening are very slim.

    Sounds like a case of sour grapes on the neighbors behalf. They had to pay for theirs, and when this other guy waltzs into a home basically for free they go "Thats not fair waaaaah." Frankly, that guy was smart enough to take advantage of it, he`s not hurting anyone or stealing anything, so I say let him have it. Too bad for everyone else who didn`t think of it first.

    It`s hilarious how mad his neighbors are, it`s a completely legal way to possess the house. In fact one of the main pieces to the law is: "to maintain an open and advertise his ownership" for the period of time. As well as maintain the property during his stay.


    It`s legal in every state (just about) but the years needed for possession are different in each. For example some it`s 7 years and some it`s 21. He just got lucky texas only has a 3 year limit.

    Smart man, and to the winner goes the spoils.

    You can buy that house for £185,000!? Holy poo... I`ve just been looking to buy a place here in the UK, and for that money I could just about get a two bedroom, one living room, one bathroom apartment. And where I live is below national average.
    Sounds like a pretty stupid law though. Also surely the house`s ownership would default to one of the creditors of the mortgage company that went bankrupt?

    I actually live in Texas and I`ve heard of this law haha. I`m surprised somebody actually took advantage of it though.

    Adverse possession is OLD law, and every single first year law student has to memorize its elements. Did the news story tell how long he`d have to be in the house to receive good title? Three years? Five? Ten? I think that`s just how long it takes before a property owner can sue, not until he` scott free.

    Omg I hate his neighbors, they seem so snobby. What jealous goody two-shoes. :/ I hate my neighbors too though... they`re nosy. Sort of like these people trying to protect an abandoned home from being taken advantage of. Lol.

    something tells me there`s a little bit of racism going on with why those neighbors want him out, i mean it is Texas, and hes not being a disturbance to anyone.

    Wow, the ethic issue here is tough. He didn`t break any laws but... Well god damnit, something feels like something is bad. I just don`t know what the hell it is.

    @Angillion But he`s not really stealing anything, its more like a car getting repossessed then the repo company/bank or w/e going out of business and leaving the car by the side of the road with no gas but the keys in it.

    Which would still be theft.

    If you take something that doesn`t belong to you, it doesn`t stop being theft just because it was easy for you to take it.

    He`s a clever thief who found a loophole that allows him to get away with stealing $300,000. But he`s still a thief.

    How dare that man do legal research and completely and legitimately legally get ownership of a house by using his head?! I`m glad the neighbors are trying to gett involved in the legal possession of a house that does not belong to them in any way whatsoever.
