Ahh, the joys of living in a free country. These girls learned a lesson entrepreneurship is punished in USA (Europe too). The need to pay their exorbitant business taxes before they decide to open a stand. Oh and fill out the paper work so the gov knows every detail about your buisness.

It all boils down to personal responsibility. This country severely lacks it, thus lawmakers have to enact these ridiculous codes & laws to attempt to prevent most people from being sued.
As a couple readers have mentioned: if you are worried about contamination of the lemonade, don`t buy it. If you are willing to take the risk, then go for it, but be prepared to accept the consequence if you fall ill (of course if it is determined these sinister, evil little girls dumped rat poison in the lemonade with purpose, that`s a whole `nother issue....and quite likely NOT to happen). We should not have to have laws this strict. Permits for actual established businesses/kitchens/food carts are understandable, but a little lemonade stand? Really?
Same lines as the bulls*it laws that allow an intruder to sue YOU if they break into your home and get injured. That person may have broken a law by breaking into your home, but it is your fault if they get hurt or killed.......

steelgrid is a moron. where`s the harm in 3 girls selling lemonade? just because it`s a crime doesn`t make it wrong, in this context. this is where "spirit of the law" is relevabt in todays society.

you probably side with the DA for that woman who has the vegetable garden in her front yard. nice to see people still conform to the law and never question.

Steelgrid,

the spirit of the law is a VERY WELL KNOWN CONCEPT IN LEGAL COURT idiot.

it is not some made up idea, it is acknowledgement that every law has a gray area and does not always cover EVRY situation.

you sir are a moron best served by a dictator that an tell you how to feel and when to feel it...now please, find the exit and get the drat out of my country.

"Just another example of morons with authority and no concept of the spirit of the law versus the letter of the law."

While I do not agree with these cops, I am sicked every time someone says "the spirit of the law".

The drat is that supposed to be? You gonna follow the "spirit" at a stop sign? Oh just roll on through, no biggie, theres no one around. SLAM!!!

Maybe we can use the "spirit" in stores: You know, EA games makes 100s of millions a year, I can steal this game. No harm done.

I dont care how you twist it, acting as though something falls within the "spirit" of the law is still BREAKING THE LAW!!!

I don`t blame the police here. I don`t want police arbitrarily choosing when and when not to enforce the law.

I do blame the city council (or whichever body) for imposing regulations without exceptions for these circumstances.

So, if these cops were living in Nazi Germany, they would have enforced the Nuremberg laws without hesitation, for no other reason other than it was the law, regardless of moral implications. (for those of you who were educated in the U.S., look it up on Google).

This is exactly what happens when municipal council members blindly adopt into law health code regulations with-out reading the code first. This happened in Albuquerque a few year ago and the code was amended quickly after some harsh public outcry. I`m sure this is the same nationalized crap pushed by a group who thinks all food should be nuked before consumption. I`m sure the adopted code bans everything from pot luck dinners to bringing snack to say an athletic function. I am all for health regulations but, fascism does not always come with the rumbling of tanks.

Lots of comments about `upholding the law` and so on from the cops, in their defense. Seems they forgot to read the lawbook. A child under the age of 14-18 (depending on jurisdiction) cannot legally enter into a contract, and to be selling lemonade, an implied contract of sale is created. So they WEREN`T breaking the law.

I hope these girls learned their lesson, that being:

1. Sometimes stupid people are put into positions of authority.

2. This will never change.

3. Learn to deal with it.

Ok, point number one: this isn`t news. I don`t care, even if I lived there.

Next, the law is the law, and for a reason, as the cop pointed out.

Finally, the media is stupid. This story is designed to exact an emotional response, obviously, but I still don`t care.

You might think that the cops ought to be doing something more productive with their time, which is true, but we don`t know the area. Maybe it was a slow crime day just as it was a slow news day.

At least it was a warning as opposed to the other anti-lemonade stand story a while back which resulted in a fine.

Cop2: "Yes."
Cop3: "*Pfpfpfpfpf!!* The Mrs.Fields is complaining about a dangerous looking troop of girlscouts. You better get over there!"
Cop2: "Goddammit!"
Cops 1&3: "BWAAA-HAHAHAHAHA!!!"
Captain: "Is this the report? I`m going to have this framed!"
Cop2: "GODDAMMIT!!!"

Don`t the police have harmless potsmokers to bust? Or speeders to brutalize?

Seriously though. This story is so absurdly dream-like. Just watch it again. It sounds like a joke. This is ridiculous.

You think that`s a joke. It`s going to happen if the people don`t stand up to this creeping totalitarianism.

Sorry, going to have to agree with the cops on this one. Cross contamination and proper food handling is something I work with everyday and you can easily make a lot of people sick if the correct steps are not taken. Food permits are there for a reason and need to apply to all, regardless of how big or small. "

Well if that`s the case then. The Police needs to attend and check every church function, funeral, outdoor, AYSO, Little League Baseball, Pop Warner and Friday night Football tailgate and College BBQ`s, etc.. and shut them down for lack of having a Health Department Certified kitchen. Yeah you don`t see them doing that huh?

Hmm...make sure all foods stay at the required temps with proper refrigeration and heating. Ensure it is within dates and has a 3 compartment sink. Proper sink for hand washing etc...

nice going there, officer.

same one then said:
"we were not aware of how they made the lemonade, who made the lemonade, and what the lemonade was made with"

I think I can answer that one. by hand, the girls, and with lemons, sugar, and water.

I always feel like there`s more to the story then the media is reporting.

For example, they never said that the girls were setting up the stand on their parents property. They could have been selling the lemonaide at a public park or outside a grocery store, etc, in which case I would side with the cops.

"It`s a shame, but the law is the law.
And the hygiene of the lemonade-making process is a thing to be worried about. You could accidentally make people ill."

Yeah because I always am forced to drink roadside lemonade when I walk by a stand! Hello fool, the buyer knows there`s always a risk of bad preparation when you purchase food at a bake sale/lemonade stand.

They aren`t protecting anyone by shutting this down. Just taking away more free choice (in this case the choice to risk buying roadside lemonade). And also training future generations that it`s ok to bend over for every police state request... If they tried this in the 50`s the whole town would have defended those girls and the cops would have been sent packing.

It`s not like they were even pretending to be selling sealed pasteurized bottles of lemonade..

People sell lemonade and burgers all the time when they have a garage sale, and cops have never shut it down. I thought it was allowed if it`s on private property.
And what about bake sales at schools? Are they going to outlaw those as well? Cops can`t pick a choose like this.

It`s sad that our society has come to this. I don`t blame the police for enforcing the law either. The law(s) were put in place to protect people from each other , but they also make things like this disappear. I`m sure if they hadn`t and someone drunk the girls lemonade and got sick they`d sue the parents, the kids and the city for allowing it to be sold. Society it to blame for were we are heading.
