The sad thing is that the way Copyright laws are written, if LV does not go after little people like this, they can be seen as abandoning their copyright over their logo, just as Bayer lost the ownership of the word "Aspirin" years ago. Then, big companies like Walmart would be able to make millions selling knock off LV bags and LV wouldn`t be able to do anything about it.

What they should do, if they are smart, is to license the images to this woman for $1, or even license it for what they would charge a larger company, and then donate those proceeds to Darfur. Then, their copyright is safe, but they don`t appear to be uncaring to the poor.

Also, Walmart et alia aren`t using it to depict LV in a bad way. Cheap knock-offs from bottom-end shops would have far less effect on LV than bad publicity.

I think it`s worth pointing out that the actual sum Louis Vitton are asking for (according to the formal submission to the court) is 1 Euro.

She is blatantly and deliberately infringing copyright in merchandise that she`s selling. Maybe the profits from the T-shirts go to charity. Can you prove that? What about the profits from her paintings?

You can`t reasonably expect a business to give up the copyright(*) on a profitable product just because an artist orders them to so that she can use it to sell stuff and conduct a campaign against them.


* If you don`t defend copyright every time, especially in such an obvious case of a copyrighted designed being used against the copyright holder, you`ll have a hard time ever enforcing it.

THE FACTS:

May 6, 2008 New York Magazine reported LV attempted to stop the case from going to court, but that they were forced to take legal action when Plesner did not respond to their original request to remove the contested image, nor to the subsequent Cease and Desist order

Plesner was attempting to conceal the lengths that LV went to in order to prevent the lawsuit because she wanted to make LV look bad to gain free PR for her shirts.

In October 2008, Louis Vuitton dropped its lawsuit to show Plesner they would be glad to meet her halfway and forgive the past.

Plesner then went ahead and painted the picture, causing LV to reopened the lawsuit.
