    There are no winners in a situation like this. They are guilty and they will go to jail/ burn in hell.

    Or they are not guilty and will still have their lives ruined by this. Hopefully they get a fair trial. (And if they are guilty get what they deserve.)

    I don`t understand really.. I mean I get why the community (mainly relatives of these boys/men) are angry, they say there was no proof, but you can`t just arrest someone without proof of some crime. You just can`t.

    I hate to ask it, but would they have been more upset about the rape than the chanrges if it was a girl from their own community?

    I don`t know, that clip really didn`t have a well rounded balance of information. The people that are angry make it seem like the police are just bad guys or something, and there really wasn`t much on their behalf (the police) as far as like evidence....etc. I understand information is sensitive b/c of the girls age, and that there has been no convictions yet... still that was a very biased video to me.

    What fivezones said. Although IAB have put the disclaimer stating it is alleged, people should wait until they have been proven guilty before passing opinions that you want them slowly killed. They should have the right to be antonymous until they have been proven guilty or not guilty.

    Also, @draino. I don`t slow torture is a fit way to punish anyone, no matter what the crime. At least not in a society that isn`t based in the middle ages.

    They video taped it and apparently the video was circulating at school. I`m assuming they`ve been identifying these kids from the video footage. That and from interviewing kids at school who saw the video. Link.

    @Gerry obviously secret trials and kangaroo courts are never going to be a good thing, I think fivezones meant that posting identities of people accused of such a crime without full supported evidence against them isn`t fair on the accused.
    There has been a recent case in the UK with he murder of Joanna Yates, in which the first person charged was hounded and accused by the papers to be the killer for weeks based on his arrest, before it was revealed he had nothing to do with it.

    @jimbro Not everything is about race. it also hasn`t been proven as of yet any of them were involved. None of them, as far as I understand, have yet been charged. It`s not either "guilty" or "racially motivated". there`s also "innocent".

    @hatface, though I see the intent of you saying they should remain anonymous until proven guilty- I have to respectfully disagree. As a victim of rape myself, also as a minor, because he remained anonymous and charges were never pressed, he went on to rape (that I know of) 1 other woman. He is now a registered sex offender. That`s the only one who was brave enough to step forward. How many others suffered at this man`s hands for his anonimity in being accused of raping me? How many will be saved now that he has been brought out by name?

    hatface, I agree. A person`s life is ruined just at the acusation
    of these crimes. But I don`t see a way out of it.

    I dislike the police releasing names/photos of people they only
    suspect of crimes and don`t have arrests for.
    "Persons of Interest" they call them. That also ruins lives.

    Well first off, I`m very sorry to hear what happened to you, and obviously, it`s a very good thing that your attacker has been brought to justice. However, as a purely hypothetical scenario, imagine the brave woman who stepped forward to say this man raped me, by some terrible freak accident, got it wrong? The press immediately brand the attacker as a monster, and he is arrested and questioned. During this time, the innocent man has his entire life dragged through the mud by papers and news outlets who accuse him of being a rapist. Then, suddenly, the police release him after your real attacker is caught. Now, the innocent man may never recover from this. He may forever be branded a rapist through an honest mistake.

    By all means, I totally agree that guilty men should be brought to justice, and there crimes made clear and there names carry the burden of what they`ve done. However, before that happens, we have to be sure we have the right man. I hope I ma

    touche. Legal loopholes and red tape. I think, that if they are going to be charged, releasing their names and photo`s is ok, as long as you mention they are on trial for it. They don`t release victims names and faces for worry that they will become a target of other predators. I see what you`re saying, but it`s kind of like Communism- the idea of it is euphoric, but because of the human condition it will just never work. Too many want precautions, to save other victims. At least most of the intent behind posting names and faces is to protect others- granted it comes at the price of hurting people`s reputation, but they have evidence that they were wrongly accused, so I mean it`s not ALL bad, at least they have a chance. it is what you make it. (until the masses get angry)

    I guess the whole deal is a catch 22, there is no perfect answer to this conundrum,don`t you think?

    @lazyme: for the victim being under 14 that makes it a 1st degree felony- now I got a 1st dgree on possession of drugs when I was 19 and got 5 yrs probation for first offense. I highly doubt they will be that lienient, but you are correct "life" isn`t quite suiting lol- realistically, considering their previous offenses (if any) and how good their lawyers are, they`ll probably get 5 years with parole and possibly early release

    they have the accused on video at the time of the assault, showing the footage, releasing pictures and name of those verified to be present is acceptable. I honestly don`t care if any of them didn`t actually rape her, just being there and allowing it to happen is enough to be punished just like the others. Rape has to be the most detestable crime, it is never committed in self defense, it is never done to feed starving children...life in prison, death penalty, life of servitude, human sex slave, being raped to death by baboons, all of these would be adequate punishments.

    I see where you`re going, but arrests are Public Record. If not, the gov`ment can arrest anyone secretly.
    The news can broadcast any public record. It`s not a great system, not by a long shot, but it`s better than secret arrests and secret trials.

    If it`s not public, who is looking over the gov`ments shoulder when it`s faking evidence?
    The police get caught often enough already faking evidence when it`s public. It`d be a nightmare if it were secret trials.

    The problem isn`t with the "public" trial/arrest issue.
    It`s with the people {US} convicting the accused in our minds before we know any evidence.

    Remember boys and girls, just because someone is arrested in connection with the case doesn`t mean they raped the girl. It just means they could have been witnesses to the crime who are now being charged as accomplices or perhaps they aided and abbeded the suspects, etc.

    Gerry is bang on with his comment. Jimbro, It may be all the evidence YOU need, but it sure as hell wouldn`t hold up in court. It`s also not evidence of anything other than the fact your prejudging all of these men with no evidence.

    The fact is, you haven`t seen the video, have you? So you don`t know if ANY of these individuals are in that video. Neither do you know if any of them are currently being charged with it. It could simply be a case of mistaken identity on one, or on all of there cases. The link you referenced doesn`t know any more in depth into the proceedings of the invesigation than anyone else.

    If they did it, they should be punished. However, because this society is based upon a fair moral code, it`s innocent until proven guilty.

    Not true. I mentioned earlier about the Joanna Yates murder in which the first man arrested and questioned was crucified and vilified as the only possible suspect, and that he undoubtedly did it by the media. However, it was soon found he was NOT the murderer. He lost his job, his family and friends and is currently in hiding.

    If this man was found 100% innocent, would you let any one of them into your house? Would you let him babysit a small child, completely aware of his background? Pains me to say, but I probably wouldn`t

    This is not true when you live in a small area. I have a second cousin who was accused of rape, but was found not guilty. That was 11 years ago and people here still haven`t let him live it down.

    ... I know this may seem a bit naive, but how does anyone really believe that a group of 20 some odd men raped one 11 year old? Were they in some kind of gang or cult? Because I really just don`t see the whole neighborhood just getting together for a big ol` rapin` party. How about some context?

    @lazyme484- a suitable punishment is having their nuts cut off and then taking them to a jail to be gang raped by 20 plus large inmates. People should consider- what if it was their daughter or sister.

    @jimbro. They`re suspects, nothing more. Not yet. The police have seen the tapes, but if they knew 100%, they would have charged them. They haven`t. Video evidence alone will not hold up in court. We don`t know the quality, we don`t know what it shows. Right now we don`t know anything. All we do know is that it clearly isn`t enough to charge them.

    Hatface - According to this they have been charged. And apparently the girl was moved to a `safe house` by CPS because people in the community have been making threatening phone calls. Originally a girl recognized several of the rapists as kids from her school after the video went "viral" (articles word, not mine) and notified authorities.

    holy crap, regardless if they are in custody or not, innocent until proven guilty, the police arrest people every day. these guys may or may have no committed a crime, chances are good, more of them did then didn`t. either way, they go on tril just like anyone else, and at this point its how convincing their lawyers are.

    @Brassbull Ah, well now THAT changes everything. The last article did not state whether they had been charged. I was just trying to show that until they have been charged or proved guilty by a court, it`s unfair to assume their guilty with no prior evidence.

    If guilty, the only suitable punishment would be to chain them to a post and let members of the public beat them to death with spiked baseball bats. Preferably over a week or two. Jail is too kind.

    Those who are innocent will not have their lives ruined by this. If they`re found innocent, they`ll be able to continue their lives normally.

    My neighbor cheated on his wife, when caught red handed the "other woman" cried rape. He was arrested and charged. The truth came out in the trial and he was acquitted. But his career in the navy was ruined. Because of the trial he could not be deployed on schedule and they decided not to reinlist him. Even the acusation of such a thing destroyed his career after 15 years of service.

    But any politician, or teacher or numerous other jobs could be destroyed by an accusation just as easily.

    PeeWee Herman not only was found not guilt, but the Judge had his record expunged of the arrest because the police faked the charges. But his television career was ruined by the accusation.

    Rapists are not very liked in the prison systems, not saying they are liked anywhere, but, if they are found guilty and locked up, they will be beaten to a pulp multiple times. If it were a family member or friend of mine they was raped, there would be 18 dead I am a racist!s.

    you can`t just arrest someone without proof of some crime. You just can`t.

    Yes, you can.

    People aren`t supposed to be arrested without enough evidence to make it plausible that they are guilty, but (a) that`s a very long way from proof and (b) sometimes people are arrested without it. There have even been cases of people being arrested when no crime occured, let alone one they were guilty of.

    The criminal justice system is run by people and that means it`s imperfect even when they`re honest and competent.

    Also, it`s implemented by ordinary people. Like all the people who want to torture people to death because they`re sure they`d enjoy doing so and don`t even care about minor details like whether their victims are guilty or not. Plenty of them in this thread and every other one like it.

    realistically, considering their previous offenses (if any) and how good their lawyers are, they`ll probably get 5 years with parole and possibly early release

    I think it`s not probable that people convicted of gang raping an 11 year old, videoing it and distributing it would get a sentence of 5 years with the option of parole and early release. Unless they`re not much older, because the law is very different depending on age.

    I`d have to check, but I think there`s a minimum 20 years in there under UK law. There are three extremely serious offences, any one of which can result in a life sentence. Is USA law so much different? Don`t you usually run sentences consecutively over there? Sentences are usually concurrent over here, which I`ve never understood.

    Many people want to torture them to death before any trial has even started. You can`t seriously think that everyone will forget about it if they`re found not guilty. Many people will assume they`re guilty anyway but got off.

    I just really hope that the little girl is OK and recovers physically and mentally from this ordeal. If I were the judge over this case I would order an immediate chemical castration and no less than 10-15 years imprisonment to those guilty of this horrible act of violence. Race be damned, hurting children and subjecting them to such horror is just wrong on every level. Those who are guilty will pay for their injustice one way or another. What goes around certainly comes around.

    I`m surprised nobody has mentioned this so far... Why is Eric Bernard McGowen, one kinda non-black sounding name, not pictured...
    I looked it up, he is black. (I was just checking to see if they didn`t show that one white guy, not trying to be racist.) He was at another jail which might not release mugshots.
    With rape cases, if its sexual people tend to rape others of their own race. I cant help but think they are bitter people who wanted revenge on some white symbol.

    85% of all rape victims are also between people who know each other in some way. The only reason people hear about rapes between two strangers is because the news like report unusual cases. So I also find it a bit odd to hear that 18 males who just happened to be black, raped an 11 year old white girl? And 18? That seems way too extreme to be legit.

    There`s bits and pieces, here and there but from what I got one 19yr boy convinced her to ride around with them then got her to his bed and told her if she didn`t have sex with them they`d have girls at school beat her up then they, left when the parents came home and moved to the trailer, there they continued and started calling more and more people to participate people were recording and taking pictures. Also they say the girl looks well over 11.

    Even in that article there is nothing about a video “circulating” through school…not to mention that if the rape had taken place during the night and with camera phones being pooty as they are how are you going to identify a black guy : | when I see some REAL evidence then ill believe, judge, and be disgusted.     there isnt enough real evidence to charge them. plain and simple. its possible that they dont even have the right 18 guys. its POSSIBLE that the cops just got lazy and arrested 18 black guys becuase they couldnt find the REAL 18 black guys who did it.

    what im trying to say is that all of you who are judging them right now are wrong and im happy that none of you are in charge of anything significant. you dissapoint me IABers.

    Heresay! The alleged `bragging` is heresay and not admissable.
    And my clients rights were violated in the search therefore the tape is not admissable.
    As for "showing" the alleged tape, what someone shows their attorney is privelaged!
    They should be released and all charges dropped!

    Isn`t that how the justice system usually works?

    Where did you read that this girl was white? Her identity has not been released to the public so how could you know what color skin she has?

    Maybe I`ve been jumbling news articles but the first one I linked to says: "The video quickly went viral, sparking arrests after the teens in it were recognized by fellow students. The victim, described as a troubled young girl, was also recognized by several people." In a separate article the source equates going viral with it being passed around school.

    although with it being from FOX im kind of skeptical but seeing as this tells ANYTHING about any real significant evidence ive no other real choice but to pay attention to that...

    all i can say about that is that the kids were stupid for showing it around. im glad that they did though and that they were caught IF this whole thing is true.

    let me go on record to say that if all of these men ARE guilty may i be the first to say that they wont make it out of prison alive.

    I honestly don`t know what to make of all this. Houston`s a cesspool and I hear a lot of stories about kids having sex at younger and younger ages. I kind of want to believe that this was at least consensual (in the sense that she was willing because obviously she can`t legally consent to sex at her age) and that you couldn`t get 20 guys that easily together who would be cool with forcibly raping a girl a girl of any age, but then again, there are a lot of f-ed up people in this city who do a lot of f-ed up things. Whether it was consensual or not, it`s still a felony, and if they are guilty, their lives are f-ed from here on out regardless of how much jail time they do.

    Courts always argue that capitol punishment is, more than anything, for the family of the victim. If that`s the deal, just arm the family with their weapon of choice and let them have a real cathartic experience.

    Not that her parents would care. A neighbor said he saw her during the day outside the trailer and heard loud music from the trailer into the night. This kids parents didn`t notice she was gone past sundown? I`m really glad CPS moved the kid from that home.
