Evan Emory edited a video of him singing to kids to sound sexualy abusive and put it on YouTube. Is this constitutional?

2. How is the world can you make charges stick when the kids weren`t even present for the explicit version of the song?
3. How can he even legally be charged with this when the video was edited afterward, and no children were harmed in the making of it.

He didn`t traumatize any kids, he didn`t damage any fragile youth. Seriously? Both parties are in the wrong here. The kid really should have thought twice before he posted it. Sure, it may have seemed like a funny idea to begin with, but how could you honestly think the parents wouldn`t raise hell because of it. The prosecutor is similarly overreaching. Don`t charge him as a sex offender, charge him with unauthorized use of an image (for not blurring the kids` faces) and slap him with whatever the penalty is for that.

Okay maybe it was wrong of him to post footage of the kids along with his video on youtube without informing the parents of what is going on(which is how professional comedians make theirs except obviously asking before recording)...but at the same time 20 years in prison is a horrible punishment way beyond what he could possibly deserve. How about taking down his youtube video and giving him 24 hours of community service along with an apology to the parents.

I`ll admit I`d be pissed if my kids were on the video. I don`t like it when kids are involved in stuff like this. This time they`re just innocent bystanders, but there are times that kids end up using profanity or making comments that are inappropriate in movies and videos. People think it`s funny but it`s not.
