It`s a public place, if they don`t want people watching and video taping, then don`t do it in public. Simple as that.
Just because you don`t agree with it doesn`t mean you can infringe on other people`s rights.

the guy is a grade A non-nice individual or sorry... "goober" but he has a point, it`s a public sidewalk. Were the other people asking the permission of everyone in the back of the shots? I doubt it.

The guy was absolutely 100% in the right. Yes, he was a douchebag, but he was right and I found it incredibly hypocrtical of the weenie on the bike to take issue with him taping the model when he obviously was getting his jollies off watching her as well.

    @ Kodyo,
You`re right - it`s a public place. That doesn`t always make it appropriate. You want him taking video of your wife/girlfriend/sister or little daughter/son/cousin and using as his justification that it`s in public? Say what you want as a joke but give this some actual critical thought. That said, we also have to give some consideration to the fact that she was, in some sense, giving a performance and also that the crotch/butt shot is not where the video started. Still, listen to the guy - he`s still an idiot!

Granted the guy is a jerkoff, she was in public, and she therefore "exposed" herself. She, and her entourage, have no expectation of privacy. It`s a sad commentary on society today that something as innocent as a dance pose can be taken and turned into a means of sexual gratification. That`s why the toddler beauty pagents are so dangerous, they are a feeding ground for perverts and the da mothers don`t see it.

Sure, this video may be disgusting for someone to do this, but then again, how is this different than what they were taking pictures of? How is this in any way private? This guy has every right to be there as they do.

That`s so the woman`s point of view its ridiculous. So a woman can dance around naked, but if a man looks at her, he is bad. If she does not want men to look at her, why not not dance around naked.

I wonder how many people here complaining have also defended the filmers when we`ve had clips of them filming people having mad rants or falling over ,doing stuff that is embarrassing etc.

Guys annoying douche for filming but he is entitled to do so, and those people stopping him are causing problems. Your modelling bending over chairs you dont think whatever magazine or advert they end up in wont have people like him looking at them in same way. You choose to be a model you choose to do that in public this is part of it. And at least you knew you were going to be getting filmed pictures taken aside from half the people who end up online who don`t.

    Comments summed up:

Female Commenter: "That guy filming is such douchebag. That woman has every right to wear whatever she wants and not be looked at by who she doesn`t want looking at her."

Male Commenter: "When you think of it logically, he has every right to film her when she is in public choosing to wear that type of clothing."

Hmmm... In this situation the female commenters are taking the whole emotional approach, while male commenters take the logical approach.

Kinda sounds like liberals (emotion based argumentation) and conservatives (logic based argumentation).

You act like women are confused about how men are sexually.

If they were confused about how men are sexually, they wouldn`t be doing it because they wouldn`t understand that it works. It`s mating ritual posing and strutting. Humans are different to other animals, but we are animals. It`s about beating the competition, dismissing inferior mates and/or attracting superior mates. A power thing, mostly. Same basic thing as other animals strutting and roaring or whatever.

And then some raving idiot will pop up somewhere and compare being looked at with being raped. I`d consider that an offensive trivialisation of rape if it wasn`t so obviously the meaningless drooling of a damaged mind.

What if you where walking down the street and this guy started filming your butt up close and making sexual comments?

You`re out in public. Your butt is on display for everyone to see. Does that make it ok?

He is completely justified in his actions, both legally and morally. She has chosen to perform in such ways in public in a way that is obviously designed to attract the attention of others. If he is morally wrong for filming, everyone else in the crowd of onlookers is morally wrong for observing. Retarded `holier than thou` bullpoo strikes again.

Ugh, this is my whole problem with people. Have some f*cking common sense! If her mom and sister (I`m guessing that`s who those two other blond bitches were?) were gonna get all uppity about people looking at ballerina girl`s crotch, then maybe they should have told her not to wear ass hugging shorts or better yet, how about not doing your ballet in public at all? Literally THOUSANDS of other people walking by all got a good look at her ass and crotch too; did they jump all over them? Maybe y`all should go on back to Alabama or whatever pooty podunk place you`re from.

There are creepy fapping weirdos in the world. Fact of life. So if you don`t want your "baby" being oggled by them, then don`t have her out on a public street doing this kind of poo.

Also, what the hell was bike boy even doing there? He started the whole thing by getting all up in camera guy`s face and then he says "Get out of my face." I started laughing when camera man kept calli

Technically, yes, she is in public, and so is he. This is how photojournalists can take pictures lawfully. As long as you are in a public place, and so is your subject, you can take a picture.

For someone to take someone else`s property without their consent, that is stealing.

Now for him to act like that, yes he`s being a prick about things and could have handled it by being less of a loser.

"yeah that whole video just made me feel awkward"

I found this question so interesting that I actually took the time to research it. Unfortunately it`s a little bit of a gray area. While the photographer DOES have the right to video the girl because she has no expectation of privacy, she does have the expectation not to be sexually harrassed. I.E. Goober King had purposely moved to be behind her as she is bent over and waiting for, I assume, to raise her leg and get a crotch shot.

It`s a gray area because while there are laws against "up-skirt" shots, she is raising her leg to make the shot possible. But she is doing it doing a ballet dance move, not a provocative move in public.

It was fascinating to find out that if you`re out in public someone can still photograph you (or your child) after you tell them to stop. But notice the Mom said, "Don`t take a photo of her butt!" not HER. So I really do think it becomes an issue of sexual harrasment, since he put up an argument and MOVED to get tha

As a photographer, I have to deal with this from time to time.

The shoot was on location in public, therefore the model has no expectation of privacy and Mr. GooberCam has the right to videotape the event.

However, as soon as he makes it obvious that he is trying to get the crotch-shot, it becomes illegal as he is invading her privacy by attempting to film something that is covered.

So as the lady said in the video, he can film ... but he can`t film her butt (looking up her shorts).

Here`s my question ... since that appears to be NYC ... did the photographer file for the right permits to shoot that? You can take pictures in public all you want. But he had a Pocket Wizard, a staff, strobes, reflectors, etc ... obviously this was a professional shoot, which in NYC requires a permit. He *could* have called NYPD, if he had the permit.

But, he did the best thing .... pack up, go grab some coffee, and come back in 20 minutes after Mr. GooberC

I see nothing wrong here. If the woman didn`t want the back of her filmed, they should not of been shooting in the middle of the street. You can`t make anyone not walk behind you. Anything that can be seen in plain sight is fair game. It is creepy to be filming someone`s ass? yes. Does he have the right to do that, yes. Does she have the right to ask him not to? Yes. Just like they could of avoided the whole thing if they shot in a studio. People get drunk and make total fools of themselves in public and end up on youtube. this is no different other than the model and the photographer should of been sober enough to realize in this day and age, there`s always someone with some kind of camera to tape whatever you are doing in public.

Enable for this to fall under Up-skirt laws the guy needs to "intentionally capture an individual`s private areas without consent, when there is a reasonable expectation of privacy. This also entails the circumvention of garments and modesty."

Obviously this girl had no reasonable expectation of privacy. The only way he was getting a "crotch shot" was when she put it on display in tight, small shorts. So there goes modesty. And he in no way circumvented her garments.

He was perfectly within the law.

The only law breaker was Mr. Goober on the bike. First is Harassment (engaging in intentional conduct which the actor knows would cause the victim, to feel frightened, threatened, oppressed, persecuted, or intimidated) Second is Menace (actions that would cause a person to have a reasonable fear that they are in danger of harm)

Sorry, but in a free country the freedom is for everyone.

    To KMeatPiLover,
The guy`s a creep and it appears he was trying to make a splash with this, and clearly he has, though probably not the way he wanted. He`s an non-nice individual but the law is on his side here. The situation you propose is one in which the person filmed is not making a public display of her/himself and has a reasonable expectation of being left alone. The person you propose following, taping and commenting could probably be charged with harassment and possibly even stalking. Don`t get me wrong, I think this jerk probably videotapes at the playground then goes home and jerks off to it but I believe he`s done nothing, in this video, prosecutable because poor taste and ostentatious stupidity are not illegal.

@broizfam "which the person filmed is not making a public display of her/himself and has a reasonable expectation of being left alone"

So because this woman has a job modeling in public she no longer has a reasonable expectation to be left alone?

What most of the men/boys commenting on here don`t understand is that when a woman goes out in public she never has a reasonable expectation of being left alone because non-nice individuals like this guy will always find a reason to harrass woman.

If your top is too low cut then you no longer deserve to be left alone.
If your jeans are too tight you no longer deserve to be left alone.
If you`re riding your bike and your butt is in the air you no longer deserve to be left alone.
If you are wearing sweatpants and just roled out of bed, SORRY, you still won`t be left alone.

So It`s not surprising that modeling is being added to this list of things that woman are not alowed to do in public

Meanwhile, a man just jogged by wearing nothing but bike shorts and NOBODY harrassed him.

Men can do whatever they want in public and not get harrassed. Naturally, most of you take this for granted and instead of demanding that men stop harrassing women you create a bunch of arbitrary rules of what women can and can`t do in public and say,

"IF WOMEN WOULD JUST STOP DOING XYZ IN PUBLIC THEN NOBODY WOULD HARASS THEM!"

Ironicly, the Taliban use similar reasoning when they ban women from wearing anything but a burqa in public. I guess you guys have more in common than you thought!

I see the phrase "she has a right to not be harassed" or close to it from several posters both male and female. My question is, at what point did he harass this chick? He was filming her and apparently she (and a few others) didn`t want him to. But he didn`t initiate unwanted touching, invasion of personal space, rude, intimidating or threatening comments, or initiate distracting behavior. As a matter of fact he didn`t address her at all.

Look, the guy was being creepy. That is a given by and large. But that isn`t against the law in any way, and as soon as we start deciding that someone shouldn`t be allowed to do something because they are fat, ugly, old, play WoW or simply because we don`t want them to; we may as well throw in the towel on freedom altogether. Removing liberty for one is removing liberty for all.

I can see how someone might take offense to that, but who knows what was happening before the video was cut into her ass...though it does seem like he is taping her ass...so who knows but him and the people around. It still doesn`t give people the right to become complete douch-holes especially the named goober in this video. At the same time... if she was under 18 then these people had every right..

I saw this on digg, and they said she just stretching, I believe. I know they said nothing about her being a model.
    ---------------
So she brings a chair out into the street so she can stretch? That`s kinda weird.

    @Wizard77

When did he start harrassing her? Seriously?

You even provided the definition yourself

"Harassment (engaging in intentional conduct which the actor knows would cause the victim, to feel frightened, threatened, oppressed, persecuted, or intimidated)"

When he started filming her butt and she asked him to stop because she obviously felt THREATENED and FRIGHTENED by his predatory behavior. That`s when he started harrassing her.

You would have a very hard time getting any DA to buy that argument. 1) She was in no way approached by this guy. He was in the crowd like a dozen other people. 2) Without the camera he would just be another bystander. 3)If she was feeling threatened, a camera could not be argued to be threatening by virtue of its presence. She was not for example, threatened by the photographer she knew OR other bystanders.

She CHOSE to do this in public and had no reasonable expectation of privacy. As for her "being left alone" while in public; the law says (at least in the USA) one can not expect privacy or to be left alone when in a public area. PERIOD!

I know you don`t like the guy or what he is doing and that is understandable. But someone being "icky" isn`t legal ground to stand on. Attempting to shoe-horn his actions into something illegal or trying to stretch what is on camera into a threat is irrational.

    @jeffcomedy

Sexual Harrassment in a public place isn`t illegal. It`s only illegal in the workplace. In public it is protected speech. Same as racism. I can`t go to work and put up a sign that says "I hate blacks." I am fully free to walk up and down the street with one though. If she has an "expectation of not being sexually harrassed" while posing like that on a public sidewalk in a US city, she`s an idiot. Any hottie who`s walked by a group of construction workers can tell you that.

Upskirt photos are illegal because physically sticking your head down there and looking is also illegal. If what this guy is doing is illegal, than everyone who so much as looked at her would also be breaking the law.

This guy might be creepy, but being offensive to someone isn`t against the law in this country.

So according to a majority of poster on this thread,

    Violence against women = Crime

Violence against men = Justice / funny / reparations for perceived wrongs of the past or nature.

ryanwi, the model was obviously creeped out by it. although I am surprised she didn`t say something (or the photographer for that matter, he kept directing her). at the same time, if the vid guy had the right to shoot her, then everyone else who told him not to shoot her butt/crotch were also within their rights to do so. as jeffcomedy already stated, the older woman told him not to take a vid of her butt, not necessarily the model herself. on a courtesy note, the guy didn`t have to be a dick about it, I`m sure he has access to plenty of porn at home, why go through the trouble?

Yeah, it`s creepy what that guy is doing, but she is out in public doing leg lifts and spreading it out there, job or not. If they did not want to be seen/filmed/photographed they should have done this on a closed set and used photoshop. Sorry, but you`re in public. Too bad.
