Passerby tries to film a model posing for someone else. Bystanders take offense.

I found this question so interesting that I actually took the time to research it. Unfortunately it`s a little bit of a gray area. Yeah, it`s creepy what that guy is doing, but she is out in public doing leg lifts and spreading it out there, job or not. If they did not want to be seen/filmed/photographed they should have done this on a closed set and used photoshop. Sorry, but you`re in public. Too bad.

ryanwi, the model was obviously creeped out by it. although I am surprised she didn`t say something (or the photographer for that matter, he kept directing her). at the same time, if the vid guy had the right to shoot her, then everyone else who told him not to shoot her butt/crotch were also within their rights to do so. as jeffcomedy already stated, the older woman told him not to take a vid of her butt, not necessarily the model herself. on a courtesy note, the guy didn`t have to be a dick about it, I`m sure he has access to plenty of porn at home, why go through the trouble?

Sexual Harrassment in a public place isn`t illegal. It`s only illegal in the workplace. In public it is protected speech. Same as racism. I can`t go to work and put up a sign that says "I hate blacks." I am fully free to walk up and down the street with one though. If she has an "expectation of not being sexually harrassed" while posing like that on a public sidewalk in a US city, she`s an idiot. Any hottie who`s walked by a group of construction workers can tell you that.

Upskirt photos are illegal because physically sticking your head down there and looking is also illegal. If what this guy is doing is illegal, than everyone who so much as looked at her would also be breaking the law.

This guy might be creepy, but being offensive to someone isn`t against the law in this country.

You would have a very hard time getting any DA to buy that argument. 1) She was in no way approached by this guy. He was in the crowd like a dozen other people. 2) Without the camera he would just be another bystander. 3)If she was feeling threatened, a camera could not be argued to be threatening by virtue of its presence. She was not for example, threatened by the photographer she knew OR other bystanders.

She CHOSE to do this in public and had no reasonable expectation of privacy. As for her "being left alone" while in public; the law says (at least in the USA) one can not expect privacy or to be left alone when in a public area. PERIOD!

I know you don`t like the guy or what he is doing and that is understandable. But someone being "icky" isn`t legal ground to stand on. Attempting to shoe-horn his actions into something illegal or trying to stretch what is on camera into a threat is irrational.

I see the phrase "she has a right to not be harassed" or close to it from several posters both male and female. My question is, at what point did he harass this chick? He was filming her and apparently she (and a few others) didn`t want him to. But he didn`t initiate unwanted touching, invasion of personal space, rude, intimidating or threatening comments, or initiate distracting behavior. As a matter of fact he didn`t address her at all.

Look, the guy was being creepy. That is a given by and large. But that isn`t against the law in any way, and as soon as we start deciding that someone shouldn`t be allowed to do something because they are fat, ugly, old, play WoW or simply because we don`t want them to; we may as well throw in the towel on freedom altogether. The guy`s a creep and it appears he was trying to make a splash with this, and clearly he has, though probably not the way he wanted. He`s an non-nice individual but the law is on his side here. The situation you propose is one in which the person filmed is not making a public display of her/himself and has a reasonable expectation of being left alone. The person you propose following, taping and commenting could probably be charged with harassment and possibly even stalking. Don`t get me wrong, I think this jerk probably videotapes at the playground then goes home and jerks off to it but I believe he`s done nothing, in this video, prosecutable because poor taste and ostentatious stupidity are not illegal.

Enable for this to fall under Up-skirt laws the guy needs to "intentionally capture an individual`s private areas without consent, when there is a reasonable expectation of privacy. This also entails the circumvention of garments and modesty."

Obviously this girl had no reasonable expectation of privacy. The only way he was getting a "crotch shot" was when she put it on display in tight, small shorts. So there goes modesty. And he in no way circumvented her garments.

He was perfectly within the law.

The only law breaker was Mr. Goober on the bike. I see nothing wrong here. If the woman didn`t want the back of her filmed, they should not of been shooting in the middle of the street. You can`t make anyone not walk behind you. Anything that can be seen in plain sight is fair game. It is creepy to be filming someone`s ass? yes. Does he have the right to do that, yes. Does she have the right to ask him not to? Yes. Just like they could of avoided the whole thing if they shot in a studio. People get drunk and make total fools of themselves in public and end up on youtube. this is no different other than the model and the photographer should of been sober enough to realize in this day and age, there`s always someone with some kind of camera to tape whatever you are doing in public.

As a photographer, I have to deal with this from time to time.

The shoot was on location in public, therefore the model has no expectation of privacy and Mr. GooberCam has the right to videotape the event.

However, as soon as he makes it obvious that he is trying to get the crotch-shot, it becomes illegal as he is invading her privacy by attempting to film something that is covered.

So as the lady said in the video, he can film ... but he can`t film her butt (looking up her shorts).

Here`s my question ... since that appears to be NYC ... did the photographer file for the right permits to shoot that? You can take pictures in public all you want. But he had a Pocket Wizard, a staff, strobes, reflectors, etc ... obviously this was a professional shoot, which in NYC requires a permit. He *could* have called NYPD, if he had the permit.

But, he did the best thing .... pack up, go grab some coffee, and come back in 20 minutes after Mr. GooberC

Technically, yes, she is in public, and so is he. This is how photojournalists can take pictures lawfully. As long as you are in a public place, and so is your subject, you can take a picture.

For someone to take someone else`s property without their consent, that is stealing.

Now for him to act like that, yes he`s being a prick about things and could have handled it by being less of a loser.
