Run A Stop Sign And Get A Ticket? Loophole! [Pic

Submitted by: fancylad 7 years ago in Misc

If you happen to run a stop sign and get a ticket for it, do a little investigating on the sign--you might get off.

Another one is that if double yellow lines don`t have a line at the end of them like this ===| then they are not complete and therefore you can`t be given a ticket for parking on them :DD

@ piiink1,

"its more of if you didn`t stop and you got a ticket you can get out of it this way"

Well why in the hell would you be running a stop sign in the first place. If you can`t see it to stop, you shouldn`t be driving.

FYI... In Indiana, this is BS. Also, the police don`t enforce traffic laws on private property. I think someone mentioned not having a license. Here, that`s actually an arrestable offense, and can be enforced anywhere the person is operating a vehicle. Luckily, for the offenders, if you appear in court and don`t have a history, they will take in under advisement for 1 year, then you`re good.

how about you just stop so you don`t run the risk of being hit by a car?

That`s good to know. So, from now on, I`ll stop my car, get out, look to see if there`s a sticker, and if there`s not, I won`t stop...except...I already stopped...DRAT!

IkeRay, laws vary by state. If you are in California, you are flat wrong. Any parking lot that is accessible to the public falls under the same jurisdiction as the streets; police can and will enforce any and all traffic laws in parking lots.
People - never take legal advice from idiots on the internet (myself included). These laws are published online, how hard is it to just look them up?

Wow, IkeRay, get your head out of your own ass. A rolling stop is a victimless crime if you don`t hit anybody, which is kind of the point of rolling through instead of just not slowing down at all, to make sure there`s nobody there. Much unlike murder...when you make comparisons, try to keep them reasonable.

Don`t take legal advice from a entertainment website. Especially when it is advice about state law since every jurisdiction handles these situations differently.

"Where I live all parking lot signs, including posted limits and stops are legally binding."

unless its a government buildings parking lot, then you`re wrong. parking lots are private property and police have 0 jurisdiction over the stop signs, painted "STOP" on the ground, speed limits, and even accidents. Police may show up to a scene of an accident in a parking lot, but they cannot issue a ticket, even for offenses such as expired registration, expired inspection, no license, etc. the only thing the cop can do is point fault.

"or if it`s a very quiet road i will just slow down and then keep going."

so just because you don`t get caught its ok? like the speeders who slam on the brakes when they see a cop, if they aren`t caught speeding is ok....(yes this may be extreme) but if you murdered someone and weren`t caught, is that also ok? w/o laws and people obeying said laws, we have chaos

but don`t get me started on co

You: "judge I have photographic evidence of this sign not being a legally binding stop sign"

Judge: "what are you talking about"

You: "I saw this on i-am-bored.com that since there isn`t a sticker I am not legally obligated to stop"

Judge: "i-am-bored.com huh, *facepalm"

something like that

nettech, I can`t speak for other states, but it`s not a question of "what laws are going out the window" it`s a question of what`s being kept out. Should police be able to enforce how fast I drive or where I stop on my own property? As as stores and stuff go, that is not to say there are no consequences, it simply become a civil matter at that point.

"Would you rather wait the half an hour that the cops take to write you a ticket, or stop for a second or two and drive on?"

I don`t think it`s meant as a "Well, do it and you might get away with it," so much as if you DO slip up and run a stop sign, you might be able to get away without a fine.

And for all of you that think it`s ok to ignore traffic laws on private property, what about a traffic light? Pedestrian crossing? No parking zone? Speed limits?

Where does it stop? What other laws go out the window?

And keep in mind that there`s a difference between private property and private property where the public is openly invited like a store or mall.

But Judge... I thought it was one of those signs I didn`t have to obey... And honest - I would`ve stopped had I seen the other car/ kid-on-a-bike/ old-lady/ skateboarder/ 5-year-old....

@apexs: It might be "100% true" in your town, development, state or whatever, but it is also "100% true" that in someplaces you must obey the signs no matter what - which makes sense.

What state do you live in?

One example I found regarding gated communities is that they can invite the police to do enforcement with an agreement. Also if the streets belong to the town instead of the community (for maintenance purposes) then the signs belong to the town also.

Not so cut and dry.

its 100% true that on private property that if there is a posted stop sign you do not have to stop IE like shopping centers and gated residents. I know because i was stop by a police officer and he told that he can not ticket me but i should not run any stop sign for safety issues

This is wrong. If a sign is there not by government, then it still has to be DOT approved (or the individuals who put it there get fined out the ass), thus making any directional traffic sign legal binding.

But all in all...why not this loophole: Dont drive like a d*ck.

Male 1,184
Oh, BTW, no one is going to look at the back of a street sign while driving. You`d have to stop to do so anyway. That person obviously meant to run a stop sign, whether or not it was a legal stop sign.

Well, since we`re posting pictures directly from reddit`s homepage, you might as well see what Florida`s Senate has to say.

Florida Statute 316.074(4) whenever official traffic control devices are placed in position approximately conforming to the requirements of this chapter, such devices shall be presumed to have been so placed by the official act or direct of lawful authority unless the contrary shall be established by competent evidence.

Yeah it`s Florida, I know. But still. If this [quote">were[/quote"> true, then everyone would just go around peeling off the stickers to get off scot-free.
