If you read the story (I just want want to play devils advocate) The guy said he didn`t realise the kid was there, and then apologised and gave the ball to the little kid. Then who ever hit the ball gave the guy two signed balls for the "meanie`s" kids, and signed the other kid`s ball. So all is okies!

Goaliejerry, you are making some awfully big assumptions about agency/ the scope of agency/agent authorization.. We could just as easily make assumptions/skew facts and claim a donative transfer or even larceny of the ball by the player. But for the sake of agreement, I can easily see your argument and, assuming certain facts, agree with you -- ABANDONED :-)

I really don`t see how the guy is in poo for this. He gave it to his little kid, he basically said its that fat kid or my kid, and i like my kid better. Ever to go a baseball game and anything thrown out into the crowd has to go to a little kid, even if its an xtra large t-shirt. well screw that, when i have a kid i will do anything to get him stuff, regardless if i piss on another kids day cause i have longer arms and not those fat stubby things

It doesn`t matter that the baseball player made it so they each got their own ball, the fact is the dad took it from the little boy (there`s no way he didn`t see him when he was reaching right in front of his face) just because they both got balls doesn`t mean it`s all better he`s still a douche.

Thats not quite correct. If the player was an agent of the true owner of the ball, the player was implicitly authorized to divest title to the baseball, as happens all the time. If not, the true owner abandoned the ball, as they clearly had intent to relinquish title and not retrieve the ball.

Several possibilities: (1) Home team owned ball and intended to abandon, allowing player to gain title, (2) MLB owned ball, but abandoned it, allowing player to gain title, or (3) either (1) or (2), but player was agent of his principle, who gained title in employers name, as he was within scope of agency, but was implicitly authorized by industry custom to divest title in favor of another, which he did.

It`s doubtful the kid would`ve caught the ball, The boy with the glove was covering his face in fear. I don`t believe this guy even knew the ball was intended for the kid with the glove until afterward.
He did give it to him later and that had to be hard, Considering he was taking it out of his own kids hands.

Jerry, the video you linked doesn`t say the dad gave the ball back, it says Wright had to fix the situation by giving the kid another ball after the game. The baseball was clearly intended for that kid, and that d*ckhead had to reach directly in front the kid`s face to steal it.

Folks, let`s all take a minute to realize that he gave the ball to his own son. Shortly thereafter, the man gave the ball back to the kid he had apparently stolen it from. Then, David Wright, the player, made arrangements to have the man`s as well as the man a ball for the hard time they had went through.

jamie76 - you might be reading a *bit* too much into this. Short internet videos have a way of making douchebags out of otherwise good intentioned people who make mistakes - MISTAKES THE MAN ACTUALLY CORRECTED BY GIVING THE BALL TO THE KID! This video (not surprisingly) omits that part.

COME ON - dad probably didn`t see little kid (3 feet tall, to his left) from where he was standing, and wanted his kid to get a ball. Whats so wrong about that?

PLUS - Dad DID give the kid the ball once everyone around him booed - he probably didn`t realize what happened and felt bad.

PLUS - baseball play later came by and gave BOTH kids a ball, so the world is HAPPY!!!!!
