well not saying it isn`t a little fishy... ive worked in alf`s and when people have alzheimers they get scared and confused and lash out sometimes physically. i`ve had things snatched off me before by some excited old person. they`re stronger than they look...

Hmm... I was roomed with an elderly woman (with dementia) on a neurology ward and she used to pull the alarms thinking that the Nazis were coming to Krakow.

They can definitely act oddly at times.

On the other hand, it wouldn`t unfathomable to take advantage of someone in that condition.

Why wouldn`t the nurse have backed away to cover himself immediately instead of lingering around for others to see?

I`d like that to be true, but it isn`t. Being medically trained doesn`t make it impossible to abuse people.

I don`t know. The bias against him predisposes me to think he`s innocent, but that`s just me rooting for the underdog. I haven`t really seen any reliable information, so I can`t fairly judge the case.

One of the degrees is rape. The others are not rape.

Some people want to inflate rape figures for their own political reasons, so they mislabel other things as rape in order to inflate the figures.

Some people want to create rage that they can use to gain more power, so they take something already reviled and falsely apply the same label to other things, partly in order to create a degree of rage that would not exist if they were labelled honestly and partly to silence dissent.

In all cases, only the worst extreme is referred to and everything else is treated as if it was that. Disagreeing with that dishonesty can then be treated as support for that worst extreme.

People wonder why kids these days use the word rape in everyday conversation ("you just got raped at MW2 man!"). I`d say its because the word has been abused to the point that it no longer carries the emotional weight it used to (when raped meant forced intercourse)

well theres no good defense for claiming the old lady whipped his junk out before he could react. the only way he could explain it away would be to say they were in the process of a conssentual sexual act when she had an episode. which of course wouldnt work at all since its already established that she cannot give consent. and ya i meant he would get off of the second degree rape charge im sure he will get charged with something to. should have been more specific

While I don`t think he`ll get off with nothing, I do think it will be minimal, because your right it`s all circumstantial. I think at the very least he`ll be interrogated on just how this frail woman managed to get his junk out of his pants without his being able to stop her.

with all this you only have implications. circumstantial evidence is not enough to convict him it is barely enough to charge him so he will prolly get off on the charge (no pun intended). she has alzheimers so she isnt competant to be a witness and the cops didnt witness anything occur other then indecent exposure.

dragosal, while I agree that double standards in charging women with offenses are not right, I don`t think that this is the time to be arguing it. If it were a woman and she were being let off then it would be relevant, but just because some women are inadequately prosecuted is not a reason to diminish what this perv was doing.

This is Rape in the second degree according to Washington. I think they charged him with rape because she was not mentally capable of giving consent, he is a health care provider, and the fact that he was over top of her implies that he had been more actively pursuing intercourse rather than just exposing himself. That combined with the ladies hand being in the vicinity of his crotch implies that he perhaps had forced her to touch him.

Why didn`t he have any underwear on? Or did he? If both his pants and his undies came down then it`s a totally clear cut case. I have old people grab at me all the time and stuff, and you have to be a little on your guard and anticipate the possibility, but if this guy expects me to believe this poor lady was so wily, that she managed to undo his trousers and get his junk out, scream, and he didn`t put it away before someone came in...
