xiquiripat, my opinion is based on context. I don`t think that this method should penetrate into mainstream society because that would be a waste of public resources and would probably result in an *increase* in corruption (e.g. wrongful accusation based on blackmailing). It would also have to be derived from a big brother society.

But in the context of the military, these are people in high-stres, high-risk environments and if superior officers don`t keep an eye on their subordinates, something could happen that could threaten the lives of others. In this case, if there is no other evidence than these pictures (and that`s a BIG if), then it`s worth the price to make sure this man is still mentally fit to be on the front lines. I feel sorry for him, but it`s sometimes the price a person has to pay for the cohesion of a unit in combat.

If this guy really is looking at child porn and has perverse control issues, would you be comfortable putting your life in his hands?

Well, let`s see, is it easier to defend yourself against one individual or the state? Simply being wrongfully accused, let alone convicted, of sexual abuse, rape, or child pornography can damage a person`s life just as decisively as being the victim of a sexual crime. It can take a person a lifetime to get over either one.

Wow . .... The pendulous swing of humanity,goes from ambivalence to asinine. Why in God`s name is this man in custody for child pornography for simple pictures sent to him by his own mother of a child ( whom we really don`t know the connection ) to help lift his spirits while in a war zone!
If this is the case then anyone who looked at the entry just a few places up should have their eyes burned out and head on a plate for looking at the young obvious underage Japanese girls standing in line with their panties around their knees.
Maybe to help people with their judgment ( so they won`t find themselves in this sort of predicament again) someone can either come up with a feature on a camera that can judge whether a simple picture of a child will be construed as child porn of course it would have to be updated daily because ideas and views or interpretations change that often....or maybe have a program on your computer to evaluate the photo.

That`s horsecock. Unless there are other pictures involved, the LT. or the company commander should have shut this poo right down. Those are no more pornographic than kids running through sprinklers. The rights of military personnel are not the same for the common citizen. In order for every level of the military to run effectively (despite what you think about the objectives set down by superior officers) and if people`s lives are in jeopardy, you can`t take the risk of letting someone who might have deep psychiatric problems slip through the cracks.

I don`t think those pictures count as child porn, but some of them are provocative enough to wave some red flags. Is that enough to charge a man in the military? Maybe. If there isn`t anything more to the story, he`ll be found innocent.

Honestly, there are greater atrocities being committed in the world right now then this. Why not save your outrage for something important -- like, I dunno, the Haitian earthquake profiteers?

Why people love to hate the military I`ll never understand. Im going to go ahead and assume the military at least generally follows the U.S. policy of "innocent until proven guilty" and probably has more to go on than simply his possession of these photos.

There HAS to be more to the story than just those pictures. The military has proven it`s lack of intelligence over the years, but doubt they would get mad at a soldier for just having a few pictures of a little girl. Maybe he told his mom it was those pictures because he was ashamed of the pics, IDK...

In the military, there is no such thing as innocent until proven guilty. The military doesn`t use civilian laws and judicial operating procedures. They have what is called the Uniform Code of Military Justice (UCMJ), and it doesn`t provide military members with constitutional rights.

I agree that it`s better to err on the side of caution. Some of those pictures really could be considered provocative. The military is strict -- and soldiers know that going in. And if the army is that strict, then you feel safe knowing there`s no corruption or shenanigans going on. What`s worse -- a wrongful accusation or an offender who`s never caught?

(BTW, look at the Garrido case and tell me things wouldn`t have been better if people erred on the side of caution)

If he really is innocent, the court will find him innocent. And this will be a poo experience, but it`s part of life.

20 bucks says that he was charged for a batch of other pictures he had not the ones his mother sent...

Much like the story about the kid who made bomb threats and it turned out his mother was a dirty liar the whole time and that he really made the threats.

Now I am not saying that this couldn`t be what it looks like and maybe he is wrongfully charged but if his parents had no idea what he was officially charged with how did they know that those pictures were the cause? I bet you anything that he had other pictures of actual child porn and that is the reason he is in trouble right now.

What the video shows us does not add up. Just watch it a second time and pay attention to the details and facts they aren`t telling us that these pictures are what he is being charged for or that the family had been informed that they were the cause either.

As for you goostik. i only raged at the ignorance of the US Military. I believe this story is one of the main things wrong with the world especially the US. The fact that everyone is against everyone. Laws are subject to the interpretation of ignorant people. Joe Citizen thinks he knows best and kicks up such a fuss that he annoys "To whom it may concern" until something is done about it. Then that becomes the norm.

I tell you a story, I have been free from the blinding smoke of the US for 9 years now. Well, being what looks like the only US Soldier on this website I thought I`d share my two cents on it. This actually isn`t surprising. The Army is a large enough organization that has to worry about hundreds of thousands of Soldiers. With that in mind, the Army tends to err on the side of safety instead of being surprised and looking like a giant douche in front of the entire world. I`d be willing to bet, they`re approaching this with a "better safe than sorry" mindset because there probably are Soldiers, just like civilians, out there who would find those pictures arousing. Billy here is just taking the big green weenie like all Soldiers eventually do, his case is just rather severe. If there`s not more to this story that they`re not telling, then the charges will probably be dropped after the court martial.
