If this bulls#it suit passes, there`s gonna be a lot of bodies laying out in the sun on the border. No one is gonna let an illegal immigrant off their property alive and there`s a lot of places to hide a corpse on 22,000 acres.

If someone came in the back door to your house and you had to drive them out by pointing a gun at them, then they attempted to sue you for threatening them, they`d be wrong and your legal system would be officially [email protected] if it sided with the trespassers.

They don`t have to win. I have already lost faith in the legal systems of Canada and the USA for this very reason. We let criminals sue a landowner for being caught trespassing, or in this case, illegal immigration. This is complete BS. There`s a reason the sheriff did nothing to stop the rancher. It reminds me of a story I read a few years back of some guy tripped on a toy and broke his ankle falling down the stairs of the house he was robbing. He sued the homeowner and *won*. The North American judicial system needs an overhaul. Too bad the time and money required aren`t there.

And bhedgehog is correct, while we in the U.S. are supposed to be the "great melting pot" and welcome all immigrants, we do not.

BUT, we do have one of the world`s more lenient immigration policies. Here in the agricultural midwest, there are more farm and ranch jobs than can be filled... and the majority of people who fill those jobs are Mexican migrant workers who come here and work LEGALLY.

So I scoff at those who jump the border in the dead of night. All they need to do is apply for a work visa, and the state of Minnesota will welcome them and they`ll have NO problem finding work... in many cases, all they have to do is show up at a farm, say they want a job, and show their paperwork. The majority of small towns even have housing available just for the migrant workers.

No illegal border crossing, trespassing and skulking in the dead of night necessary.

There is a HUGE difference between immigration and smuggling. You want to immigrate here? Fine. Do it the legal way. Otherwise, you run the risk of getting shot for trespassing. I love the negative spin some of you are intentionally putting on my words.

Cutting across my property is not going to garner any response from me at all.

Damaging my property and doing anything that could be construed as threatening my safety WILL garner an appropriate response.

Said response could be anything from my telling you to to leave, to physical intervention and removal IF NECESSARY.

I have a houseful of little kids right next door to me, subsequently balls, frisbees, and toys sometimes inadvertently come over the fence.

All the kids next door know that they are more than welcome to enter my yard to retrieve their belongings if necessary, and understand that it is not safe to enter the yard if the dogs are outside unattended. If that`s the case they know to ring the front doorbell and tell me that a ball, or whatever has come over the fence, and will I get it for them.

I remember once I was traveling to Taiwan about seven years ago. One of the people I was with was a U.S. citizen but she still had a Filipino passport from when she lived there. Once we arrived in Taiwan they refused to admit her into the country because they saw the blight the Filipino illegal immigrants were causing their country. Even though she could document she was a U.S. Citizen and the U.S. Embassy backed her on it, they still refused to let her in because of the source of her passport. I even asked one of the agents over there how they deal with illegal immigrants coming into their country and he said it was a major problem so they have a "shoot first, ask questions later" type of policy there. Get out in the world a little folks. You`ll realize the U.S. has a border issue that`s dealt with in kindness more than any other place on the planet.

Regarding Euro countries, even many of them are now cracking down on immigration because they realize the blight that illegal immigration causes. Just look at the UK for example. The problem is not the illegal aliens. Illegal aliens are really only secondary.
Illegal alien`s come to the US to seek employment at a better life. Who`s at fault are the legal citizens who give them jobs. If Americans didn`t hire them they would keep searching for a better place to live.

Sorry, bub, but I`m afraid it does mean you do not value human life as much as it SHOULD be valued... whether you like it or not. Property is NOTHING. Life is EVERYTHING. One does not equate with the other in any way, shape or form... and to imagine for one moment that damage to (or even walking on) someone`s property should be punished with death is over valuing that property by an infinite amount. Your involvement with any deaths in the past, rightly or wrongly, do not have any impact on this argument, however the mere fact you bring them up is telling. That is so wrong and stupid. If you are not a U. S. citizen, then you do not share in American civil liberties. Even with a visa, non-citizens` rights are restricted. Therefore, these illegals should not be allowed to sue in American courts. They can take it up with their own courts, but that would still probably get them nowhere.

Well, the farmer doesn`t sound very nice, but neither do illegal immigrants as a whole. OK, maybe these particular people didn`t wreck anything or mess up his land, but I can see why he`d be annoyed.

The question that I would like answered is why it was left up to an angry farmer to defend the American boarder? The article makes it clear that his land is a well-known `highway` for illegal immigrants, so why not spend a bit of extra money on posting more boarder patrol to properly protect his land, as well as the immigrants legal rights? Things like that should not be left up to an angry citizen.

I feel bad for the immigrants - they must have it pretty awful to want to leave their country, family, friends etc and risk getting caught. But suing? Please! They have every right to be treated humanely which is another reason that the area needs to be properly policed, rather than the law enforcement relying on a man with a gun and a grudge.

You can be held liable for anyone that gets injured on your property and I`m sure he doesn`t want to have to pay tens of thousands of dollars to get insurance to cover all those illegals crossing his land.

My only regret is that he didn`t blow their heads off with a shotgun and perch their rotting, headless corpses on stakes at the edge of his property with a huge sign (in ENGLISH) that says "Illegal Immigrants Are Not Welcome Here". My bet is they would stop crossing on his property immediately. My only prayer in this case is that someone take the filthy attorney who took this case out behind the courthouse and beat him within 2 millimeters of his life. This guy had every right under the laws of his state and his country to do what he did. He`s defending the border of our nation. and the rancher was perfectly in his rights to hold them (Yes, even at gunpoint) until authorities arrived. He apprehended criminals in the act of breaking federal law. I`m somewhat on the same wavelength as Robert D; I`d need more information before making a judgment on the abuse issue. However, I DON`T need any more information to know that the bottom line in this whole situation is called TRESPASSING - If this rancher has even a single No Trespassing sign posted then anyone entering his property without his permission is violating the law. Period! The fact that these illegal immigrants use his property as a highway for entry to the US and along the way leave every kind of gross litter, garbage and human waste in their path is reason enough for him to make a `citizens arrest`. They are trespassing, vandalizing, stealing (remember the calves?) and basically denying Mr. Barnett his LEGAL right to bar anyone from entering his property without his permission, in addition to jeopardizing his business. If he has become less than cordial to the illegals over the years all I can say is: if you don`t like his treatment, don`t go on his land!

I have some friends who work for the U.S. Border Patrol, and my fiancee`s family owns 180 acres on the Arizona/Mexico border.

Last February, I spent a week there helping clean up trash left by illegal immigrants, and assisted in demolishing two maintenance sheds that they were using to sleep in... after they stripped it of everything of value, and urinated and defecated anywhere they pleased.

My Border Patrol friends have their share of "war stories" of being attacked by illegals they are attempting to apprehend.

There is NOTHING "low" about defending your family, home and property.

I will defend my family, home and property with the maximum force the law allows... Including deadly force if the situation warrants it.

The article, like many dealing with legal topics, is short on specifics and doesn`t give me enough to make an informed decision about this.

They claim their civil rights were violated by being held captive at gunpoint and "terrorized" for lack for lack of a better term.

I`d need to know more about the provisions in that state for citizen`s arrests. Usually you`re permitted to detain someone until the authorities get there, and that seems to be what he did.

Sure they have allegations that he kicked one of them, and maybe frightened them, and maybe that does deserve to go before a jury. Let`s let 12 citizens decide.

I don`t know why you`d lose faith in the law if he`s convicted by 12 of his peers.

I`d just like to add, the idea that civil rights should be extended to non-citizens is not a new one. It`s also an important concept because we don`t want illegal immigrants being abused, enslaved, etc. by anyone.

I especially liked how a Mexican American group was representing the illegals. I guess in their eyes, a Mexican on US soil is a clear substitute for the actual citizenship process.

My Dad actually taught me how to fire my first gun, by taking me to the edge of our property (In Texas) and having me fire "warning shots". I know just how he feels, because even nine years ago, we faced the same problems he did. I personally hope that those illegals get what they deserve. This is our nation, not theirs. Kbx3, I understand your concern, but... you`re a legal immigrant. You have the requisite papers. Of course there is a human component, but look at it as a different scenario: if his ranch was being trampled all to hell by thousands of citizens who decided it would be a good place to hike, doesn`t he have the right to ensure that they get off his property and are prosecuted properly? Whether the trespassers are legal or not, it`s his right to control who enters his ranch.

On one hand I agree that illigal immigration is a problem (we have a big problem with it in the UK as well)...Nobody wants people setting up camp in their back yard or taking their jobs etc etc.

On the other hand I think far to many Americans are de humanising the issue.
If these people are desperate enough to cross the border in the first place, it obviously means all other options have been exhausted. I know if I was desperate, I`d do anything to find work to feed my family. I know this wont allways be the case but some people are obviously desperate.
