    Those Mexicans are crossing illegally, but the rancher did point a gun at them. A gun of all things... Hmmm. Why would Mexicans want to move INTO the US? I suppose its less of a hole then where they came from... Unless they`re moving further north. But human rights violations? I donno...

    OK. I hope the Mexicans win, but also that they`ll then be deported back to Mexico.

    If he was abusing them in some way, sure, sue him, but for holding them until the authorities come is his right because they trespassed on his land.

    I think I`d put up a big sign stating in English and Spanish, "Land is mined", please watch your step.

    Seriously? Now we`re not allowed to defend our homes and property against incursions by ILLEGAL immigrants?

    Kudos to Mr. Barnett for taking a stand!

    And once this farce of a "civil lawsuit" is over, I hope that the State Department expedites the deportation of these illegals.

    If they`re here illegally, then they are in violation of Federal law, NOT U.S. citizens, and shouldn`t be crying about how their "civil rights" have been violated.

    What gives THEM the right to trespass on his land?

    Personally, I`d set my dogs on them, and fire a few rounds over their heads as they fled to discourage them coming back.

    And if they DID come back... well... "accidents" happen.

    If you want to live here and work, I welcome you to do so. But go through the proper channels and apply for resident alien status like the thousands who do so legally every year.

    This pretty much sums it up. I was all ready to go in and defend the immigrants and thought he was being racist...but no, he has a right to defend his home and protect his family. They were doing damage to his property and he has a right to protect himself and his family by any means necessary.

    On one hand I agree that illigal immigration is a problem (we have a big problem with it in the UK as well)...Nobody wants people setting up camp in their back yard or taking their jobs etc etc.

    On the other hand I think far to many Americans are de humanising the issue.
    If these people are desperate enough to cross the border in the first place, it obviously means all other options have been exhausted. I know if I was desperate, I`d do anything to find work to feed my family. I know this wont allways be the case but some people are obviously desperate.

    Osirisascend your response to dealing with the issue is is as low as it gets. A firm hand and an escort back other the border is all you can do at the moment. Arranging accidents...sick man..sick!

    Kbx3, I understand your concern, but... you`re a legal immigrant. You have the requisite papers. Of course there is a human component, but look at it as a different scenario: if his ranch was being trampled all to hell by thousands of citizens who decided it would be a good place to hike, doesn`t he have the right to ensure that they get off his property and are prosecuted properly? Whether the trespassers are legal or not, it`s his right to control who enters his ranch.

    This is actually a really interesting case, i mean here are these people clearly trespassing - and they are illegals. This bitter non-nice individual of a ranch owner is costing American tens of thousands in deportation and legal fees instead of letting in cheap labor.

    How can they even sue? I can`t walk into Canada and start a law suit. Yeah, they`re people and it means they have rights (such as not to be shot- even though in some states that`s legal), they don`t have all the rights of an American. America was founded on immigration- yeah, decades ago. You can`t just waltz into the country and expect all our rights. And you can`t destroy someone`s property and sue them! I hope those idiots lose.

    Everyone has civil rights, regardless of race, color, or creed. Not that I`m supporting illegal immigration, or this frivolous lawsuit.

    If you really want to do something about illegal immigration, maybe you should stop voting for these jackass politicians that do absolutely nothing about it, and our gov`t that seemingly doesn`t believe that this is a problem. And then do something about the farmers that hire them, do something about the gov`t handouts.

    If you want them gone, don`t give them motivation to come across the border illegally.

    i am sick of hearing about our country being built by immigrants. yes it was. it was built by legal immigrants who did things the legal way by getting legal papers and then coming here.

    This sort of thing is the kind that makes me feel ashamed of my fellow Mexicans.

    They go to another country, with NO legal rights (yeah, I said it, NONE) because they are illegal. Human rights is not the same as legal rights.
    And then they sue because the owner of the land wants to shoot them? WTF? If you trespass in a ranch in Mexico, prepare to get shot. Seriously.

    Those trespassers shouldn`t be allowed to a case. If they win don`t be surprise if you see more cases of illegal immigrants suing u.s citizens. Our rights in this country is disintegrating anyways. I am an immigrant of this country but i came here legally. Its not fair that my family and other families struggle to come here legally and find out that illegal immigrants are ruining our opportunities and give us a bad reputation to be here. Our economy is a sh*t hole right now and we cant afford to hire illegal immigrants anymore, why not give these jobs to laid off workers. This country need to work on its own problems and support its people above anything else.

    My Dad actually taught me how to fire my first gun, by taking me to the edge of our property (In Texas) and having me fire "warning shots". I know just how he feels, because even nine years ago, we faced the same problems he did. I personally hope that those illegals get what they deserve. This is our nation, not theirs. If they want to be a part of it, then they have to go through the proper channels.

    I especially liked how a Mexican American group was representing the illegals. I guess in their eyes, a Mexican on US soil is a clear substitute for the actual citizenship process.

    I sure hope that the judge is going to rule fairly in this one. If we get a clone of the judge that ruled in favor of the lady who spilled McDonald`s coffee on her lap, a very dangerous precedent will be set.

    The article, like many dealing with legal topics, is short on specifics and doesn`t give me enough to make an informed decision about this.

    They claim their civil rights were violated by being held captive at gunpoint and "terrorized" for lack for lack of a better term.

    I`d need to know more about the provisions in that state for citizen`s arrests. Usually you`re permitted to detain someone until the authorities get there, and that seems to be what he did.

    Sure they have allegations that he kicked one of them, and maybe frightened them, and maybe that does deserve to go before a jury. Let`s let 12 citizens decide.

    I don`t know why you`d lose faith in the law if he`s convicted by 12 of his peers.

    I`d just like to add, the idea that civil rights should be extended to non-citizens is not a new one. It`s also an important concept because we don`t want illegal immigrants being abused, enslaved, etc. by anyone.

    First off Illegal aliens are NOT citizens, So they don`t have civil rights protections within the US.

    Having said that, This guy should not be violating state laws concerning "Citizens Arrest". Once arrested, They must be treated humanely and not abused.

    The border patrol has agents abusing US citizens rights, Like the baptist preacher, But they can`t patrol this area regularly ? Something is way out of wack here.

    I have some friends who work for the U.S. Border Patrol, and my fiancee`s family owns 180 acres on the Arizona/Mexico border.

    Last February, I spent a week there helping clean up trash left by illegal immigrants, and assisted in demolishing two maintenance sheds that they were using to sleep in... after they stripped it of everything of value, and urinated and defecated anywhere they pleased.

    My Border Patrol friends have their share of "war stories" of being attacked by illegals they are attempting to apprehend.

    There is NOTHING "low" about defending your family, home and property.

    I will defend my family, home and property with the maximum force the law allows... Including deadly force if the situation warrants it.

    You can be as pompous as you wish, but I daresay if it was YOUR family and property involved you`d see things differently.

    I`m somewhat on the same wavelength as Robert D; I`d need more information before making a judgment on the abuse issue. However, I DON`T need any more information to know that the bottom line in this whole situation is called TRESPASSING - If this rancher has even a single No Trespassing sign posted then anyone entering his property without his permission is violating the law. Period! The fact that these illegal immigrants use his property as a highway for entry to the US and along the way leave every kind of gross litter, garbage and human waste in their path is reason enough for him to make a `citizens arrest`. They are trespassing, vandalizing, stealing (remember the calves?) and basically denying Mr. Barnett his LEGAL right to bar anyone from entering his property without his permission, in addition to jeopardizing his business. If he has become less than cordial to the illegals over the years all I can say is: if you don`t like his treatment, don`t go on his land!

    kbx3, its not sad. its how humans operate, and i guarantee you that sympathy has a limit, in every single case. from what meager details were provided, it wasn`t a little amble through the rancher`s yard that was taking place. i can totally see that his patience had run out, and if i were in his place and my property was being overrun by strangers, people that you don`t even KNOW have a family or not, i can also see how someone could shoot someone and live with themselves afterwards.

    To be honest, LEGAL immigrants should see this and other incursions of illegals as a slap in the face moreso than those of us born here.
    and the rancher was perfectly in his rights to hold them (Yes, even at gunpoint) until authorities arrived. He apprehended criminals in the act of breaking federal law. How he treated them is irrelevant except if he ACTUALLY committed any human rights violations, which judging by the article, he did not.

    They introduced new laws in the UK a few years ago which basically completely protects the homeowner from prosecution if someone breaks into their house. So if he were over here, he`d be fine.

    My only regret is that he didn`t blow their heads off with a shotgun and perch their rotting, headless corpses on stakes at the edge of his property with a huge sign (in ENGLISH) that says "Illegal Immigrants Are Not Welcome Here". My bet is they would stop crossing on his property immediately. My only prayer in this case is that someone take the filthy attorney who took this case out behind the courthouse and beat him within 2 millimeters of his life. This guy had every right under the laws of his state and his country to do what he did. He`s defending the border of our nation.     Well, the farmer doesn`t sound very nice, but neither do illegal immigrants as a whole. OK, maybe these particular people didn`t wreck anything or mess up his land, but I can see why he`d be annoyed.

    The question that I would like answered is why it was left up to an angry farmer to defend the American boarder? The article makes it clear that his land is a well-known `highway` for illegal immigrants, so why not spend a bit of extra money on posting more boarder patrol to properly protect his land, as well as the immigrants legal rights? Things like that should not be left up to an angry citizen.

    I feel bad for the immigrants - they must have it pretty awful to want to leave their country, family, friends etc and risk getting caught. But suing? Please! They have every right to be treated humanely which is another reason that the area needs to be properly policed, rather than the law enforcement relying on a man with a gun and a grudge.

    That is so wrong and stupid. If you are not a U. S. citizen, then you do not share in American civil liberties. Even with a visa, non-citizens` rights are restricted. Therefore, these illegals should not be allowed to sue in American courts. They can take it up with their own courts, but that would still probably get them nowhere.

    Sorry, bub, but I`m afraid it does mean you do not value human life as much as it SHOULD be valued... whether you like it or not. Property is NOTHING. Life is EVERYTHING. One does not equate with the other in any way, shape or form... and to imagine for one moment that damage to (or even walking on) someone`s property should be punished with death is over valuing that property by an infinite amount. Your involvement with any deaths in the past, rightly or wrongly, do not have any impact on this argument, however the mere fact you bring them up is telling.     Yes I have had dealings with illegals in the UK. Sure, they may by diffrent illegals but after I had to listen to a woman beg me for help to stay in my country because her children would die if she was deported was harsh wake up call for me.     Look at all the misplaced racism here.
    The problem is not the illegal aliens. Illegal aliens are really only secondary.
    Illegal alien`s come to the US to seek employment at a better life. Who`s at fault are the legal citizens who give them jobs. If Americans didn`t hire them they would keep searching for a better place to live.
    In 2007 California investigated and fined two companies for hiring illegal aliens. It is estimated that there are 10 million illegals in the United States.

While it`s true that border hopping in Europe is common, they don`t have an immigration problem the way we do. Illegal immigration is sucking the system dry here in the U.S. Ever go to an Emergency room in a hospital? You`d be shocked to see what you see. Regarding Euro countries, even many of them are now cracking down on immigration because they realize the blight that illegal immigration causes. Just look at the UK for example.     I remember once I was traveling to Taiwan about seven years ago. One of the people I was with was a U.S. citizen but she still had a Filipino passport from when she lived there. Once we arrived in Taiwan they refused to admit her into the country because they saw the blight the Filipino illegal immigrants were causing their country. Even though she could document she was a U.S. Citizen and the U.S. Embassy backed her on it, they still refused to let her in because of the source of her passport. I even asked one of the agents over there how they deal with illegal immigrants coming into their country and he said it was a major problem so they have a "shoot first, ask questions later" type of policy there. Get out in the world a little folks. You`ll realize the U.S. has a border issue that`s dealt with in kindness more than any other place on the planet.

    I love the negative spin some of you are intentionally putting on my words.

    Cutting across my property is not going to garner any response from me at all.

    Damaging my property and doing anything that could be construed as threatening my safety WILL garner an appropriate response.

    Said response could be anything from my telling you to to leave, to physical intervention and removal IF NECESSARY.

    I have a houseful of little kids right next door to me, subsequently balls, frisbees, and toys sometimes inadvertently come over the fence.

    All the kids next door know that they are more than welcome to enter my yard to retrieve their belongings if necessary, and understand that it is not safe to enter the yard if the dogs are outside unattended. If that`s the case they know to ring the front doorbell and tell me that a ball, or whatever has come over the fence, and will I get it for them.

    I take SERIOUS issue with those that seem to think that because I have taken human life, I do not value it.

    No one is more aware than me of the consequences of such actions, and yes, I have to live with the fact that I have had to do so.

    To say that someone does not value human life because they are capable of killing if necessary is ludicrous.

    The VAST majority of human beings are capable of, and will kill to save their own life.

    To believe otherwise is foolish.

    There is a HUGE difference between immigration and smuggling. You want to immigrate here? Fine. Do it the legal way. Otherwise, you run the risk of getting shot for trespassing. At least he took them to the authorities instead of shooting them right out. Come to America legally if you want, but don`t break laws to get here illegally just to leech off our system.

    And bhedgehog is correct, while we in the U.S. are supposed to be the "great melting pot" and welcome all immigrants, we do not.

    BUT, we do have one of the world`s more lenient immigration policies. Here in the agricultural midwest, there are more farm and ranch jobs than can be filled... and the majority of people who fill those jobs are Mexican migrant workers who come here and work LEGALLY.

    So I scoff at those who jump the border in the dead of night. All they need to do is apply for a work visa, and the state of Minnesota will welcome them and they`ll have NO problem finding work... in many cases, all they have to do is show up at a farm, say they want a job, and show their paperwork. The majority of small towns even have housing available just for the migrant workers.

    No illegal border crossing, trespassing and skulking in the dead of night necessary.

    They don`t have to win. I have already lost faith in the legal systems of Canada and the USA for this very reason. We let criminals sue a landowner for being caught trespassing, or in this case, illegal immigration. This is complete BS. There`s a reason the sheriff did nothing to stop the rancher. It reminds me of a story I read a few years back of some guy tripped on a toy and broke his ankle falling down the stairs of the house he was robbing. He sued the homeowner and *won*. The North American judicial system needs an overhaul. Too bad the time and money required aren`t there.

Well, how about the ranch owner`s civil rights? doesnt he deserve any? and they are not only breaking international laws, but also the are traspassing into his property So, Mexico and those 16 pieces of poo, STFU and go make and honest living instead of trying to syphon of this guys money, besides where the f*ck is he gonna get 32 million dollars from.

    If this bulls#it suit passes, there`s gonna be a lot of bodies laying out in the sun on the border. No one is gonna let an illegal immigrant off their property alive and there`s a lot of places to hide a corpse on 22,000 acres.

    If someone came in the back door to your house and you had to drive them out by pointing a gun at them, then they attempted to sue you for threatening them, they`d be wrong and your legal system would be officially f@cked if it sided with the trespassers.
