He went on the trip knowing damn well he had those seizures and he sat by the fire STILL knowing he had these seizures.

It is not like they held a gun to his head and ordered him onto that trip or sit by the fire.

I would say both parties were at fault. The guy should`ve taken more care. If you have a history of seizures, STAY AWAY FROM FIRE! On the other hand, the school should probably not have taken him on the trip.

If he has a history of seizures then its his own damn fault for going on the trip and knowing the potential risks he took.

ok. so he has a history of epileptic attacks, and chooses to go anyway WITHOUT consulting a physician. He was asked to tend a "flickering" campfire, and even though he knows that flickering can trigger attacks, he agrees WITHOUT mentioning he suffers from eplieptic attacks. Suprise! He has an eplieptic attack! So it`s the school`s fault he didn`t take proper precautions with his medical condition? It`s the schools fault for not saying hey you have epilepsy, your unfit to camp? I bet he would of sued for "discrimination" if they had done that. In my opinion he deserves a rooster for a nose if he`s going to be so irresponsible about his own health and limitations.

My sister has epilepsy and takes medication. She has not had a siezure in more than seven years. Once the docs had the meds dose right, no problems. I would have to say this is not an "open and shut" case.

I feel bad for the guy. I almost wish it was the university`s fault, but I think it`s just a tragic mishap and everyone wants someone to lay blame on someone for what`s happened to the poor guy. He should know how severe his condition is and should have requested an excuse from watching the fire. I have a hard time believing the university would have required him or denied him that right. According to the article they said he normally wouldn`t be allowed to go unless he`d been incident free for a year. The university may have not applied this rule because they thought he`d use his own better judgment.

Plain and simple the school will get punished even tho it was in fact his own fault. He should thank his school paper for posting the penis nose pic on the intarwebz. That will greatly help the pain and suffering now that everyone has seen this guy with said schnoz.

I do believe this is the university`s fault. He made it known he had epilepsy, he made it known he was taking medication for it, and they failed to have a doctor review the form or even see him. They left him alone with a campfire all night knowing that even with medication, you are not CURED of seizures. Medication only helps lengthen the time between seizures.

He should have, at the very least, had someone with him: an instructor, or a friend. Failure to do so put him at undue risk when he made every attempt to let them know his medical condition.

The university is at fault, in my opinion. This poor man`s life has been completely changed because of this incident and to put the blame on him for a condition he has no true control over, is just ludicrous.

If this outing was a REQUIRED part of his course, he would have had no choice but to go on it. That said, the university is liable, in my opinion, for the safety of its students. If only to cover their own butts.

First, let me say that I feel absolutely terrible for this guy. I can`t even imagine what he is going through, and wouldn`t wish this on anybody.

Despite the fact that this was a terrible tragedy, I don`t see how the university could have forseen this. The student had just as much opportunity and capacity to anticipate any accident of the sorts as the university did, which was NO CHANCE OF PREDICTING THIS. I mean, what can anybody do, patient or organization, if a freak accident could occur and they have to plan for such a possibility?

The universe owes this guy money and comfort. Fate owes this guy a fat check. But this isn`t the university`s fault and it was simply a horrible accident.

Thats horrible, but it is his own fault. He should be responsible enough to know when these kinds of situations can be potentially dangerous for him. He chose to go on the trip, why should the university pay. Did they push him into the fire? But I suppose he needs to get the money someway. i don`t know if any of you heard about it, but in 2007 (in kentucky), a house burned down and killed 10 people (4 adults, 6 children). the survivors tried to sue phillip morris and lost because it wasn`t phillip morris` fault the adults in that house were drunk and passed out with a ciggarette still lit, which ignited some curtains and quickly ate the house up. they had a mass funeral in the high school gym where so many people showed up they actually had to turn them away, and of course it was sad, but you can`t expect someone else to pay for your mistakes! the town donated food and money, and all the leftover money after funeral (a lot of which was donated) and medical expenses was put into an account for the survivors (one was a friend of mine). they weren`t happy with that, they wanted more.

this guy is just like them, he`s just GREEDY!

I completely agree with Almightybob1. This guy was 22 when it happened. Its terrible that it did happen, but he has to take responsibility for his condition. He was the one with epilepsy, and therefore would be the most aware of the dangers of sitting close to an open fire.

For the people saying he should have stayed away from the fire, he could have been three feet away staying close enough to the fire to stay warm stood up and had a seizure and fell into it. Think before you post gesh. The school should have atleast sent them out in pairs just in case something happend. What if someone was alone and got attacked by an animal and bled to death out there? If he signed a release of liability form, then the responsibility is his just as much as if he fell over in the street.

If he didn`t sign such a form, then the university should have had some form of insurance.

Either way, there must have been some way in which the university laid out exactly what their liability should be before he went on the trip.

Obviously, we don`t know what was agreed before the trip.

I feel very bad for this fellow, but I don`t think the universaty should be completely responsible for his injery. If you have a history of epileptic seizures you should know enough not to sit close to a fire. It is terrible for this guy. But people with conditions like this should always think about self preservation before doing anything that may put them in harms way. Maybe I could understand if he was a child or something, but at 25!!!! Come ON!

it sucks he fell into a fire and looks like gonzo now, but how can he sue because he had a sezuire and got burned? unless someone stood in front of him and purposely held a strobe light to his eyes, no one caused him to have a seizure, it just happened like every other seizure he`s had, but in a really bad place this time. if the school didn`t let him go he`d be crying discrimination. accidents happen, some are worse than others, but you can`t always get paid when something awful happens, especially when there`s really no one to blame.

We have no idea what type of epilepsy he has, for all we know he was never affect by flashes before.

And maybe he wasn`t near the fire. Maybe in his fit he rolled into it.

We simply don`t know enough to say he should take responsibilty. And if this happened to any of us I know we would want some money for it. So I hope he wins. And when you see all these poo lawsuits out there - for example the guys sueing Resident Evil for having black zombies - you just know this is at least better than them ones.

If I have Bi-Polar or depression and I was not watched and went and physically assulted someone so bad they needed surgery can I sue the school for not making sure I wasn`t manic? Because Bi-polar isn`t an insanity plea, suing would probably make sense, right?

This is why we have so many problems in America- no one takes responsibility for anything and everything is everyone elses fault- especially our failures.

I think this is a case of specific, and doubt he will win. Being in college I can surely say that it is mostlikely that this was a club event more than likely held by a student, not a faculty member, becasue how often in college do professors take students camping? They are not liable unless they are made aware of his condition and this student now has the burden of proof that they were aware. Chances are though, students are there for fun, not to babysit a condition, so if they were aware, he shouldn`t have went in the first place. Either way his own mistake, 1. going and 2.getting near a fire because he is the only one who factually was aware of his condition. Only in America..

I have epilepsy and I know it`s my responsibility to be aware of my safety. Sure I want to lead as normal of a life as possible but I also don`t want to permanently injure myself either. I don`t blame other people if I do something that I know is unsafe for my condition and I happen to get hurt. That`s just immature. I feel for the guy, I do. It`s just that he should have thought more before he went through with it. Not everyone is informed about epilepsy so it`s the people that have the condition`s responsibility to both inform others of what triggers them, what to do if a seizure occurs and keeping themselves safe.

It`s dicks like this, though, that cause schools to ban all the fun stuff. Growing up, my school board had banned any sort of "water sport activity" while on school trips. We went on a camping trip once and had to watch all the other kids from the other school boards water skiing and swimming and all that fun stuff that we weren`t allowed to do. It sucked balls >.<

Actually... I can nearly guarantee that he will win the case.
1. He can say the school has a DUTY to protect him in a school sponsored camping trip.
2. He can say that the school BREACHED their DUTY to protect him.
3. By allowing the student to be that close to a fire, they are LIABLE for his burns
4. It resulted in DAMAGE.

So according to law, he will win this case.... ain`t negligence cases a bitch.

I`ve wanted to take a similar Wilderness Survival course, but unfortunately it interfered with core courses, and I could always take another phys ed. elective that did not conflict.

So I`m sorry, but the only reason he needed the course to graduate was to fulfill a General Education requirement for Phys Ed. It would have said in the course description that the class will require you to survive, alone, in the wilderness. If you`ve had a history of seizures, I`m not sure you should ever be planning on going on any independent wilderness hikes in your entire life.

He could have taken Walking, Racquetball, or even Underwater Basket Weaving! He knew the dangers before enrolling in the course, had other options, but ignored that. I`m sorry, but its not the school`s fault.

I find this to be in no fault of the University at all. I have epilepsy and and it for about 10 years now. I know when I am going to have a seizure and from what I understand many other people know when they are going to have one as well. Either way he knew his condition and I don`t think special accommodations should have been made. All he had to do is use common sense and stay further away from the fire and this would never had happen. I do feel bad for him, however I think its his own fault.

Here`s a thought, he could have told officials about his case before enrolling in the class (which I seriously doubt was manditory) and not attended if it were. Regardless though, he signed up for the class on his own free will knowing the risks. If he didn`t, he`s a moron. So I`m sorry to sound a bit callous here but jeez dude, take some responsibility for your own life or live in a bubble but don`t blame everyone else for life happening.
