    AAlso, what right did the school official have to look through the pics that were on the phone? They said it was against policy to have phones at the school. Okay, take the phone away. But to look through the "contents" of said phone is not right at all.

    in Pennsylvania that actually is illegal, because as in most other US states, the age of consent is 16 years of age. So the 16/17 year old teens were not minors, and therefor WERE in possession of child pornography.

    what makes the people at the school believe that just because you took a students phone, gives you the right to look at what is on it. i garuntee that nowhere in the rules it says that they will look at your personal stuff. don`t get me wrong, i dont think it was right for the students to have the pics, but what the "school officials" did was an invasion of privacy

    This is a little bit hard to understand. I think they charged the teens for child pornography because those pictures ARE the very definition of child pornography. Does anybody catch my drift here? Any sexual photograph of a child is considered child pornography, wether it`s in the hands of some old pervert or not. Still, I find it a little weird that the teens were charged. I don`t think they knew what they were doing, buuuuuut whatever. This will probably scare them into being more careful. non-nice individuals.

    Also, the school officials shouldn`t have been looking at the phone and I`m not sure about the laws concerning this, but I`m not sure they can use that as evidence in a child pornography case unless somewhere along the line a search and seizure warrant was issued.

    This is not child porn. This is just teenagers getting pics from their peers. It`s the equivalent of a 25 year old man getting pics from a 21 year old woman. The differences are only in maturity. If they have to be punished for this then they shouldn`t be registered as sex-offenders. That is going to ruin their life.

    yeah, i didnt know you can ponograph yourself, seems kinda ridiculous, they may be foolish, but no one deserves to go to jail here, the girls took the pictures on their own without being under anyone`s captivity or restrain, and the boys acquired the pictures with their consent, so yeah, although i see the moral problem, i dont see why the "law" has to get involved

    i recently graduated high school, and it became common practice if you got caught with a cell phone to remove the battery and/or memory card so the administrators could not look through your photos or text messages. if not, they would go through your phone and slap you with charges for anything inappropriate.

    What happened to a right to privacy? Doesn`t going through a persons phone without their consent violate that right? Especially in the case of a minor who does not have a parent present?

    If this had been one of my kids I would have been beating that school administration down in the court room.

    I would think the appropriate thing to do here is to get them all into a classroom on a Saturday and maybe bring in one or two real sex offenders who have had most of their rights and privacy taken away from them, give a supervised class to these young people. If the class is good enough, these teens may see how their seemingly naive actions can have a huge snowball effect and ruin what should be some of the best years of thier lives.

    I think it would be totally inappropriate for them to slap the book down on them. Everyone handling this case should step back and remember what it was like to be young and have hormones.

    I dint think they can really do that, why would they be looking through the kids phone in the first place? If the kid had it out in class, then they just confiscate it, they have no right to look through your stuff, its an invasion of privacy. They can only look through your stuff if they think your suspicious of a crime or to be crime or if they have a warrant and good reasons

    that is so stupid. Under privacy laws, they technically can`t look through a childs phone. they are supposed to turn it off when they get it until it is returned to the child. Just the fact that they went through the phone constitutes that this case should be thrown out. And the rest of the related cases because they found out through the first childs phone. This is utterly ridiculous.

    If both kids are teens, is it still an offense? Anyway I work in a school, and we do take the kids phones when they use them but going through them would be bad for us. Not matter the content, we`d have parents coming to the school ready to fightsomeone because we went throught their kids stuff without a reason.

    HA. Same exact thing happened at my school. Except almost everyone in the goddamn place had the pictures. We had some stupid assembly about it and some cop was telling us we had like a week to delete the pictures before people started getting arrested and whatnot.

    But yeah. Child pornography is child pornography, and it`s illegal. I`m not sure how administrators even found out about the pictures, unless some stupid kid told them, which is possible. EVERYONE had those pictures.

    So long as these individuals have NO CONTROL over whether someone else proceeds to send them such messages, then they CANNOT by any moral standard be held responsible!

    Besides, they`re peers. Could they be arrested for seeing these images in person? Is that what these pigs (or their parents, for that matter) would prefer?

    Let`s just confiscate their brain in that case, because one of their memories might be pornog- I mean, photographic..

    I think its good that they are trying to discourage this kind of behaviour amongst 14 and 15 year old girls in a school. Its dangerous taking pictures of yourself completely naked to send to guy in your class. Say that guy gets in a major bust up with the girl who`s sent him a picture and then decides to go ahead and post the picture on the web out of spite. So its good practise i think just to teach the young girls not to send such pictures in the first place cause there is always a risk it reaches someone elses eyes. Although i do think the way they are going about discouraging them is totally wrong and the boys should not be in court, they`ve really done nothing wrong.

    Kids can be really dumb. With my cell phone carrier, picture mail is uploaded to the carrier website automatically (to my picture mail account). Now, it might be private to the internet, but who knows who is looking at them on the cell phone servers haha.
