I wouldn`t say that. It`s the thieve`s fault,if the victim decides that he wants a bottle wichhappens to have poison in his car, and someonewho steals the car drinks it, it`s their own fault. It`s like blaming the victim because he had a gun in the car and the carjackers shot themselves with it.

when he got carjacked, they stole his car, im guessing his phone was left in the car.
They didn`t text the criminals the texted the victim who either had his phone in the car or a synced gps.

But in all seriousness, that is some epic fail on their part. Idiots.
While you would probably not be found criminaly liable, you would almost certainly be sued in civil court.
Also, if they had his phone, and it was on, the police could have just tracked that down...had they actually wanted to put in some work.
Maybe, but they`d have to prove intent. There`s no law against having certain poisons in your possession; and so long as you have some plausible reason to have a poisoned bottled of scotch in your car (maybe it`s a science experiment or somesuch)you`d likely be fine. After all, you didn`t ask the thieves to drink the scotch, you just had it in your car.
