A cop chokes a camera man for filming in public and says, ""I can do whatever I want."" Can he?

ryan99, the media have special rights due to the free world having a free press. If they are on public property the police do not have the right to tell a member of the media to stop filming.

The only thing the media can`t do is film children without the consent of their parents which is why you often see footage of childrens feet or out of focus footage.

In this case the media is not subject to the whim of the police officer especially if they are not involved with the protest.

How can you lean towards the cop he has no legal right to tell someone to stop filming in a public place just becasue he wears a badge and a uniform does not give him carte blanche to dictate to people in that manner!

If a cop tells you to put a camera away, you should probablly put it away...You have to reason to defy him, though the officer has no reason to act like that. I am leaning more towards the cop`s side right now.

Police forces around the country need to get serious about training cops properly. I keep seeing case after case of cops who think that they can order someone to do just about anything, and then physically assault them if they don`t comply 100% immediately.

I know cops have a pooty job, and I suspect that most of them are doing their jobs well.

Still, there are just too many of these stereotypical videos involving some cop on a power trip turning a routine interaction into a career-ending video on the Internet.

as long as the camera man is not creating/involved with any sort of violence, on public property, and not taking pictures of anything that compromises national security, the police has no right to confiscate, delete, or otherwise obstruct the cameraman

The cameraman should be let go and that cop should be sued. Public ground, exercising his freedom of the press while filming a peaceful rally protected by the freedom to congregate, speak, and protest.

There are some really good cops out there that could be called heroes and the type of people that you look up to, but now you see more and more cops abusing power.

That`s the problem with cops these days - they seem to think that their job gives them the right to break the law. They seem to think they have the right to take others rights away from them on a whim. And the biggest problem is they think that their job is to make it seem like people are breaking the law. No, their job is to ENFORCE the law. Just like cops who need tickets at the end of the month, so they check the tags of everyone around them because no one is speeding. Instead of being content that everyone is following the law, they want to find something wrong with it.

I am usually the very first to call someone an idiot for claiming "police brutality". However, in this case I side with the cameraman. He was not breaking any laws, he was on public property, and that cop had an attitude problem.

Those kind of police are dangerous and need to be fired immediately upon discovery. There should be ZERO tolerance for police who break any law whatsoever. For instance... all the cops that don`t use blinkers or speed all the time. Yet, they`ll pull you over in a heartbeat and give you a ticket for the same thing.

What are you thinking?? There is no obligation (legal or moral) to obey the police unconditionally. The whole point of the Constitution is to delineate what the state *cannot* do. Freedom of speech, freedom of assembly and freedom of the press are *so* important that they are mentioned first in the Constitution before all other rights.

Hello.."freedom of the press" on PUBLIC street locations!! This is a cop who`s badge gives him a hard on!! It`s for reasons such as this that video is a necessity on the streets and on patrol cars, to PROVE power hungry "bad cops" and "bad people", so the rest of us mostly normal people can function in this insane world... Another example of power going to an individuals head, that cop should be booted out of the service not in 12 months or 18 months time but straight away its people like him that destroy the hard work that good cops do.
As far as I know he has no legal right to prevent a camera man taking footage unless he is obstructing the officer in his duties!? and you have to ask why does he not want footage of his actions taken!

umm am I the only one recognizing that the only thing the cameraman filmed was the cop and his ass get cuffed? never saw a march anywhere except for post-production stuff cut in.. maybe you are not allowed to film another person without their permission? and if he repeatedly tells him to stop filming and he doesn`t.. he`ll sit in..

the fact is that he had a right to film the march, it was in public place and it was a news reporter, they would have a license for that sort of thing. It;s not the fact that he arrests him or puts him into achoke hold, it`s the fact that he tells him to put the camera away before even stating for what reason or asking for their lisence to film

The Police officer does deserve to lose his job for his actions. Purely because he said "I can do whatever I want," because No, Police officers do not have free reign of control, and if he feels that he does, he is not mentally prepared to carry out his duties responsibly.
